HomeMy Public PortalAbout06-29-2009PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, JUNE 29, 2009 The Common Council of the City of Richmond, Indiana met in regular session Monday, June 29, 2009 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY MR. WISSEL President Wissel presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Sam Lahanis and Bob Wiwi, Richmond Sanitary District; Greg Stiens, City Engineer; Tammy Glenn, City Controller; Katie Baldwin- Chaney, Community Events Coordinator for Parks & Recreation; Monica Burns, Deputy City Clerk; Kris Wolski, Police Chief;Walt Chidester, City Attorney; Haley Studebaker, Matt Sheridan, Alex Christ, Erica Williams, Collin Bell, George Myers, Jennie Campbell, Kalie Miller and Dakota Collins represented the All America City Team; Sally Hutton, Mayor and Karen Chasteen, City Clerk. APPROVAL OF MINUTES Mr. Miller moved to approve the minutes of the meeting of June 1, 2009, supported by Mr. Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS ■ IF 1 WERE MAYOR, 1 WOULD ... essay contest winners were Runner Up- Terrell Wallace, Gallileo Charter School and first place, Patrick Marsee, Seton School. Mr. Wallace was awarded a $50 savings and Mr. Marsee was presented with a $100 savings bond. RESOLUTION 5 -2009 - A RESOLUTION OF RICHMOND COMMON COUNCIL AND MAYOR EXTENDING CONGRATULATIONS TO RICHMOND YOUTH FOR HELPING RICHMOND ACHIEVE THE TITLE OF ALL - AMERICA CITY The Clerk read Resolution No. 5 -2009 in its entirety. Presented by Mayor Hutton, this Resolution honors the Richmond All-America City team, consisting of 25 local youth, who participated in the competition in from of a jury of national experts and enabled Richmond, for the second time, to win the title of "All-America City ". Mr. Parker moved to adopt Resolution No. 5 -2009, supported by Mr. Miller. Upon a vote viva voce, the motion passed. COMMUNICATION FROM THE MAYOR ■ Mayor Hutton introduced members of the All America Team to Council. Common Council Minutes June 29, 2009 Page 2 of 4 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the May 28, June 4, 11 & 18, 2009 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS ■ Police Chief Wolski reported on the savings in 2009 overtime. MISCELLANEOUS BUSINESS ■ The Committee of the Whole meeting for the 2010 Budget was scheduled for August 25, 26 & 27, 2009. The Budget Adoption Hearing will be held September 28, 2009. ■ The next meeting of Common Council will be July 6, 2009. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 30 & 37 -2009 on first reading in their entirety, supported by Mr. Welch. Upon a vote viva voce, the motion passed. ORDINANCE NO. 30 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION (Park) The Clerk read Ordinance No. 30 -2009 on first reading in its entirety. Presented by Ms. Chaney, this Ordinance would authorize the Park Department to accept or reject donations for 2009 programs. Mr. Welch moved to advance Ordinance No. 30 -2009 to second reading and to suspend the rules and read by title only, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 30 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 30 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 30 -2009, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 30 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 30 -2009 on third reading by title only. Ordinance No. 30 -2009 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 37 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION (Garden City) The Clerk read Ordinance No. 37 -2009 in its entirety. Presented by Ms. Burns, this Ordinance would authorize the City of Richmond to accept or reject donations for the Clean Water for Garden City benefit concert which will be held July 16, 2009. Mr. Miller moved to advance Ordinance No. 37 -2009 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. There being no comments for or against the Ordinance, Ms. Pappin moved for engrossment of Ordinance No. 37 -2009 as amended, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 37 -2009 to third and final reading and suspend the rules and read by title only, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 37 -2009 on third reading by title only. Ordinance No. 37 -2009 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 29 -2009 — AN ORDINANCE AMENDING SECTIONS 53.05(v) AND 53.14 OF THE RICHMOND CITY CODE SETTING FORTH SEWER RATES AND CHARGES The Clerk read Ordinance No. 29 -2009 on second reading by title only. This Ordinance would amend Section 53.05(v) and 53.14 of the Richmond City Code. Richmond Sanitary District users residing outside the corporate boundaries of the City of Richmond benefit from the combined sewer overflow system to the same extent as users residing within the City. Ordinance No. 29- 2009 would mandate the payment of charges by these users for this combined system, in the same manner and amount, as necessary for the adequate and efficient operation of the combined sewer overflow system. Mr. Miller moved to amend paragraph 53.05 (v) (6) to read ...and whose property is located within the boundaries of the Richmond Sanitary District ..., supported by Mr. Welch. Upon a vote viva voce, the motion passed. Council President Wissel declared Ordinance No. 29 -2009 as amended on second reading and public hearing. Speaking in favor were Bob Wiwi and Walt Chidester. Opposing were Marvin Smith, Tim Cummings, Ron Crowe, Jim Jackson, Will Scoffer, Jeff Ross and Ms. Winchester. Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 29 -2009 as amended, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 29 -2009 as amended to third and final reading and suspend the rules and read by title only, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 29 -2009 on third reading by title only. Ordinance No. 29 -2009 was adopted with an 8 -1 roll call vote. Dissenting was Mr. Quinn.
