HomeMy Public PortalAbout006-1989-ZONING - 1900BLK OF SOUTH L ST ON THE SOUTHSIDEORDINANCE NO.6-1989 AN ORDINANCE AMENDING CHAPTERF154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED IN THE 1900 BLOCK OF SOUTH L STREET ON THE SOUTH SIDE, FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO R-4 MULTI -FAMILY RESIDENCE DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968, designates the property described below as R-2 Single Family Residence District; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-2 Single Family Residence District to R-4 Multi -Family Residence District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 2F CC day of 1989, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to in favor of/in recommending the passage of Ordinance No. 6-1989. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-4 Multi -Family Residence District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto: Situated in the Northeast Quarter of Section Nine (9). Township Thirteen (13) North, Range One (1) West, City of Richmond, Wayne Township, Wayne County, Indiana, being part of a 78.0 acre tract described in Deed Records Volume 370, Page 318, in the office of the Wayne County Recorder, and being more particularly described as follows: Commencing at a railroad spike found at the northeast corner of said Northeast Quarter; thence North 90 degrees 00'00" West, 1286.30 feet along the north line of said quarter to a point; thence South 00 degrees 20' 55" West, 16.50 feet along the extension of the west line of Richard's Addition to the City of Richmond as recorded in Plat Bood 6, Page 68, to the northeasterly corner of said 78.0 acre tract, being the TRUE POINT OF BEGINNING for the tract herein described, witness an iron pin set South 00 degrees 20'55" West, 28.5 feet; thence South 00 degrees 20'55" West, 464.10 feet, parallel with the east line of said quarter and along the east line of said 78.0 acre tract, being also the west line of said addition to a point; thence North 90 degrees 00100" west, 200.00 feet, along a new division line parallel with the north line of said quarter to a point; thence North 00 degrees 20'55" East 480.60 feet, along a new division line parallel with the east line of said quarter to a railroad spike set on the north line of said quarter, being also the north line of Ordinance No. 6-1989 Page 2 said 78.0 acre tract, witness an iron pin set South 00 degrees 20'55" West, 45.00 feet; thence North 90 degrees 00'00" East, 134.50 feet along the north line of said quarter to a point at a corner of said 78.0 acre tract; thence South 00 degrees 20'55" West, 16.50 feet parallel with the east line of said quarter to a point at a corner of said 78.0 acre tract; thence North 90 degrees 00100" East, 65.50 feet parallel with the north line of said quarter and along a northerly line of said 78.0 acre tract to the point of beginning, containing 2.181 acres, more or less, 0.181 acres in the right-of-way of South "L" Street, being subject to legal highways and other easements of record. Bearing for the above description are based upon assuming the north line of the Northeast Quarter being North 90 degrees 00'00: East. Iron pins set in the above description are 5/8 inch by 30 inch reinforcing rods. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. DOOLEY DIRECTOR OF PLANNING, PERMITS ANO INSPECTIONS Mrs. Sally Hutton, President Members of Common Council and Ms. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 7-1989 Plan Commission Case PC-89-3 Dear Mrs. Hutton„ Members of Common Council and Ms. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, February 28, 1989, on the petition of the Richmond Board of Aviation Commissioners, Owner, the Richmond Sanitary District, Agent, requesting a change in zoning from AZ Airport Zone District to AZSU Airport Zone Special Use District and also requesting Special Use authorization for the land application of digested sewage sludge at the Richmond Municipal Airport. Twenty (20) notices of public hearing were delivered to the surrounding residents with two (2) returned to the Plan Department in opposition to the petition. During the public hearing, two (2) persons spoke in opposition, citing their concerns about sludge running off the Airport land and contaminating adjoining land and water. The Richmond Sanitary District has been granted a permit through the Indiana Department of Environmental Management authorizing the land application of digested sewage sludge on the Airport land. However, the City's Zoning Ordinance requires that Common Council adopt a Special Use Ordinance before any sludge may be applied to the land. Both the State permit and the City's Zoning Ordianance require a rigorous monitoring and reporting to ensure the environmental safety of the process.
