LEAD-BASED PAINT RRP RULES
Ordinary renovation and maintenance activities can create dust that contains lead. Contractors who perform
renovation, repairs, and painting jobs in pre -1978 housing and child -occupied facilities must, before beginning
work, provide owners, tenants, and child-care facilities with a copy of EPA's lead hazard information pamphlet
Renovate R40t. Important Lead Hazard information for Families Child Care Providers and Schools.
Contractors must document compliance with this requirement. After April 22, 2010, federal law will require you
to be certified and to use lead -safe work practices. Georgia Environmental Protection Division Lead -Based
Paint and Asbestos Program (404) 363-7026.
Projects must be done by a Certified Lead Renovation Firm AND a Certified Renovator
When disturbing lead-based painted or coated surfaces or components more than 6 ft2 per interior
room or 24 ft2 of exterior surfaces AND all window replacements and partial demolitions of any size.
Asbestos/Environmental Notification to Georgia EPD for
Pro'ects Involving Demolition Wrecking, or Renovation
The undersigned hereby acknowledges that the issuance of this permit does not in any way grant permission
to the owner, owner's representative, or permit holder to proceed with demolition, wrecking, or renovation of a
structure prior to the filing of any required ten (10) day "Project Notification for Asbestos Renovation
Encapsulation or Demolition" form in accordance with the Georgia Asbestos Rules. The Georgia
Environmental Protection Division administers the rules. In most cases, the rules require both the owner and
the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by
an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before
renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed
demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the
building. Further guidance for regulatory compliance and contact telephone numbers are provided by the
brochures entitled Asbestos & Renovation and Asbestos and Demolition. Other environmental issues such
as asbestos removal techniques, lead abatement, ground contamination, or unusual site conditions may have
EPD regulations that could affect the project.
BMPs
While BMP deficiencies are not necessarily the fault of the owner or his agent, BMPs are their responsibility.
Two areas of deficiencies are in the most basic and common BMPs; Co — Construction Exit and Shc —
Sediment Barrier. Correct installation information can be found in the Field Manual for Erosion and Sediment
Control in Georgia, Fourth Edition 2002, Georgia Soil and Water Conservation Commission;

Problems with the Co is not limited to the installation, but to material. The stone will be a representation of
1.5"-3.5" stone or larger.
Type A sediment barriers have been installed where Type C is required and shown on the permit drawings.
Where two rows are called for they will be installed with a separation that allows for the first one to fail (fall
over) without impacting the second one. The complete assembly and installation must be compliant; steel or
wood postypost spacing, e C or A.

Dear Ms. Beaman:
The Shore Protection. Committee considered and approved permit #413 referenced above under
the Shore Protection Act O.C.G.A. §12-5-230 et. seq. The permit placards and permit conditions
are attached to this letter. All decision documents, as well as all other plans, documents and
materials submitted during the application process become terms of this permit and are now
enforceable conditions.
This letter and attachments are to be held by you for your files and for inspection by any
authorized persons. The expiration date for the permit is five (5) years from the date of issuance.
However, no construction may commence within the area of jurisdiction of the Act until the
expiration of thirty (30) days following the date of issuance, provided there is no legal appeal of
this permit, you have all other necessary federal, state and local authorizations and you have met
all of the standard and special conditions as required by this permit.
Project Description:
The permit allows for the construction and maintenance of an access stairway and connecting
walkway to the existing permitted, shared, dune crossover located within a 5' easement on the
shared property line for Lots 4A-1 and 4A-2. The structure will consist of a 4' X 16' set of stairs
with a 4' X 18' walkway. Standard and special conditions apply to this permit.
Permit Placard:
Enclosed is the permit placard to be posted at the work site (within 24 hours) for the duration of
the construction activity.
Post Construction Re uirements: Conn fiance Certification and File Maintenance
Also enclosed is a Certification of Compliance that must be submitted to us within 30 days
following completion of the permitted activity. Pleasc include this compliance form with the
post -construction survey, if required under the special conditions. Department staff will assess
compliance and provide you with a written verification of project completion and compliance.

Conveyance of Ownership Interest:
If you as the permit holder sell, lease, rent, or otherwise convey the land or any portion of the
land for which the permit was issued, you must notify the Department within 30 days of this
transfer or conveyance. The permit shall continue in force in favor of the new owner, lessee,
tenant, or other assignee so long as there is no change in the use of the land as set forth in the
original application. The Department will transfer the permit to the new owner with all of the
original terms and conditions.

1. The project must comply, as applicable, for areas permitted herein, with all other Federal,
State, and local statutes, ordinances, and regulations, and the applicant must obtain all
licenses and permits prior to commencement of construction.
2. This permit does not resolve actual or potential disputes regarding ownership of or rights in
or over the property upon which the subject project is proposed, and shall not be construed as
recognizing or denying any such rights or interests.
3. All plans, documents, and materials contained in this permit application, required by the
Shore Protection Act O.C.G.A. 12-5-230 et. seq. are apart of this permit and conformance to
such plans, documents, and materials are a condition of this permit. No change or deviation
from these plans, documents, and materials shall be permitted without prior notification and
approval by the Department or Committee.
4. No further encroachment or construction shall take place within State jurisdiction, except as
permitted by the Shore Protection Committee. Any modification of the plans or structure in
the jurisdictional area must be reviewed and approved by the Department prior to
construction.
5. A construction placard will be required to be btained from the Department up to 30 days
prior to the start of project construction and m st be posted at the site. This placard will

include certain steps in the construction of the permitted project that must be approved by the
Department prior to construction.
6. The exact location and configuration of this project must be reviewed onsite and approved by
Department staff immediately prior to beginning construction. Minor changes to the location
may be allowed or required in areas that have eroded or accreted subsequent to the original
jurisdictional determination.
7. No construction materials may be disposed of in the jurisdictional area of the Shore
Protection Act.
8. Any incidental impacts associated with the construction of this project must be rectified by
restoring areas to their pre -construction topographic and vegetative states.
9. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of
the ordinary high water mark.
10. If the permitted improvements are damaged, fall into disrepair, become dilapidated, are not
meeting their expected usefulness, or are not maintained at a serviceable level, then it is the
responsibility of the owner to remove the improvements. A new permit will be required to
retain and repair the structure, improvement or asset if it loses its structural integrity and is
no longer serviceable.
11. The Shore Protection Committee is not bound in the future to protect any asset or
improvements authorized by the permit.
12. The permit must be posted onsite within twenty-four (24) hours of beginning construction.
13. A copy of the above conditions must be supplied to the person in charge of construction.
SHORE PROTECTION ACT SPECIAL CONDITIONS FOR CROSSWALKS
1. The height of the structure(s) shall be at least 36" above the grade of the sand dune and the
width shall be no greater than 6'as measured from the outside posts at the time of
construction, to allow for sand movement or accretion in the dynamic dune field.
2. The terminal point of the crossover(s) shall be seaward of the seaward most dune but shall
not encroach into the active intertidal beach unless authorized by the Shore Protection
Committee (SPC).
3. The structure(s) shall begin at the landward toe of the landward most dune.
4. Vegetation may be cleared only for the width of the permitted structure. The maintenance
trimming of jurisdictional vegetation will only be allowed within 6" of the sides of the
structure and 7' high over the structure. Trimming must be done using hand tools.
5. Heavy equipment is prohibited in the Shore Protection Act Jurisdiction. The project must be
constructed using hand tools.
6. Clearing and grading of dunes is not authorized in conjunction with the construction of this
project; stockpiling material in the dunes is prohibited.
7. No motorized vehicles will be allowed on the structure(s) except for motorized wheelchairs
for handicapped persons and emergency vehicles.
8. If the shoreline erodes it will be the responsibility of the applicant to move the permitted
structure back to the dry sand beach. Permittee must obtain the appropriate authorizations
from the Department Staff and/or the SPC.
9. Any sand needed to restore the site to pre -project vegetated and topographic conditions, or
for backfilling, must be beach quality and obtained from an upland source and not from the

beach. Permittee must obtain the appropriate authorizations from the Department Staff and/or
the SPC.
SPECIAL CONDITIONS
1. The permitted stairs and walkway are for the exclusive use of Ms- Silva and her heirs. Unless
sooner terminated, this permit shall expire upon the expiration of the easement upon which it
relies. Upon expiration of the walking easement, all rights associated with the use of the
structure will revert to the owners of Lots 4A-1 and 4A-2.
2. Nothing in this permit shall be construed to adjudicate, establish, extend, expand, or diminish
any rights arising under that certain walking easement granted to Ms. Silva by Arnold J.
Seyden, Jr. and Randolph Warner on April 8th, 1996. Any conflicts that exist or may arise
between Ms. Silva and other persons dealing with property rights related to said easement are
property rights questions and should be resolved between private parties in a court of law as
contemplated by O.C.G.A 12-5-238(4).
3. Permittee may be required to provide a post -construction survey that locates the structures as
indicated in the application materials. Landscaped trees must be designated as such on the
survey. Such survey shall comply with the Georgia Plat Act, O.C.G.A. § 15-6-67 et seq.

Mr Beaman and Mr Harrison stated that construction of the cross over would be entirely within the five foot
easement.
At Mr Seyden's request, I spoke with his attorney (Mr Smart). Mr Smart repeatedly stated that the Court
ordered injunction to stop the construction process was in place. Mr Smart repeatedly stated that Mr Beaman and
Mr Harrison were trespassing.
I attempted to advise Mr Smart that Mr Beaman was in possession of a valid building permit. I attempted to
advised Mr Smart that the copy of the Court order presented to me by Mr Seyden was unsigned. Mr Smart
continued to shout into the phone and refused to allow me to speak. I returned the phone to Mr Seyden.
I advised Mr Seyden that I was not able to rule Mr Beaman and Mr Harrison were trespassing based solely on
Mr Smarts assertions. I advised Mr Seyden that I would attempt to gain additional information regarding the
matter from Dianne Otto (Zoning).
Mr Seyden and Mr Smart asserted that the permit was not valid since it was issued in the name of a deceased
person.
I telephoned Ms Otto. I advised her of the situation. Ms Otto stated that the City was aware of the pending Civil
litigation between Mr Seyden and Mr Beaman. Ms Otto stated that she was unaware of a Court ordered injunction
halting the construction. Ms Otto stated that Mr Beaman was in possession of a valid permit. Ms Otto stated that
the permit was valid even through it was issued in the name of a deceased person. Ms Otto stated that the permit
was issued utilizing information available through the City's Incode system. I relayed Ms Otto's assertion to Mr
Seyden.
Mr and his wife (Sue) stated a desire to contact the City Attorney (Bubba Hughes). Due to the fact that the
Seydens are represented by council (Mr Smart), I did not contact Mr Hughes on their behalf. I advised Mr and Mrs
Seyden that they could contact Mr Hughes themselves if they desired.
advised Mr Seyden and Mr Beaman, that at the time, I had no knowledge that would cause me to halt the
construction of the crossover. I advised Mr Seyden and Mr Beaman of my conversation with Ms Otto. I requested
both parties be respectful of each other. I provided both parties with my contact information and requested they
call me if they experienced any further difficulties.
Sgt Powers and I cleared the scene at 1031.
At 1113, 1 was once again dispatched to 1013 Bay Street for a dispute. I returned to the property. I spoke with
Mr Beaman and Mr Harrison. Mr Harrison stated that Mr Seyden had pulled up a number of the orange flags
delineating the easement. Mr Harrison and Mr Beaman stated that a verbal confrontation had occurred between
the parties (Mr Harrison & Mr Beaman 1 Mr Seyden & his friend "Ron").
Mr Seyden stated that he had spoken with the City Manager and the construction of the cross over was to be
halted.

I contacted the City Manager. The City Manager stated that she had spoken to Mr Hughes. The City Manager
stated that based on her discussions with Mr Hughes, the City would "reluctantly" issue a Stop Work order for the
project. The City Manager stated that she was en route to the scene to discuss the matter with the parties.
The City Manager arrived at Mr Beaman`s residence. The City Manager advised Mr Beaman that due to the
ongoing Civil litigation surrounding the construction of the dune cross over, she was issuing a Stop Work order.
The City Manager instructed me to prepare a Stop Work order listing "Matter under Civil litigation" in the
violation section. I prepared the order and issued it to Mr Beaman.
Mr Beaman and Mr Harrison requested that Mr Seyden be asked to refrain from removing any more of the
orange flags delineating the easement. I agreed to do so.

Narrative
On the above date and time I was contacted by Sgt Powers via cell phone reference a dispute at 1013 Bay
Street. I went to the location.
I spoke with the complainant (Arnie Seyden). Mr Seyden stated that he was in possession of a Court ordered
injunction halting construction of a dune cross over on the easement to the north of his property. I examined the
document presented by Mr Seyden. The document had not been signed by a Judge.
I spoke with the neighbor (Patrick Beaman) attempting to construct the cross over. Mr Beaman presented a
permit issued by the City of Tybee for construction of a dune cross over (Permit # 130508). Mr Beaman stated that
he was also in possession of a permit from the DNR for the construction of the crossover.
Mr Beaman and his contractor (Craig Harrison) showed me the walking easement from 1075 Bay Street
(Beaman's property) to the dunes at the rear of 1013 Bay Street (Seyden's property). The easement was
delineated by a series of orange flags. Mr Harrison and Mr Beaman stated that the flags were placed in
accordance with the survey submitted to the City at the issuance of the building permit.
