HomeMy Public PortalAbout05-04-2009PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, MAY 4, 2009 The Common Council of the City of Richmond, Indiana met in regular session Monday, May 4, 2009 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY MS. CRUSE - NICHOLSON Vice President Miller presided and the following business was conducted: ROLL CALL Members present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Bruce Wissel. Also present were City Attorney Walt Chidester, Assistant City Attorney Kim Vessels, Mayor Sally Hutton, City Clerk Karen Chasteen, City Controller Tammy Glenn, Human Rights Director Ron Church and Purchasing Manager Vicki Robinson. APPROVAL OF MINUTES Mr. Welch moved to approve the minutes of the meeting of April 20, 2009, supported by Mrs. Pappin. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ Lemonade Day was a great success ■ Neighborhood clean -ups are going very well ■ $10,000 has been raised to date for the All American City conference in June REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the April 23, 2009 meeting were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS ■ Urban Enterprise Association: The UEA Board recommended the re- appointment of Board members Jim Grimm, Etta Lundy and Phil Quinn. Mrs. Pappin moved to approve the Board recommendation. The motion was approved by consensus. MISCELLANEOUS BUSINESS None Common Council Minutes May 4, 2009 Page 2 of 3 ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 21 and 22 -2009 on first reading by title only and Ordinance No. 20 -2009 in its entirety, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. ORDINANCE NO. 20 -2009 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION FROM THE BONNER CENTER The Clerk read Ordinance No. 20 -2009 on first reading in its entirety Presented by Mr. Church, this Ordinance would authorize the City of Richmond Human Rights Department to accept a donation from the Bonner Center for Service and Vocation of Earlham College, Community Fund Committee in the amount of One Thousand Five Hundred Dollars and No Cents ($1,500.00). These funds will be used to fund a Fair Housing promotional campaign. Mr. Elstro moved to advance Ordinance No. 20 -2009 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 20 -2009 on second reading by title only. Mr. Miller declared Ordinance No. 20 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 20 -2009, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 20 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 20 -2009 on third reading by title only. Ordinance No. 20 -2009 was adopted with an 8 -0 roll call vote. ORDINANCE NO. 21 -2009 — AN ORDINANCE AMENDING ORDINANCE NO. 85 -2006, THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (TBK) The Clerk read Ordinance No. 21 -2009 on first reading by title only. This Ordinance is a request of TBK America that Ordinance No. 85 -2006 and the original SB -1 be amended to consider the actual amount of investment. Ordinance No. 21 -2009 was referred to the Tax Abatement Committee for due diligence ORDINANCE NO. 22 -2009 — A SPECIAL ORDINANCE MAKING CERTAIN FINDINGS AND AUTHORIZING THE CITY OF RICHMOND TO ENTER INTO GUARANTEED ENERGY SAVINGS CONTRACT (CONTRACT NO. 60- 2009- AMERESCO) The Clerk read Ordinance No. 22 -2009 on first reading by title only. Presented by Mrs. Robinson, this Ordinance would authorize the City of Richmond to enter into a Guaranteed Energy Savings Contract with Ameresco for the purposes of installation and upgrades of energy savings and conservation measures at the Richmond Municipal Building and Fire Station No. 1 Mr. Elstro moved to advance Ordinance No. 22 -2009 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Mr. Miller declared Ordinance No. 22 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 22 -2009, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Ms. Cruse - Nicholson moved to advance Ordinance No. 22 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 22 -2009 on third reading by title only. Ordinance No. 22 -2009 was adopted with a 7 -1 roll call vote. Dissenting was Mr. Quinn. ORDINANCES ON SECOND READING None ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
