The City has limited resources to enhance and maintain the aesthetics of some of our highly visible public spaces. This policy details the process by which partnerships are developed between private and non-profit entities and the City to beautify public spaces. Section 2.0: Scope This policy applies to all departments that are responsible for managing City owned property as well as those private and non-profit entities that/who agree to partner with the City for this program. Section 3.0: Definitions Public Way- the entire width between the boundary lines of any public highway, street, avenue, road, alley, park or parkway, sidewalk, leisure way, or multi-use path. Public Property- Property owned or under the control of the City Section 4.0: Policy Detail 4.1 Maintenance Agreements The City would like to enter into agreements with private and non-profit entities to enhance and maintain public spaces. These agreements can take one of several different forms. Below are some options however there may be other creative agreements that could also be structured. 1. Entities could agree to provide direct donated funding to the City to pay for or offset the cost to either use City resources or contract with a private service provider to maintain a designated piece of City property. Entity would be credited with a sign acknowledging their sponsorship. Entities could contract directly with a private service provider to maintain a designated piece of City property. (Liability Insurance?) 3. Entities could agree to use their own workforce to maintain the designated piece of City property. Workers’ Compensation Insurance is required as outlined in 5.3 below. Section 5.0: Procedures 5.1 Identification of public property for participation in this program The City will identify those areas that are prominent and would be appropriate for this program. Public spaces can include parks, leisure ways, traffic islands, properties where City buildings are located, etc… 5.2 Safety Protocols The location of the traffic islands and similar areas by their very nature pose a higher risk to the safety of persons working in those areas. The Department of Public Works will be provide written protocols and training for anyone who will be working in these higher risk areas. Appropriate safety garments and traffic safety devices in accordance with the MUTCD must be in place and used when maintenance operations are underway within public ways. 5.3 Workers Compensation Insurance Coverage Employees of private and non-profit sector entities are expected to carry workers compensation insurance coverage for their employees in accordance with the applicable sections of NH RSA 281-A. For those entities that are not required to have workers compensation insurance coverage and volunteer organizations, the City has limited insurance coverage for listed volunteers. In order to be covered by the City’s limited workers compensation insurance, personnel working on beautification projects must complete and submit a form to become a listed volunteer.
