HomeMy Public PortalAbout088-1990- ZONING - 3237 CHESTER BOULEVARD•- i I • •' 1 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 3237 CHESTER BOULEVARD, FROM C-2 COMMERCIAL DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as C-2 Commercial District the property located at 3237 Chester Boulevard; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from C-2 Commercial District to C-4 General Business District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 27IZ day of Y. ,1990, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was—L_to b in favor of/i recommending the passage of Ordinance No. 88-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-4 General Business District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. A parcel of land in the Southwest Quarter of Section Sixteen (16), Township Fourteen (14) North, Range One (1) West, in Wayne Township, Wayne County, Indiana, described as follows: Beginning at the southwest corner of said southwest quarter and running thence south eighty-nine (89) degrees and twenty- five (25) minutes east, along the south line of said quarter, two hundred eighty-four (284) feet; thence north zero (00) degrees and fifty-two (52) minutes east, parallel to the centerline of the United States Highway Number 27, three hundred forty-five (345) feet; thence north eighty-nine (89) degrees and twenty-five (25) minutes west, parallel to the south line of said quarter, two hundred eithty-four (284) feet to the centerline of said U.S. Highway Number 27; thence south zero (00) degrees and fifty-two (52) minutes west, along said centerline, three hundred forty-five (345) feet to the place of beginning. EXCEPT, twenty four hundredths (.24) acres, more or less, conveyed by said School Corporation to the State Highway Ordinance No. 88-1990 Page 2 Department of Indiana, per right-of-way grant record in Deed Record 278, page 122, in the Recorder's Office in Wayne County, Indiana, being a strip of land along the West side of the above described parcel for highway widening. Containing, after said Exception, two and one hundreths (2.01) acres, more or less. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. The property in question is located at the northeast corner of Chester Boulevard and Highland Road. The property is presently being used for retail sales through the business known as Pools & Patio Plus. The petition is requesting a change in zoning from C-2 to C-4 to enable Pools & Patio Plus to expand its product line to include the display and sales of mobile homes. Eighteen (18) notices of public hearing were sent to the residents surrounding the site. One (1) notice was returned to the Plan Department not oppossed to the petition. During the public hearing no one spoke in opposition to the petition.
