The Common Council of the City of Richmond, Indiana met in regular session Monday, June 1, 2009 in
the Council Chambers in said City.
PLEDGE OF ALLEGIANCE
PRAYER BY MR. WELCH
President Wissel presided and the following business was conducted:
ROLL CALL
Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing
Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn.
Also present were Vivian Ashmawi, Tim Lloyd and Pat James of Communities in Schools; Sue Routson of
Peer Helpers; Fire Chief Mike Crawley; Mayor Sally Hutton; Kim Vessels, Assistant City Attorney; Monica
Burns, Deputy Clerk; Ron Church, Director of Human Rights; Karen Chasteen, City Clerk; Tammy Glenn,
City Controller, Blair Beach, Park Department and Bill Thistlethwaite, Superintendent of Parks &
Recreation.
APPROVAL OF MINUTES
Mr. Parker moved to include the following in the narrative for Ordinance No. 31 -2009 after The Clerk read
Ordinance No. 31 -2009 on second reading by title only. Mr. Welch questioned if a solar panel would
produce enough power to be practical. Mr. Parker asked that an engineer from Richmond Power and
Light evaluate the feasibility of the panel prior to the installation, supported by Mr. Welch. Upon a vote
viva voce, the motion passed. Ms. Pappin moved to approve the minutes as amended of the meeting of
May 18, 2009, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
■ COMMUNITIES IN SCHOOLS PRESENTATION — Ms. Ashmawi, Mr. Lloyd and Ms. James
distributed information relative to current CIS activities in Richmond Community Schools and
reported on the progress being made.
■ PEER HELPERS of Richmond High School presented an update on Blood Drive and Safety
Survey
COMMUNICATION FROM THE MAYOR
■ $22,000 has been raised for the All American City Conference
■ 354 tall grass letters have been mailed and 120 court orders issued
■ The budget has been approved
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the May 14 & 21, 2009 meetings were accepted as presented.

• HUMAN RIGHTS COMMISSION: Ms. Cruse - Nicholson nominated Mario Simpson to the
Board of the Human Rights Commission, supported by Mr. Quinn. Upon a vote viva voce,
the motion passed.
• Chief Crawley reported $77,436.00 in savings (March, April, May) due to the closing of Fire
House No. 6.

ORDINANCES ON FIRST READING
Mr. Elstro moved to suspend the rules and read Ordinance Nos. 27, 34 and 35 -2009 on first reading by
title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed.
ORDINANCE NO. 27 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE U.S. DEPARTMENT OF
HOMELAND SECURITY, FEDERAL EMERGENCY MANAGEMENT AGENCY
The Clerk read Ordinance No. 27 -2009 on first reading by title only.
Presented by Chief Crawley, this Ordinance would authorize the Fire Department to submit a grant
application to the Federal Emergency Management Agency through its Assistance to Firefighters Grant
Program and to accept grant funding in an amount up to Nine Hundred Thousand Dollars and Zero Cents
($900,000.00). Said grant funding shall be used to purchase one Quint 100 foot aerial ladder truck.
Mr. Elstro moved to advance Ordinance No. 27 -2009 to second reading and to suspend the rules and
read by title only, supported by Ms. Pappin. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 27 -2009 on second reading by title only.
Council President Wissel declared Ordinance No. 27 -2009 on second reading and public hearing. There
being no comments for or against the Ordinance, Ms. Pappin moved for engrossment of Ordinance No.
27 -2009 as amended, supported by Mr. Miller. Upon a vote viva voce, the motion passed.
Mr. Welch moved to advance Ordinance No. 27 -2009 to third and final reading and suspend the rules and
read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.

Ordinance No. 27 -2009 was adopted with a 9 -0 roll call vote.
ORDINANCE NO. 34 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE WAYNE COUNTY, INDIANA,
FOUNDATION
The Clerk read Ordinance No. 34 -2009 on first reading by title only.
Presented by Ms. Beach, this Ordinance would authorize the Park Department to submit a grant
application to the Wayne County Foundation and to accept grant funding in an amount up to Three
Thousand Dollars and Zero Cents ($3,000.00).

Mr. Welch moved to advance Ordinance No.34 -2009 to second reading and to suspend the rules and

ORDINANCE NO. 35 -2009- A SPECIAL ORDINANCE VACATING A PUBLIC ROAD
The Clerk read Ordinance No. 35 -2009 on first reading by title only.
Presented by Tony Foster, this Ordinance would vacate a portion of Old National Road. This would be
used for commercial and multifamily residential development. Ordinance No. 35 -2009 replaces
Ordinance No. 32 -2009.
Ordinance No. 35 -2009 was referred to the Plan Commission for public hearing at its meeting on June 25,
2009.
ORDINANCES ON SECOND READING
ORDINANCE NO. 21 -2009 — AN ORDINANCE AMENDING ORDINANCE NO. 85 -2006, THE
APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR
DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (TBK)
The Clerk read Ordinance No. 21 -2009 on second reading by title only.
This Ordinance is a request of TBK America that Ordinance No. 85 -2006 and the original SB -1 be
amended to consider the actual amount of investment in the amount of One Million Seven Hundred Fifty
Nine Thousand Two Hundred and Thirty Eight Dollars ($1,759,238.00). The Tax Abatement Committee
recommended approval.
Council President Wissel declared Ordinance No. 21 -2009 on second reading and public hearing. There
being no comments for or against the Ordinance, Mr. Welch moved for engrossment of Ordinance No. 21-
2009, supported by Ms. Pappin. Upon a vote viva voce, the motion passed.
Mr. Welch moved to advance Ordinance No. 21 -2009 to third and final reading and suspend the rules and
read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 21 -2009 on third reading by title only.
Ordinance No. 21 -2009 was adopted with a 9 -0 roll call vote.
