HomeMy Public PortalAboutOrdinance 74-385ORDINANCE NO, 74 -385 AN ORDINANCE OF THE CITY OF TEMPLE CITY AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF TEMPLE CITY AND THE BOARD OF ADMINISTRATION OF THE CALIFOR- NIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN AS FOLLOWS: SECTION 1. That an amendment to the Contract between the City Council of the City. of Temple City and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached hereto, marked "Exhibit A ", and by such reference made a part hereof as though herein set out in full. SECTION 2. The Mayor of the City Council is hereby authorized, empowered, and directed to execute said amendment for and on behalf of said Agency. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of gen- eral circulation, printed, published and circulated in the City of Temple City. ATTEST: Ch of Deputy City Clerk I HEREBY CERTIFY that the foregoing Ordinance, being Ordinance No. 74 -385, was introduced at a regular meeting of the City Council of the City of Temple City held on the 21st day of May and was duly passed, approved and adopted by said Council, approved and signed by the Mayor and attested by the City Clerk at a regular meeting of the said City Council held on the 4th day of June , 1974 by the following vote: AYES: Councilmen- Gilbertson, Greenberg,Merritt,Tyrell,Dennis NOES: Councilmen -None ABSENT: Councilmen -None Chief Deputy City Clerk EXHIBIT A AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF TEMPLE CITY The Board of Administration, Public Employees' Retirement System, hereinafter referred to as Board and the CITY COUNCIL of the CITY OF TEMPLE CITY, hereinafter referred to as Public Agency having entered into a contract under date of September 20, 1965, effective October 1, 1965, and as provided by Chapter 170, Statutes of 1971, which provides for participation of Public Agency in said System, Board and Public Agency hereby agree as follows: A. Paragraphs 1 through 12 are hereby stricken from said contract as executed effective October 1, 1965, and are hereby replaced by the following paragraphs numbered 1 through 8 inclusive: 1. All words and terms used herein which are defined in the Public Employees' Retirement Law shall have the meaning as defined therein unless otherwise specifically pro- vided. "Normal retirement age" shall mean age 60 for miscellaneous members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after October 1, 1965, making its employees as hereinafter provided, members of said system subject to all provisions of the Public Employees' Retirement Law except such as apply'only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except such as by express provision thereof apply only on the election of contracting agencies. 3. Employees of Public Agency in the following classes shall become members of said Retirement System except such in each such class as are excluded by law or this agreement: a. Employees other than local safety members (herein referred to as miscellaneous members). The following employees shall be excluded from member- ship in said Retirement System: FIREMEN AND POLICEMEN. ELECTIVE OFFICIALS. APPOINTIVE BOARDS, COMMISSIONS AND COMMITTEES. PERSONS COMPENSATED ON AN HOURLY BASIS. CITY TREASURER AND CITY ATTORNEY. 4 The fraction of final compensation to be provided for each year of credited prior and current service as a miscella- neous member upon retirement at normal retirement age shall be that provided in Section 21251.13 of said Re- tirement Law and reduced for members covered under Federal Social Security for all service prior to the termination of Social Security coverage for all service subject to the modification as set forth in said section. 5. The following additional provisions of the Public Employees' Retirement Law which apply only upon election of a contract- ing agency shall apply to the Public Agency and its employees: a. Section 21380 -7 (providing for allowances for survi- vors of members covered under the program upon death before retirement). 6. Public Agency shall contribute to said Retirement System as follows: a. With respect to miscellaneous members, the agency shall contribute the following percentages of monthly salaries earned as miscellaneous members of said System: (1) 0.19 percent until June the liability for prior (2) 7.67 percent on account rent service benefits. 30, 2000 on account of service benefits. of the liability for cur- (3) 1.00 percent on account of the liability for the 1959 Survivor program. b. A reasonable amount per annum, as fixed by Board to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or the periodical in- vestigations and valuation required by law. c. A reasonable amount as fixed by the Board, payable in one installment as the occasions arise, to cover costs of special valuations on account of employees of Pub- lic Agency, and costs of the periodical investigation and valuation required by law. 7. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amend- ments to the Public Employees' Retirement Law, and on account -2- of the experience under the Retirement System as determined by the periodical investigation and valuation required by said Retirement Law. 8. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within thirty days after the end of the period to which said contributions refer or as may be prescribed by Board regulations. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances, or adjustments on account of errors in contributions re- quired of any employee may be made by direct cash payments between the employee and Board. Payments by Public Agency to Board may be made in the form of warrants, bank checks, bank drafts, certified checks, money orders, or cash. B.
