HomeMy Public PortalAboutOrdinance 74-384ORDINANCE NO. 74 -384 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9122, 9123, 9296 AND 9366 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO DEVELOPMENT STANDARDS FOR THE R -3 AND R -4 ZONES OF THE CITY THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. Subparagraph 2 of Section 9122 of the Temple City Municipal Code is hereby amended to read as follows: 2. Open Space shall mean ground floor area other than a required yard area, driveway, swimming pool, or off - street parking facility, which has an average gra- dient of not to exceed 5 %, with no building or structure located therein, except for non - habitable structures used exclusively for recreational purposes, and which has a minimum area of 250 contiguous square feet with a minimum dimension of 10 feet. Notwithstanding any other provision of this Section, open space shall include the required side yard area of any interior lot provided said area complies with each of the other provisions hereof. SECTION 2. Subparagraphs 1 and 2 of Section 9362 of the Temple City Municipal Code are hereby amended to read as follows: 1. Lots. (a) Area. The minimum required area of each lot in the R -3 zone shall be 10,000 square feet. (b) Width. The minimum lot width for R -3 zoned lots shall-TT-50 feet;provided that no new lot shall be created after the effective date of this regula- tion having less than the following minimum widths: 1) Interior lots shall have a width of not less than 80 feet. 2) Corner lots shall have a width of not less than 100 feet. (c) Permissible Lot Coverage. Buildings, in- cluding accessory buildings and structures, shall not cover more than fifty percent of the area of any lot. 2. Buildings. (a) Length. No building or structure shall exceed a length of 150 feet. (b) Hei ht: No building or structure shall exceed a eig t of 35 feet. (c) Lot Area Per Dwelling Unit: Minimum lot area per dwelling unit shall be 1,800 square feet. 1 1 (d) Minimum Gross Floor Area for Dwelling Units: 1) Bachelor units shall contain not less than 600 square feet. 2) One- bedroom units shall contain not less than 750 square feet. 3) Two - bedroom or one- bedroom and den units shall contain not less than 900 square feet. 4) Three - bedroom or two - bedroom and den units shall contain not less than 1,100 square feet. 5) For each additional bedroom in units of more than three - bedrooms, an additional 150 square feet is required. 6) Not more than forty percent of the total building complex shall be composed of bachelor and /or one - bedroom units. (e) Stairways: No exterior stairway shall be placed in front of, and within 10 feet, of any door or window. (f) Elevators: All buildings containing dwelling units above the third floor shall be served with ele- vators in addition to the stairways otherwise required by law. For purposes of this Section the number of floors, in a building shall be counted from the lower- most floor to the uppermost floor and shall include subterranean off - street parking areas. (g) Off- Street Parking: Each lot in the R -3 zone shall have, on the same lot or parcel of land, parking spaces as provided in Section 9291 as amended. At least two parking spaces per dwelling unit, each of which must be located in a garage or carport, plus one space, which may be either enclosed or unenclosed, for each three units or any fraction thereof. Such park- ing facilities shall be conveniently accessible and located only on such portions of the lot or parcel of land upon which structures may be erected. The off - street parking spaces which are required to be located in a carport or a garage shall be located upon the lot so that the vehicular access thereto is not directly visible from a public street. SECTION 3. Section 9366 of the Temple City Municipal Code is hereby amended to read as follows: 9366. Permitted Uses. No person shall use, nor shall any property owners permit the use, of any R -4 zoned lot for any purpose other than the following: 1. Principal Uses. (a) Uses permitted in zone R -3, subject to the 2 limitations, restrictions and regulations as set forth in Sections 9360, 9361, 9363, 9364 and 9365 hereof; and (b) The following professional - commercial uses: 1) Attorneys 2) Dentists 3) Medical Doctors The uses permitted by Subparagraph (b) hereof shall be subject to the limitations and restrictions as set forth in Sections 9390 through 9394 inclusive, hereof. 2. Standards of Development. The standards of devel- opment for the R -4 zone shall_ be the same as those specified for the R -3 zone in Section 9362 hereof, except as follows: (a) Lot Area Per Unit: The minimum lot area per unit shall be 1,200 square feet. (b) Floor Area Per Unit: Floor area shall con- form to the Uniform Building Code standards. SECTION 4. Subparagraph 2A is hereby added to Section 9123 of the Temple City Municipal Code, to read as follows: 2A. Parallel Parking Space shall mean a parking space which is situated parallel to the direction of traffic in a driveway, off - street parking facility or street. SECTION 5. Subparagraph 1 of Section 9296 of the Temple City Municipal Code is hereby amended to read as follows: 1. Size. Each off - street parking space, other than a parallel parking space, shall be at least ten feet (10') in width and at least twenty feet (20') in length. Each off - street parallel parking space shall be at least eight feet (8') in width and at least twenty -four (24') in length. All off - street parking spaces shall be provided with ade- quate ingress and egress. SECTION 6. New Subparagraph 14 is hereby added to Section 9296 of the Temple City Municipal Code, to read as follows: 14. Desi n of Parkin Areas. Off- street parking facilities uti izing ang a par ing spaces shall comply with the dimensions specified in the following chart and diagram. Dimensions for angles not listed shall be determined by interpolation. The City Clerk of the City of Temple City shall certify to the passage and adoption of this Ordinance and to its approval by the. Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, published and circulated in the City of Temple City.
