HomeMy Public PortalAbout004-1989-ZONING - 2300BLK CHESTER BOULEVARD ON THE WESTSIDEAMENDED ORDINANCE NO. 4-1989 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF'THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN THE 2300 BLOCK OF CHESTER BOULEVARD ON THE WEST SIDE FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO C-2 SU COMMERCIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A COMMERCIAL DEVELOPMENT UNIT PROJECT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District the property located on the west side of Chester Boulevard in the 2300 block; and, WHEREAS, it is the intent and purpose hereof tochange the zoning classification of said property from R-2 Single Family Residence District to C-2SU Commercial Special Use District, and to authorize the Special Use of said property as a Commercial Development Unit Project; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of ,1989, at which time remonstrances were Mard fr m all parties interested in or affected by this Ordianance; and, WHEREAS, the vote of the Richmond City Plan Commission was to D in favor of/' recommending the passage of Amended Ordinance No. 4-1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-2SU Commercial Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Part of the Northeast Quarter of Section 20-Township 14 North- Range 1 West, City of Richmond, Wayne County, Indiana, and more particularly describee as follows: Commencing at a brass plug marking the southeast corner of said Quarter Section and thence running South 89 degrees 59 minutes 09 seconds west along the south line of said Quarter Section 330.00 feet to an iron rebar marking the point of beginning of the tract described herein; thence running south 89 degrees 59 minutes 09 seconds west along the south line of said Quarter Section 462.00 feet to an iron rebar; thence running north 00 degrees 00 minutes 00 seconds east parallel with the east line of said Quarter Section 495.00 feet to an iron rebar; thence running north 89 degrees 59 minutes 09 seconds east parallel with the south line of said Quarter Section 462.00 feet; thence running south 00 degrees 00 minutes 00 seconds west parallel with the east line of said Quarter Section 495.00 feet to the point of beginning. Said above tract containing 5.250 acres. SECTION 2. That as provided in Articles 31, 45 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as a Commercial Development Unit Project. SECTION 3. That as a condition of being granted the Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a. The property owner shall prepare a committment to be recorded in the Office of the Wayne County Recorder agreeing Amended Ordinance No. 4-1989 Page 2 that the commercial outlot fronting on Chester Boulevard, as shown on the Development Unit Project site plan, shall not derive direct access from Chester Boulevard. b. The Special Use site plan and narrative submitted in the Special Use petition shall be marked Exhibit "A" and made a part of this Ordinance. C. The retention area serving the Special Use shall be enclosed by an eight (8) foot high security fence that will include barb wire at the top. d. Manor Drive shall be improved in accordance with Richmond City Street Standards. e. The site drainage plan for the Special Use shall be approved by the City Engineering Department. f. Access to the Special Use from Chester Boulevard shall be subject to the approval of the Indiana Department of Highways. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Mayor ATTEST: City C1 rk CITY PLAN COMMISSION RICHMOND, INDIANA February 2, 1988 Mrs. Sally Hutton, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 4-1989 Plan Commission Case PC-89-1 Dear Mrs. Hutton, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on January 24, 1989, on the petition of Rees Realty, owner, Gayle Gardner, agent, requesting to rezone property located in the 2300 block of Chester Boulevard on the west side, from R-2 Single Family Residence District to C-2 SU Commercial Special Use District, and also requesting Special Use Authorization for a Commercial Development Unit Project consisting of a proposed Super 8 Motel. Fifty -Nine (59) notices of public hearing were sent to the surrounding residents with two (2) returned not opposed to the petition. During the public hearing Dave Fulton, representing Indiana University East, spoke of the University's concerns about traffic congestion on Chester Boulevard and the need to ensure the compatibilty of new development with existing land use. Also during the public hearing, two (2) persons spoke in opposition to the petition citing concerns about traffic and storm water drainage. The Plan Commission determined that Ordinance No. 4-1989 should be amended by adding four (4) additional conditions to Section 3 of the Ordinance. These conditions relate to fencing the storm water retention area to provide security; to the improvement of Manor Drive which provides access to the project; to the project's overall site drainage plan; and to access off of Chester Boulevard to the project. The Plan Commission determined that with these additional conditions the petition complies with the requirements of the Zoning Ordinance. The Commission voted seven (7) to zero (0) to recommend that Amended Ordinance No. 4-1989 be adopted.
