HomeMy Public PortalAboutADM-104_Temp Alternative Duty Policy_Effective 06-01-2018 City of Lebanon New Hampshire ADMINISTRATIVE POLICIES & PROCEDURES Temporary Alternative Duty Policy Policy Number Effective Date Last Revision Page No. ADM-104 6/1/18 Page 1 of 3 Approved by: Section 1.0: Purpose It is the policy of the City of Lebanon (hereinafter, “City”) to comply with those requirements set forth in RSA 281-A:23-b and NH LAB 504.04 as well as any other governing rules and/or regulations. Further, it is the objective of the City to provide meaningful, temporary and transitional work to employees who have suffered a work-related illness or injury so that a transition back to full duty may take place. Section 2.0: Scope Temporary Alternative Duty (hereinafter, “TAD”) is available to an employee for as long as his/her illness or injury requires (as documented by the treating physician) and as such duties are available. In no instance shall a TAD assignment exceed 18 months in duration from the date of injury. Temporary alternative duty is not intended, nor will it be provided, in those situations in which an employee has been deemed permanently disabled and unable to resume his/her previous position. Section 3.0: Procedure 1. The ill/injured employee shall timely provide the initial NH Workers’ Compensation Medical Form to the Benefits Coordinator. 2. The Benefits Coordinator shall review the initial NH Workers’ Compensation Medical Form with the appropriate Department Head and/or his/her designee. Where appropriate, the Benefits Coordinator shall then provide the ill/injured employee’s treating physician with a completed NH Workers’ Compensation Task Analysis form, the employee’s current job description and a proposed TAD assignment summary for his/her review and approval. 3. Upon receipt of the treating physician’s documented approval of the TAD assignment, the Benefits Coordinator shall send to the ill/injured employee a certified letter summarizing the following: a. the approved TAD assignment; b. the return-to-work date, time and location; and, City Manager City of Lebanon New Hampshire ADMINISTRATIVE POLICIES & PROCEDURES Temporary Alternative Duty Policy Policy Number Effective Date Last Revision Page No. ADM-104 6/1/18 Page 2 of 3 Approved by: c. that a failure to report for the TAD assignment on the specified date and time may result in a reduction or termination of workers’ compensation benefits. EMPLOYEE OBLIGATIONS - OTHER An ill/injured employee shall timely provide to the Benefits Coordinator a NH Worker’s Compensation Medical form, as completed by his/her treating physician, after each visit. REVIEW OF TAD ASSIGNMENTS The Benefits Coordinator shall be responsible for the ongoing review of any TAD assignment. RETURN TO REGULAR DUTIES Upon full release by the treating physician and subject to the statutory 18-month maximum reinstatement provision, the employee will resume the normal duties of his or her regular position. POSITION DESCRIPTIONS AND TASK ANALYSES Current job descriptions and NH Workers’ Compensation Task Analysis forms for each position within the City may be obtained from the Benefits Coordinator. NOTIFICATION(S) TO EMPLOYEES This policy and attachments shall be posted by the Benefits Coordinator in each work location for review by all employees. INTERACTION WITH OTHER LAWS/REQUIREMENTS To the extent that this policy is ambiguous or contradicts NH state law or NH Department of Labor (“DOL”) regulation, the language of the NH state law or NH DOL regulation will control.
