AUTHORIZING THE MAYOR TO EXECUTE A REGIONAL
CONTRIBUTION AGREEMENT (RCA) BETWEEN THE BOROUGH OF
CARTERET AND THE TOWNSHIP OF NORTH BRUNSWICK
WHEREAS, the Fair Housing Act, N.J.S.A. 52:27D-301 to 329 at -312, allows
two municipalities to enter into a contractual agreement, known as a regional contribution
agreement (RCA), for the transfer of up to 50% of a sending municipality's fair share
housing obligation to a receiving municipality within its housing region; and
WHEREAS, the Borough of Carteret ("Borough"; receiving municipality) and the
Township of North Bnmswick ("Township"; sending municipality) have reached an
agreement with regard to a proposed RCA between the municipalities; and
WHEREAS, said RCA provides for the transfer of 45 low and moderate-income
housing units to the Borough from the Township, with the Township providing the
Borough the sum of $20,000.00 per unit transferred for a total payment of $900,000.00;
and
WHEREAS, both of said municipalities believe the execution of this RCA will be
beneficial to the residents of their respective communities and will promote and facilitate
the availability of low and moderate-income housing within the housing region.
NOW, THEREFORE, be it resolved by the Mayor and Council of the Borough of
Carteret as follows:
1. That the propr~sed RCA between the Borough of Carteret and the
Township of North Brunswick is hereby approved and the Mayor is
hereby authorized and directed to execute the same upon its approval by
the New Jersey Council on Affordable Housing.
2. That should the Council on Affordable Housing approve either a
greater or lesser total number of low or moderate-income housing units for
transfer pursuant to the RCA, then the agreement and all payments
provided for therein shall be modified accordingly to reflect the actual
number of units approved for transfer by the Council on Affordable
Housing.
3. That a certified copy of this Resolution be forwarded to the Township
of North Brunswick, the New Jersey Council on Affordable Housing, John
B. Riggio, and the Borough Attorney.
