The FLSA regulates how employees are compensated for time worked over forty (40) hours in a workweek. As a municipality, the City may compensate employees with “compensatory time off” at the rate of one and one-half hours for each hour paid over forty (40). Section 2.0: Scope The following policy applies to City of Lebanon employees who are subject to the rules and regulation set forth by the Fair Labor Standards Act (FLSA). This includes all non-exempt positions who receive compensatory time off in lieu of payment for hours worked over forty (40) in a workweek. Section 3.0: Recordkeeping All compensatory time must be recorded on the employees’ timesheet each week. The timesheet must be verified, approved and signed by the employees’ department head. Section 4.0: Use of Compensatory Time Use of compensatory time off must be approved in advance by the employees’ department head. Compensatory time off should be used in a reasonable time frame which may vary from department to department depending upon work load. Note: To be consistent with other leave policies, when using a whole day, compensatory time shall be recorded as 8 hours taken. Section 5.0: Procedure A non-exempt employee who is eligible for overtime, with the prior approval of his/her department head, may accrue compensatory time off in lieu of payment for overtime. The compensatory time off shall accrue at the appropriate rate which is one and one-half hours for each hour paid over forty (40) hours in a workweek. Section 6.0: Maximum Balance The maximum compensatory time balance shall NOT accrue beyond 20 hours. The City reserves the right to direct an employee to take accrued compensatory time off. Hours will be paid at the employees’ last current base hourly rate at time and one half per hour.
