HomeMy Public PortalAboutr 02:295No. 02-295 Date of AdoptionJu]'-~-u-~L'-~8-4~--18 2002 APPOINTING THE GHIEF OF POLICE AS GUSTODIAN OF RECORDS FOR THE POLICE DEPARTMENT WHEREAS, Section 2 of P.L. 2001, c. 404, amending and supplementing the Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), provides that the officer officially designated by formal action of the Governing Body of a public agency may be the Custodian of Government Records that are made, maintained or kept on file by said agency; and WHEREAS, Section 2 of P.L. 2001, c. 404, further provides that a Law Enforcement Agency is a Public Agency determined by the Attorney General to have law enforcement responsibilities; and WHEREAS, the Carteret Police Department has cleady been determined to have law enforcement responsibilities and prepares, maintains or otherwise keeps on file government records in carrying out its law enforcement responsibilities; and WHEREAS, the Chief of Police has advised the Governing Body that the Middlesex County Prosecutor's Office has recommended that all municipalities within the County designate by resolution the Chief of Police and/or his designee as the Custodian of Government Records for the respective police department. NOW, THEREFORE, be it resolved by the Mayor and Council of the Borough of Carteret as follows: 1. That the Chief of Police and/or his designee is hereby designated the Custodian of Government Records for the Carteret Police Department. 2. That the Chief of Police and/or his designee may be indemnified in performing their responsibilities under the Open Public Records Act.
