ORDINANCE NO, 18
AN ORDINANCE RESTRICTING THE DISCHARGE OF WEAPONS: AIR RIFLES,
OR BB GUNS WITHIN THE CITY LIMITS; PROVIDING FOR RULE AND REGULA-
TIONS FOR CITY FIRING RANGE AND THE USE AND FEE THEREOF; PERMITTING
AIR RIFLE AND ARCHERY INSTRUCTIONS OUTSIDE THE CITY FIRING RANGE
AND PROVIDING FOR PENALTY FOR VIOLATIONS HEREOF AND DESTRUCTION
OF WEAPONS.

Be It Ordained by the Governing Body of the City of Bel Aire, Kansas:
SECTION 1. Discharging firearms, or shooting with bow and arrow
deemed misdemeanor--Exception. Any person, other than an authorized
peace officer in the performance of his duty, who discharges or shoots
off any gun, pistol or other firearm, or any bow and arrow, within the
corporate limits of the city shall be deemed guilty of a misdemeanor,
SECTION 2. Discharging air rifle, pellet gun or BB gun deemed
misdemeanor--Exceptions. Any person, other than authorized peace
officer or animal control agent who fires or discharges any air rifle
pellet gun or BB gun within the corporate limits of the city shall be
~eemed guilty of a misdemeanor.
SECTION 3. Firing Range--Rules and Regulations. Rules and Regulations
pertaining to the use, maintenance and control of the city firing range
shall be sumitted by the chief of police to the governing body who shall
adopt and approve said rules and regulations. Said rules and regulations
shall be posted at all times at the city firing range and shall be
strictly adhered to by all parties utilizing same.
SECTION 4. Firing Range--Use permit required. The chief of police
may give written permission to any qualified individual, club, organization
or association to conduct supervised pistol, rifle or archery instruction
and practice at the city firing range. A copy of said written permit shall
be immediately filed with the city clerk.
SECTION 5. Firing range--Fees. The governing body may estalish and
charge reasonable fees for the use of the firing range commensurate with
the expenses and costs of the operation and maintenance of said firing
range.
SECTION 6. Air rifle and archery instruction permitted outside
firing range when--Liability. The ,chief of police, with the consent of
the city council, may given written permission to any qualified individual,
school, club, organization or association to conduct training and instruc-
tions in the firing of air rifles and archery at suitable places other than
the city firiag range,said place to be first approved by the Chief of Police;
when said instruction and training is under the supervision of a qualified
adult authority, and when instruction and training constitutes a regular
course of education sponsored by the school, club, organization or associa-
tion; and providing further said school, club, organization or association
assumes full and complete responsibility for any and all damages or losses
arising out of or incidental to said training and instruction.
SECTION 7. Violation--Penalty--Destruction or weapons authorized when.
Any person who violates any of the provisions of this chapter is guilty
of a misdemeanor and upon conviction thereof shall be punished by a fine
not to exceed five hundred dollars ($500.00). In addition to the penalty
for the violation of any of the provisions of this ordinance, the judge of
the municipal court may order any such ~eapon~ as pro~ided in this
ordinance to be forfeited to the city,and the same shall be destroyed
or 'c~used to be destroyed by the chief of police whenever such weapon
is no longer needed as evidence.
