M. PRESENT: TRUSTEE HOVEL TRUSTEE HOOVER TRUSTEE HOFF TRUSTEE RAU TRUSTEE SHEETS TRUSTEE MARSH MAYOR GIECK CLERK LESH Sever, audience members were present. MAYOR R. EDGAR GIECK PRESIDED CONFIRMATION The minutes of the May 21, 1991 regular O6/18/91 meeting were reviewed by the Board. MINUTES 91-08 MOTION WAS MADE BY TRUSTEE HOVEL, to approve the minutes as written. All members voting YES MOTION CARRIED APPROVAL Account payable 1991 June were reviewed. ACCOUNT MOTION WAS MADE BY TRUSTEE SHEETS, to PAYABLE approve the bills as presented. All members voting YES MOTION CARRIED FALL FESTIVAL Harvey Nelson and Randy Stevens appeared before Council requesting use of Liberty Park August 9, 10, and 11, 1991. They requested the Towns involvement in the Fall Festival. Monetary donations and participation in the parade, set up etc. is needed. They explained they are operating on a tight budget. If it was not for the committee, there would be no Festival. The committee will furnish the Town with a committee list and events list. Page - 1 MOTION WAS MADE BY TRUSTEE HOFF, to donate 0600. 00 to the Ault Fall Festival. Trustee Hovel stated the do nation wo uld be taken a en out of Economic. Development portion of the budget. All members voting YES MOTION CARRIED The Town Hall will sell raffle tickets for the Festival raffle. Several of the Town Board and employees offered to help the Festival committee in any way they are needed. PRENZLOW AGREEMENT Roger Prenzlow, owner of Stewart Mobile Home Park stated that #8 of the agreement concerning a 05. 00 surcharge on usage over 15 acre feet in a calendar year. He submitted a proposed change for this item. The proposed change is as follows: 8. In the event that Stewart Mobile Home Park exceeds its water allocation of 15 acre feet in any year, the Town of Ault shall have the right to charge a surcharge to the Mobile Home Park. The surcharge would be equal to the surcharge that North Weld County Water District charges at the time. If the mobile home park owner desires to avoid the surcharge, he or she may do so by: a. Supplying the Town with additional water rights, or b. Requesting the Town to rent from North Weld Water District additional water and reimbursing the Town for the cost. June 7, 1971 James Stewart furnished the Town of Ault with five acre feet of Big T water. According to documentation an additional five acre feet of water was furnished the Town. The records do not show this. This matter will be resolved. Page - 2 After lengthy discussion MOTION WAS MADE BY TRUSTEE HOFF, to amend Item #8 in the individual metering agreement to the proposal submitted by Mr. Prenzlow. RECORDED VOTE: YEAS: TRUSTEES HOOVER, HOFF, RAU, HARSH, MAYOR GIECK 5 NAYS: TRUSTEES HOVEL, SHEETS 2 MOTION CARRIED PUBLIC COMMENTS: Mayor Gieck stated that Gary White had talked with him before the meeting requesting the alley behind White 's Car Wash be paved. Harvey Nelson stated that the alley is too high and would need to be cut down. FENCE BID The security fence was advertised for bid in the North Weld Herald, published May 30, 1991. No bids were received. One bid from M-M Enterprises had been received and read at the regular meeting May 21, 1991. The bid follows: Job description: Fence quote for outside area of sewer treatment plant. 724' of 6' chain link fence to enclose the area where the wood existing fence is standing now. Area would be secured with 6' fence, with 3 strands of barbed wire, and 1-16' double drive gate. Total for all materials and labor for outside enclosure $5312. 00 Cost for removing old existing fence around the treatment 296. 00 TOTAL BID $5608. 0O MOTION WAS MADE BY TRUSTEE HOVEL, to accept the proposal from M-M Enterprises. M-M will be liable for a temporary enclosure around the imhoff tank during fence construction. All member voting YES MOTION CARRIED Page - 3 CONCRETE & DRAINAGE Request for bids for concrete and MAINTENANCE drainage repairs was advertised in the North Weld Hearld, published May 30, 1991. One sealed bid was received. The bid is from M & A Construction Co. They can' t get deep enough to cover it back up with asphalt. The pipe will be encased in cement and brought up to street level with cement. This will alleviate the need to replace the asphalt. If asphalt was laid over PVC pipe it would eat the PVC pipe. MOSQUITO CONTROL Complaints have been registered for mosquito problems. After discussion MOTION WAS MADE BY TRUSTEE HOVEL, to ask Eaton if we can borrow their fogger and spray when necessary. RECORDED VOTE: YEAS: TRUSTEES HOVEL, HOOVER, HOFF, MARSH, MAYOR GIECK 5 NAYS: TRUSTEES RAU, SHEETS 2 MOTION CARRIED Page - 4 COMMITTEE REPORTS: FINANCE AND BUDGET: Revenue and Expenditure with Annual Budget print outs, and Bank and C. D. Balances as of May 31, 1991 were distributed and reviewed. All of our out of state investments are back in state and in compliance with state statues. PARKS AND CEMETERY: Mayor Gieck had obtained a bid to have the playground equipment installed from Classic Construction. The total bid is $3000. 00. Discussion was held and it was the consensus that this estimate was too high. The installation of the playground equipment will be advertised for bid. The removal of the Hawthorn tree was discussed. It will interfere with the playground equipment. The possibility of moving the tree to the cemetery was discussed. Eaton Grove will be up to check on the Cottonwood tree in Liberty Park. The forest service inspected the tree and said it was planted too deep, and had possible root rot. The diseased Canadian Cherry trees in Liberty Park will be addressed by Highland Nursery. The tree board met and decided to give property owners the month of July, 1991 to come into the eight foot street tree clearance compliance. As of August 1st, any trees not in compliance shall be maintained by the Town of Ault. The property owners will be billed for such maintenance. For the month of July only, residents with tree trimmings can make arrangements with the Town Hall for disposal of tree trimmings only. An appointment will be made to open the gate at the East Side Park for disposal of these trimmings. Page - 5 Several parties have contacted the Town Hall concerning reserving Liberty Park for large functions. Discussion was held and it was decided that the policy first come, first serve would remain. LIBRARY The Town was unable to have a representative at the last Library Board Meeting. The Mayor appointed the following committee to the Library Committee: Fred Hoover Charles Hoff Larry Sheets This committee will meet July 15, 1991 at 700 p. m. WATER COMMITTEE: During the week of May 27, 1991 Utility Technical Services, Inc. , conducted a waterline leak survey for the Town of Ault. The purpose was to detect and locate any leaks in the water distribution system. The leak survey was carried out by the use of a Metravib noise correlator. The noise correlator determines the time difference between similar sounds (vibrations) or noise patterns reaching sensors positioned at opposite ends of the section of pipeline being tested. By measuring this time difference based on the velocity of sound and the distance between the sensors, the instrument will compute the location of any continuous noise, ie: leaks. At the conclusion of the survey four (4 ) leak noises had been observed and located. Three of these leaks are classified as small, that is five gallons per minute or less. The fourth leak, at Fry and First Avenue has been classified as moderate or five to ten gallons per minute. These leaks could total up to 25 gpm or up to 1, 000, 000 per month. Page - 5 The leak at Fry and s First Avenue has been repaired. As soon as Ledall 's schedule permits the remaining three leaks will be repaired. Utility Technical Services, Inc. will provide a no cost follow-up call once the leak at Fry and First Avenue have been repaired. Vern Ledall recommended that new water line be installed at Frye Street. Twenty years ago the waterlines were put in at Frye Street. Instead of coming off the main that noes up First Avenue, and putting a 2" or 3" water line up Frye Street, tapping off and going into the three houses, the 6" main was tapped three times with light weight copper and now the copper lines are deteriorating. That was the problem with our leak. Ledall 's recommended replacing this. His recommendation is to go up Frye Street with 4" ductile line and move the three curbatops in the middle of Frye Street to where they belong. Put meter pits out next to the street, thus alleviating the Towns responsibility for leaks going into the residences. Ledall 's will provide estimate for this work and it will be addressed when the proposal is received. PARKS Trustee Marsh suggested that the fence and gate be moved back to the tree line on the east side of East Side Park and locked. This will entitle patrons to use the Park, and yet control traffic around the storage shed and entitle the Town Maintenance man to control dumping tree trimmings. MOTION WAS MADE BY TRUSTEE MARSH, to move the fence and gate to the east to the tree line at the East Side Park. Property owners are to contact the Town Hall to arrange for gate to be opened to dispose of tree trimmings during the month of July, 1991 only. RECORDED VOTE: YEAS: TRUSTEES HOVEL, HOOVER, HOFF, MARSH, AND MAYOR GIECK 5 NAYS: TRUSTEES RAU, SHEETS 2 MOTION CARRIED Page - 7 Trustee Hovel stated he is getting an estimate for the water hydrant at Liberty Park. Mayor Gieck will get a watering schedule for Way Side Park and have it followed. STREET AND ALLEY Trustee Sheets has had requests from residences to erect stop signs at Allison and First Avenue, and Fifth Street and First Avenue, stopping south bound traffic at Fifth and Allison. There are numerous children area. Several solutions were offered. This matter will be tabled until the procedure of adding additional stop signs in researched. POLICE Bartell 's and Noe stated that false arrest is covered under the line backer policy. The coverage will be reviewed. The police committee recommended that the Evans Animal Control Ordinance be adopted with a few minor changes. The amendments are to be written into the Evans Ordiance and the amended Animal Control proposed ordinance will be reviewed at the next regular meeting. MOTION WAS MADE BY TRUSTEE HOOVER, to purchase a Motorola radio to be used by the third officer. All members voting YES MOTION CARRIED Trustee Hovel reported that the police committee is recommending holding court session without an attorney present. After discussion, MOTION WAS MADE BY TRUSTEE HOVEL, to inform the Town Attorney that our Police Department is going to handle the court appearances, and that his services will not be needed until further notice. Page - 8 TREE BOARD Trustee Hoff will get an estimate on moving the Hawthorn Tree and the trees in the cemetery. The Tree Board discussed planting a new tree at the water works. The Tree Board discussed street tree maintenance. Stan Cass has old landscape fabric he will donate. This will be at the base of the street trees. MOTION WAS MADE BY TRUSTEE HOFF, to give a thirty day notice, which will cover the month of July, for all residences with street trees in violation of the Tow,r, Ordinances, to bring their street trees under compliance. Starting August 1, the street trees not in compliance will be trimmed by the Town and the cost billed to the residence owners. All members voting YES MOTION CARRIED The cost of mailing the street tree ordinance to each town residence will be obtained and considered. PLANNING COMMISSION Trustee Hovel reported that no progress has been made toward the final inspection, or certificate of occupancy on the Schmidt Building. He has until the Fourth of July to bring the building into compliance. STAMPEDE OF TOWNS The Town has received an invitation from the Greeley Independence Stampede to participate in the Stampede of Towns. The Board expressed their willingness to participate. Trustees Marsh, Sheets, and Rau will make arrangements for a five member team. This will be held June 27, 1991 at 7:00 p. m. WELD COUNCIL The Weld Council will meet at the Ault Town Hall July 9, 1991 at 7: 30 p. m. Two County Commissioners will be present. The public is invited to attend.
