2 New Police Vehicles - Best quote was from O.C. Welch Ford Lincoln, Inc. Hardeeville, S.C. – Base price for 2015 Ford Sedan - $20,949 and for 2015 Ford SUV - $25,999 – Total cost including
outfitting for all four vehicles (1 explorer and 3 sedans ) is $119,406.49 . City will need to pay for
all or a portion out of general fund to purchase. 2014 SPLOST will refund the general fund as

3 Coastal Regional Commission Contract for $17,800 of funding towards Phase 1 of the Marsh Hen
Trail. Revenue line item – TBD. 4 Two Separate GEFA Loan Applications - Water Line Replacement and UV Disinfection – Total loans
are for 1,997,000.00 – 1.232,000 for the water portion at a 1.39% rate with the Water First
designation and $720,000 for the UV Projection at a .89% rate with Water First designation. Water
project consists of a second phase of water line replacement, replacing old asbestos-cement and
lead-jointed pipes with new C-900 PVC pipe. Second project is a sewer project and the City intends
to replace its aging UV disinfection system at the WWTF. After discussing potential funding options
with GEFA, they have recommended that we split the Phase 2 water line replacement and the UV

Consideration of Items for Consent Agenda
Mayor Buelterman called the consent agenda to order at 6:30PM on September 22, 2016. Those present were Julie Livingston, Monty Parks, John Major, and Barry Brown. Also attending
were Diane Schleicher, City Manager; Bubba Hughes, City Attorney; Angela Hudson, Director,
Finance Department; and Janet LeViner, Clerk of Council. Wanda Doyle and Bill Garbett were
excused due to traveling.
Mayor Buelterman listed the following items on the consent agenda:
• September 9, 2016, City Council Meeting
• Susan Estroff, Historic Preservation Committee
• Alcohol License Request: Special Event – Beer and Wine – Tybee Pirate Fest. Location
of Event: Tybee SEABAR, Inc., 16th Street Parking Lot, October 7th, 8th, and 9th , 2016
• To request the City Council’s approval of the City’s internal travel policies and
procedures. Discussion: John Major stated there are minor corrections and
formatting issues that have been forwarded to Ms. Schleicher. Ms. Schleicher
acknowledged and explained they have been forwarded to Ms. Hudson. Approved contingent upon the corrections being made.
• To request that the City Council’s approval of a proposal from Palmette Fire Apparatus
for $95,000 to purchase a used fire pumper, using $30,667 from the current vehicle budget in the SPLOST 2014 fund. Discussion: Barry Brown requested the fire
pumper that is currently parked next to the fire station be moved as it is the one
involved in the accident. Ms. Schleicher confirmed and will have it moved as soon as an
appropriate location can be found.
• Resolution – Pirates Fest Festival Resolution. Discussion: Ms. Schleicher stated this
Resolution is much the same as in previous years only this year the City will control the
sale of the wristbands. She explained the Tybee Island Police Department will sell the wristbands which will create more of a presence of the officers.
• Ante Litem Notice, Sharon Carson. Discussion: Mr. Hughes stated this is the same
Ante Litem Notice that has been sent to every municipality in Chatham County to include
Chatham County under the theory this is a CNT operation and municipality officers were
involved. This was not a CNT operation, there was no Tybee Island officer involved,
therefore his recommendation is TO REJECT Ante Litem and he will notify the attorney
accordingly.
• Establish date for Independence Day Fireworks in 2017. DISCUSSION: Fireworks to be
held on 4th of July 2017 due to public safety concerns.
Mayor Buelterman called the regular meeting to order at 7:00PM. All those present for the consent agenda were present.

Mayor Buelterman read a press release from Steven Clark, Executive Director, GEFA
regarding the Coastal Well Project on Tybee Island. He read: “GEFA is taking an incremental

approach to evaluate the viability of the Coastal Well and its current state which after the partial
collapse is at a depth of approximately 3,015 ft. They are currently analyzing the part of the
well that is functional within the cretaceous aquifer to estimate what the well might produce if
the preliminary production estimates indicate that an additional analysis is warranted the well
will be developed further to determine its actual production and will continue to provide periodic
updates.” Mayor Buelterman stated he will forward as updates become available.
Mayor Buelterman recognized Pam Helton, GMA, as she is visiting our City.
Swearing In Ceremony – Tybee Island Youth Council. Jan LeViner, City
Clerk/Director, Tybee Island Youth Council approached Mayor and Council. She was
joined by Mayor Buelterman and Haley Hill, Assistant Director, Tybee Island Youth Council. Mayor Buelterman administered the Oath to the members of the Youth Council as well as the
officers and thanked them for having an interest in the Youth Council. Ms. LeViner and Ms. Hill
recognized the outgoing officers, Jessica Turberville, President; Joey Webster, Vice President;
and MiKaree Stafford, Liaison to Mayor and Council with a Certificate of Appreciation for their
service. Mayor Buelterman presented Ms. Hill with a Certificate of Appreciation for her work
with the community through the YMCA and Tybee Island Youth Council. Ms. LeViner and Ms.
Hill explained the upcoming projects for the Youth Council which includes installing mechanisms
on the beach with plantings which will build dunes in the hot spots on the beach. They will
need to monitor the areas for dune growth as well as monitor the plantings. Ms. Hill stated the
Senior Advisors will work to make Jaycee Park more youth friendly and present their
recommendations to Mayor and Council at the March 2017 City Council meeting. Aliyah Dorsey, Chairperson, Chatham County Youth Commission approached Mayor and Council and
thanked the members of the Tybee Island Youth Council for taking an active part in their
community. Mayor Buelterman thanked everyone and especially the parents for their involvement in the Youth Council.
Consideration of Bids, Contracts, Agreements and Expenditures
T-Mobile Lease Amendment – This lease is an amendment to the existing T-Mobile
lease for equipment located on the water tank at 111 Butler Avenue and will increase the monthly income of $3,118 by 5% to $3,274/month due to the
additional requested equipment. Explanation: 505-00-38-1002 Tower Space
Revenue. Mayor Buelterman asked Ms. Schleicher the renewal schedule for the other cell towers on the Island. Ms. Schleicher stated she did not have the information but will have staff
forward to Mayor and Council. Mr. Major asked for clarification of the attachments in the
packet. Ms. Schleicher explained the attachments as she wanted to ensure Mayor and Council had all pertinent information regarding the proposed lease. Mayor Buelterman confirmed with
Ms. Hudson the funds are going to the Water/Sewer Department rather than Green Space.
Monty Parks made a motion to approve. Barry Brown seconded. Vote was unanimous, 4-0.
Memorial Park Restroom Construction Contract – Arentz General Contracting – Infrastructure Committee recommended base bid and Alternate #2 – glazed block
interior finish and to consider using 24 gauge Max-Rib Galv. Aluminum for the
roofing material which is the same at the new pavilion. Need approval of the contractor with roof change and approval of Alternate #2, approval for mayor to
sign a contract with contractor contingent on legal approval, need approval of using
2014 SPLOST for project. Explanation: Total contract cost of $286,538.50 if they approve the options that we have discussed [(Base Bid) + (Bid Alt #2) + (50% of bust requested relief) – (VE option)]. This is more than what was budgeted in the

2008 SPLOST for the Memorial Park Restrooms, so infrastructure committee
recommends using 2014 SPLOST that was planned for the Jaycee Park Restrooms and Storage to pay for the Memorial Park Restrooms. City Council can budget for the
Jaycee Park Restrooms in FY 18 from the 2014 SPLOST. Budget Line Item Number
(if applicable): 322-6125-54-2100 (2014 SPLOST) and 320-6125-54-2100 (2008 SPLOST). Ms. Schleicher confirmed the renovation of bathrooms in Jaycee Park will be
postponed until next budget cycle due to the increased cost for Memorial Park Restrooms. In
this way there will not be a need for an additional mobile bathroom. Mayor Buelterman
confirmed with Ms. Schleicher that the roof materials are being changed as it is more cost
effective. Ms. Schleicher responded that after a discussion with the contractor it was
recommended the roofing materials be changed. She continued that no other internal changes
have been made. Mayor Buelterman asked Ms. Schleicher to explain the increase in the original budget. Ms. Schleicher stated the footprint and size was increased as well as glazed block
added to the scope which caused the additional funding. Monty Parks made a motion to
approve. John Major seconded. Vote was unanimous, 4-0.
To receive directives from the City Council regarding amending the FY2017 General Fund budget to renovate the city hall building upon their review of the FY 2016
General Fund’s net earnings of $1,298,627. Mr. Major asked Ms. Hudson if Mayor and Council moves forward with this request, will the general fund balance be reduced by
$1,298,627. Ms. Hudson confirmed. She further explained it is not anticipation the amount will
be used as she is estimating the project not to exceed $900,000. Mayor Buelterman confirmed
this agenda item is not authorizing Staff to move forward with construction but to only to move
forward with preparing a budget for the project. Mr. Parks stated he is not in favor of this
expenditure until a report is received recommending the amount needed in reserve for
expenditures in case of an emergency. Mayor Buelterman confirmed. Mr. Major stated the
beginning fund balance for the beginning of the fiscal year is $6,759,174 and if the City moves
forward with the renovation and the fund balance is adjusted, it will be $5,733,706 which is a
reduction of $1,025,668. Ms. Hudson confirmed. Mayor pro tem Brown asked Ms. Hudson
when she expected the report from the firm regarding the amount of money needed for the City to continue if hit by a hurricane. Ms. Hudson responded originally it was a six month
project and she will reach out to them for status. Mayor Buelterman is in favor of the
renovation of City Hall and would like to move forward but not at the expense of the Reserve
Fund. He asked Ms. Hudson to bring back an estimated time frame for the report to be
completed at the October 27, 2016 City Council meeting. Ms. Hudson confirmed. There was a
brief discussion regarding the FEMA requirements and total cost of the project. Ms. Hudson
stated the cost of the walls are separate as the limitation of the 50% is based on construction cost which would be $465,985 as that is half the appraised value of the building. The dirt walls
are considered furnishings as they are moveable. Mayor pro tem Brown stated he is working
with Mr. Shaw and they derived the cost per square foot would be $50.00 to renovate City Hall.
He recommended Ms. Hudson get a linear footage price and they meet to further discuss. DEFERRED. To be heard on the October 27, 2016 agenda.
To request the City Council’s approval of an employee purchasing card policy for full time employees under the supervision of the City Manager. Mr. Major stated he
forwarded minor edits to Ms. Schleicher. Ms. Schleicher confirmed and explained there are two
options before Mayor and Council. Option 2 is the closest to what is being done currently.
There was a short discussion regarding the spending limit for each department. Ms. Hudson
recommended Option 2 as it gives staff flexibility. Mr. Major questioned the staff member from
Public Works Department that has a $50,000 a month spending limit. Ms. Hudson explained the

level is due to possible emergency purchases over a weekend. Ms. Livingston confirmed the
new cards are credit cards and not debit cards. Ms. Hudson confirmed. Monty Parks made a motion to approve as amended using Option 2 and to correct amount
associated with the Public Works employee of a limit of $50,000. Julie Livingston seconded.
Vote was unanimous, 4-0. Revision to the policy on overtime/compensatory time off; approval and designation
for public safety personnel to comply with the FLSA standards. Mayor Buelterman
asked Ms. Schleicher if this will result in a pay decrease for any member of Staff. Ms.
Schleicher confirmed. She stated the reasoning behind the proposed policy is the hiring of the
firefighters. The firefighters will not see a decrease but the Tybee Island Police Department
(TIPD) would not be paid for the six hours every two weeks of planned overtime as they have
an unusual schedule. Ms. Hudson stated Staff does not plan to have overtime all the time. The
TIPD budget last fiscal year was $50,000 and their expenditures were well over budget. Ms.
Schleicher stated this is due to the events on the Island where the officers are asked to work.
Currently, the City has a more generous policy than is required by law. The Fair Labor Standards have a lower threshold and the City is above that threshold. Ms. Hudson stated the
services provided by the TIPD are not being reimbursed as it is in-kind and the fees have been
waived. Mayor Buelterman commended the members of the TIPD for their service to the community and express his concerns with the possibility of cutting their pay. Ms. Hudson
stated the advantage to a public safety position is they have automatic promotions and pay
raises where other employees do not. Ms. Livingston asked if there has been feedback from
the officers. Ms. Schleicher stated she met with Chief Bryson, TIPD, and Chief Fields, TIFD to get their viewpoints. Chief Bryson thanked the City for being generous with the paying of
overtime as most municipalities do not. He also uses this benefit as a recruiting tool. Ms. Elliott
approached Mayor and Council to answer any questions and address concerns. She stated the
officers work three 12 hour shifts one week and the following week four 12 hour shifts which
equates to 84 hours of which 4 are overtime. Mr. Major asked what would be the financial
impact for the typical officer if the changes are made. Ms. Schleicher gave an example if the
officer salary was $20 per hour for overtime that would be $30 per hour. For the 6 hours, the officers would lose approximately $60 per pay period. Mayor pro tem Brown stated if a person
that is hourly works over forty hours they should be compensated appropriately. Ms. Hudson
stated if there are no changes the overtime budget needs to be adjusted as they were over
budget by $33,000. Mayor Buelterman shared his concerns regarding the need for overtime
during special events. Ms. Schleicher stated 80 hour per two weeks is mandatory and the
officers might have flexibility with overtime. Ms. Elliott responded that she is not aware of any
other municipality that pays public safety employees 80 hours. Mayor Buelterman recommended the Public Safety Committee review and brings their recommendation to Mayor
and Council at a future council meeting. Mr. Hughes recommended Mayor and Council approve
the fire fighter portion. Ms. Schleicher confirmed. Mayor pro tem Brown asked Ms. Elliott if it is
more beneficial if the TIPD go to three shifts. Ms. Elliott responded that she spoke with Chief Bryson regarding an 8 hour shift, keeping them to 80 hours every two weeks, therefore no
overtime. Mayor Buelterman called for a motion. Monty Parks made a motion to approve
the fire fighter portion only and consider additional review by the Public Safety Committee regarding the Police Department. Barry Brown seconded. Vote was unanimous, 4-0.

Council, Officials and City Attorney Considerations and Comments
Mayor Buelterman stated it is his understanding the Infrastructure Committee has met
regarding the Pedestrian Friendly North-end and South-end and the Beachside of
Butler, 14th, 15th, 17th and 18th Streets Safety Improvements. He would like to ensure
the City is moving forward with both issues. Mr. Parks requested the area between Butler Avenue and Lovell Avenue is included as there are public safety issues. Ms. Schleicher
confirmed that the topics will be included in the future Public Safety Committee agenda. Mr.
Parks publically thanked Ava McNally for bringing the safety concerns to Mayor and Council on
14th Street.
Mayor Buelterman recommended a means for the purchase of a Gift Card to purchase
Parking Passes. Ms. Schleicher responded the recipient would need to come to City Hall and
fill out the proper form and a decal could be purchased with a gift card.
Mayor Buelterman recommended Staff investigate the process to Apply for State Program
for Highway 80 as Greenway and brings back recommendations to a future workshop. Trade Center Hotel/Motel Tax Authorization. Mayor Buelterman stated the proposal
before them is the same the City of Savannah has approved contingent upon the other municipalities approving. Chatham County has already agreed to a 50 year agreement and
what is being asked of Mayor and Council is to approve a 20 year agreement. He explained the
Trade Center would like to expand the facility and in order to expand they are requesting a long
term commitment. Mayor Buelterman stated if there was a way to legally direct more of this money to the City, he would recommend consideration. As there is not additionally going
forward would assist the City with the issues at hand such as the deep well, beach re-
nourishment, matching funds for the $3M study the federal government wants to do to extend
the beach re-nourishment project plus other projects. Mr. Parks stated the Tourism Council
understands the need for the commitment. Mayor Buelterman stated there are two questions:
(1) Issues with the extension if the City tax is raised to 7 cents which is resolved in relationship
to the Authorization. Mr. Hughes stated the contract as proposed would have to be adjusted to accommodate that as long as the percentage to the Trade Center would not change and (2)
reporting issues. Ms. Schleicher responded those have been resolved. Mr. Hughes stated this
is an Amendment much like in the past to extend the contract. He continued, that under the
state law, if the City collects 6% they are required to pay 1% to the Trade Center whether
there is a contract or not in place. The contingency of having possibly pursuing a change in the
rate of tax, that provision would be where it needs to be altered. Mayor Buelterman confirmed.
Ms. Hudson explained with the law, any non-profit the City includes in the budget, is required to submit a budget for approval on how they are spending the money. Mayor Buelterman
recommended approval. Mr. Hughes confirmed the contract would be for 20 years or until the
Trade Center ceases to perform the purposes under the Act. Monty Parks made a motion to
approve as amended for a twenty year commitment and contingent upon the possibility of changing the clause to pursue possible revising the City of Tybee’s rates which would not
impact the Trade Center receiving 1%. Julie Livingston seconded. Discussion: Mr. Major
asked for clarification regarding the rates whether it be 7%, 8% or higher. Mr. Parks stated the Tourism Council is in favor or moving forward with the approval of the contract. Mayor
Buelterman discussed the benefits of the contract as it will provide funds, both capital and
operating. He stated that Ms. Doyle is supportive of the approval as is Mr. Garbett. Vote was
unanimous, 4-0.

Monty Parks stated he was recently involved in a music event at the pavilion and
recommended Ms. Schleicher look into purchasing fans for large pavilion in Memorial Park.
Ms. Schleicher confirmed and will work with the Infrastructure Committee for pricing and
installation.
Closed doors required for bars with entertainment. Monty Parks stated in the current
ordinances there is a noise ordinance for commercial areas, you are to be less than 75db at the
property line. Also, there is a nuisance ordinance where Sec 12 states entertainment centers
must have the doors closed. He recommends that instead of having two noise ordinances,
there be one that requires noise no more than 75db at the property line, let the doors be open,
and if there is a complaint, enforce the current noise ordinance. This will promote a better feel
especially on 15th Street. Mayor pro tem Brown recommended the decibel reading take place
from the property line of the establishment. Mr. Major recommended a text amendment and in
this way there would be a public hearing and have input. Mayor Buelterman confirmed.
John Major stated the CRC has been reinstated and advertised for membership. Currently there are four members which is not a quorum. He that with the Master Plan and new Carrying
Capacity Study there are over 200 recommended action items. His recommendation that a new
committee be formed, Master Plan Implementation Committee, to review the action items and
ensure the City is staying on task. The CRC would then be disbanded. Mr. Parks stated he is in
favor of the recommendation for a new committee but would like to see the CRC remain and
pursue one more membership drive. Mr. Major confirmed.
Julie Livingston made a motion to adjourn to Executive Session to discuss litigation, real
estate acquisition and personnel. John Major seconded. Vote was unanimous, 4-0.

Mayor Buelterman called the Special City Council meeting to order at 6:00PM on October 17,
2016. Those present were Monty Parks, John Major, Wanda Doyle, Barry Brown and Bill Garbett. Also attending were Diane Schleicher, City Manager; and Janet LeViner, Clerk of
Council. Julie Livingston was excused due to illness.

Revised Dates: Tybee Island Pirate Fest: October 28 – 30 @ various times (16th
Street Parking Lot, Tybrisa/Strand; North Beach Parking Lot for 10/28 parade
staging and parade route). Plus October 25 - November 8 for carnival ride in 14th
Street parking lot between 15th and Marine Science Center and the Pier/Pavilion.

Consideration of Bids, Contracts, Agreements and Expenditures
GEFA Loan Application – Water Line Replacement and UV Disinfection – Total loan
for $1,997,000.00 at a 1.39% rate with the Water First designation. Project
consists of a second phase of water line replacement, replacing old asbestos-cement
and lead-jointed pipes with new C-900 PVC pipe. Also, the City intends to replace
its aging UV disinfection systems at the WWTF. Mayor pro tem Brown expressed his
concerns with the interest rate remaining at the low rate. Ms. Schleicher explained there are no
concerns with an increase in the interest rate. She then stated this project will also tie in with
the repaving of Butler Avenue. Mr. Parks stated there might be a slight increase in the
water/sewer bills in the future due to the improvement(s). Ms. Schleicher confirmed. Mayor
Buelterman questioned the remaining improvement on the sewer lines. Ms. Schleicher
responded there are a handful of force mains that need attention but are not as old as the ones
included in the agenda item. Mayor Buelterman stated in the wake of the recent hurricane he
would ask the Infrastructure Committee to review the issue of the lift stations and generators.
Ms. Schleicher confirmed. She then commended Mayor and Council for their attention to the
infrastructure in the past as if this had not been a priority there might have been catastrophic
damages to the Island as a result of the recent hurricane. Ms. Doyle recommended the
Infrastructure Committee look at installing sewer lines to Lazaretto Creek as there are two
property owners that have expressed an interest. Also, she would like this included in the next
budget cycle. Mayor pro tem Brown confirmed. Monty Parks made a motion to approve.
Wanda Doyle seconded. Vote was unanimous, 5-0.

To whom it may concern -
While reviewing this information packet, you may notice some discrepancy between the final
cost of the Ford Sedans and what was quoted by OC Welch and West Chatham. This is due to additional
necessary equipment, which was not covered under the aforementioned documents, being figured into
the final price.
The cost of these items were provided by Major William Moseley and were based off of his
experience in having similar vehicles outfitted in the same fashion. These items included radar units
($3,000.00), the cost of having a camera installed ($200.00) and Verizon cradles ($100.00), which were
all figured into the “electronics” category on the original spreadsheet. An additional $300.00 was also
figured into the “Lights” category, to address the cost of a spot light.

CONTRACT BETWEEN THE COASTAL REGIONAL COMMISSION AND THE CITY
OF TYBEE ISLAND, GEORGIA
This contract is made by and between the Coastal Regional Commission, hereinafter referred to
as the “CRC,” and City of Tybee Island, hereinafter referred to as “the City.”
Witnesses that:
WHEREAS the East Coast Georgia Greenway is a 155-mile trail system which will connect
South Carolina to Florida through Georgia’s six coastal counties; and,
WHEREAS, GA Legislature passed SR730 encouraging the CRC to support implementation of
the East Coast Greenway; and,
WHEREAS, the City of Tybee applied for funds from the Coastal Regional Commission (CRC)
for the first phase of construction of the East Coast Greenway Marsh Hen Trail; and
WHEREAS, the City of Tybee desires to implement the first phase of the Marsh Hen Trail that will eventually connect to the Lazaretto Bridge to be constructed by Georgia Department of
Transportation (GDOT) which has planned pedestrian/bicycle amenities; and
WHEREAS, a majority of the Marsh Hen Trail is located along the abandoned Marsh Hen
railroad bed; and,
WHEREAS, the construction of the Marsh Hen Trail is in the City of Tybee’s current short-term
work program.
WHEREAS, the first phase is approximately a half mile section of a multi-use bike and pedestrian off road trail; and,
WHEREAS, the current total cost estimate for the project including construction, engineering
and contingency is $484,195; and,
WHEREAS, the City of Tybee plans on contracting and completing work adjacent to Highway
80 for an estimated cost of $199,781; and,
WHEREAS, the City of Tybee Department of Public Works will complete areas of the trail that
are off the highway within the footprint of the former railroad bed for an estimated material cost is $243,635; and,
WHEREAS, the City of Tybee has budgeted $400,000 this fiscal year to complete this phase
from the City’s fund balance, green space designated funds.
WHEREAS, the City of Tybee is the recipient of East Coast Greenway DCA funded project
identified above in the amount of $17,800; and

WHEREAS, the Coastal Regional Commission is the designated agency to render certain project
management, reporting and support services in connection with East Coast Greenway grant
funds.
THEREFORE, it is distinctly understood and mutually agreed as follows:
I. SCOPE OF SERVICES: The Coastal Regional Commission (CRC) shall provide the
following scope of services:
A. Project Management
1. Record keeping consistent with DCA program guidelines.
2. Maintenance of the filing system.
3. Collect and submit required project reporting, including progress reports,
qualified reimbursable expenses to DCA.
B. Process reimbursable grant expenses. The City hereby agrees that its officials and
employees shall cooperate with the CRC. The City officials shall be responsible
for ensuring that all required information including copies of qualified
reimbursable expenses and other information shall be made available to the CRC.
C. The CRC shall consider the receipt of this contract, signed and executed, as the official notice to proceed.
II. TASKS PROVIDED BY THE CITY: The City of Tybee Island shall furnish data as
follows:
A. The City shall have a kick-off and notify the CRC of the project kick-off date.
B. The City shall invite the legislative delegation to groundbreaking.
C. The City shall include the legislative delegation in all press releases.
D. The City shall provide copies of press releases, photos and milestone events to the
CRC.
E. The City shall use the wording, ‘this phase of the Marsh Hen Trail project is completed in part by an East Coast Greenway Grant provided by the Georgia
Legislation, and the CRC in cooperation with DCA.”
F. The City shall provide monthly progress reports to the CRC.
G. The City shall provide inspection reports to the CRC.
H. The City shall provide the CRC documents relevant to this phase of construction.
I. The City shall provide documentation of qualified reimbursable expenses to the
CRC.
III. SCHEDULE: This phase of construction funded by East Coast Greenway Grant shall
be completed by June 30, 2017.

Item: Two Separate GEFA Loan Applications - Water Line Replacement and UV Disinfection – Total loans are
for 1,997,000.00 – 1.232,000 for the water portion at a 1.39% rate with the Water First designation and
$720,000 for the UV Projection at a .89% rate with Water First designation. Water project consists of a second
phase of water line replacement, replacing old asbestos-cement and lead-jointed pipes with new C-900 PVC
pipe. Second project is a sewer project and the City intends to replace its aging UV disinfection system at the
WWTF.
After discussing potential funding options with GEFA, they have recommended that we split the Phase 2 water
line replacement and the UV disinfection repair projects into two separate loans.
Explanation: Since the water line replacement project has a short timeline to meet the GaDOT resurfacing schedule for the spring, we will continue with the Georgia Fund financing for that project (which has less regulatory red tape involved and allows for quicker funding). It is planned that construction will start by the
first of the year on this project with the US 80 portion of the project completed by March to meet the road
resurfacing schedule. The UV project, which while still critical can take the extra time for the funding cycle,
will utilize Clean Water SRF funds. This will reduce the interest rate to 0.89% (a 0.5% reduction) and save approximately $40,000 in interest payments. Construction will likely begin in second quarter 2017. .

APPLICATION: Map amendment from C-2 to R-2.
PROPOSAL: The applicant is requesting to change zoning from C-2 Highway Business to R-2 One and Two
Family Residential. ANALYSIS: These two lots are currently empty. They are surrounded by residential uses. Nearby districts include
R-1, R-1B, R-2, and R-T. The Comprehensive Plan describes the Arts, Eats, Eco-Business Corridor in which it lies as follows:
This area functions as an activity center with a mix of neighborhood commercial uses including shopping, crafts, restaurants, and eco-tourism. The Comprehensive Plan describes the Historic Battery Neighborhood which it abuts as follows:
This character area includes the developed and undeveloped area north of Hwy. 80. This area contains a significant amount of natural and environmentally sensitive areas with public and private access
to the Savannah Harbor. There is existing residential development and the potential for additional development within this area. The neighborhood also has the potential to be connected to the Arts, Eats, and Eco Activity Center, North Beach Neighborhood, and McQueen’s Trail/Fort Pulaski via the proposed multi-
use trail/greenway system. The two lots more appropriately fit into the Historic Battery Neighborhood.

Planning Commission Meeting MINUTES
October 17, 2016
Vice Chair Bossick called the October 17, 2016 Tybee Island Planning Commission meeting to order. Commissioners
present were John King, David McNaughton, Tina Gann and Ron Bossick. Commissioners absent were Demery Bishop,
Charles Matlock and Marianne Bramble.
Consideration of Minutes: Vice Chair Bossick asked for consideration of September 19, 2016 meeting minutes. Commissioner McNaughton made a motion to approve the minutes, Commissioner Gann seconded and the vote to approve was unanimous. Disclosures/Recusal: Vice Chair Bossick asked if there were any disclosures or recusals, there were none.
Old Business:
Text Amendment-to the Land Development Code to amend Sec. 3-080D to create a use table with
parking requirements and adjust parking requirements. Additionally to amend Sec. 2-010 Definitions to
add a definition of shopping center:
Mr. Shaw stated he amended the previous ordinance to encompass what he believed to be all of the Planning
Commissions comments and changes. Commissioner McNaughton stated that his preference would be to wait
until everyone was present. Commissioner King asked Mr. Shaw if Gas Stations are treated as retail which he did not see listed. Mr. Shaw stated yes because a stand-alone Gas Station almost never exist anymore and that is why he did not put it in the list. He stated the two we have now are also convenience stores so they are treated as retail. Commissioner McNaughton stated in the Shopping center definition the last sentence is not needed. Mr. Shaw stated that he agrees and will strike that sentence. Commissioner McNaughton made a motion to continue for
consideration of changes until the November 14th Planning Commission meeting, Commissioner King seconded the
vote to continue was unanimous.
New Business: Text Amendment-to the Land Development Code to remove Sec. 4-050H- TBR transitional business-residential district and to amend Sec. 4-050F –C2 highway business district to allow for residential uses
by right and above commercial districts:
Mr. Shaw stated right now the City has a zoning district in the ordinance as TBR which is not on our zoning map, it
is described somewhat and as zoning administrator he was never comfortable with where it existed, and in his
opinion you can’t have a zoning district that is not on your map if you have something zoned that way. He stated this
is neither an overlay or a district itself it is an interpretation that he is not comfortable with so he would like to
remove the TBR and make the R2 uses by right in the C2. Commissioner McNaughton stated that he does not understand the second sentence at all. Mr. Shaw stated as an example a home occupation is allowed after special review in R2 so if they want a home occupation in C2 that would also require special review. Commissioner King
asked if the idea of this new one is that they would use the C2 or the R2 setbacks if it was a residential use. Mr. Shaw stated perhaps he should add that to be sure and that is an important point. Vice Chair Bossick asked if an
R2 comes in and it is in a C2 area will there have to be a buffer requirement. Mr. Shaw stated there is one in the C2

and he thinks that does need to be stated. Commissioner McNaughton made a motion to continue until the
November 14th Planning Commission meeting, Commissioner Gann seconded the vote to continue was unanimous.
Variance and Special Review-consideration of request to place materials in a marsh. Marsh Hen Trail,
north side of Hwy 80/zone r2/pin 4-0024-02-036, 4-0024-02-034, 4-0023-01-001 and 4-0022-01-001:
Mr. Shaw stated this is a continuation of our bike route and will be an off road portion from Byers to the base of
Lazaretto Creek the Trail will stop at Battery Row until the Bridge is fixed, which will have a bike lane. This was
approved by Planning Commission and City Council a couple years ago and DNR also approved the Marsh Buffer their
approval is good for 5 years where ours is only good for a year and has since expired. That is why this if before you again. Commissioner Gann made a motion to approve, Commissioner McNaughton seconded and the vote to approve was unanimous. RESOLUTION
A RESOLUTION BY THE MAYOR AND
COUNCIL OF TYBEE ISLAND,
GEORGIA, ADOPTING THE TYBEE ISLAND
2016-2036 COMPREHENSIVE PLAN
WHEREAS, Tybee Island prepared a 2016 update to the comprehensive plan in accordance with the
rules of the Georgia Department of Community Affairs Minimum Standards and Procedures for Local
Comprehensive Planning (Chapter 110-12-1); and,
WHEREAS, The Mayor and Council of Tybee Island, in consultation with the contracted consultant,
selected both a technical group and stakeholder group consisting of a cross-section of the community to
facilitate development of the 2016-2036 Comprehensive Plan (the Plan); and,
WHEREAS, the groups met regularly with staff and the consultant over the eight month period to
establish goals, objectives, and strategies to guide the future of the community; and,
WHEREAS, the Tybee Island and consultant staff assembled the recommendations of the groups and
prepared documents in the Comprehensive Plan format required by the Georgia Department of
Community Affairs Minimum Standards and Procedures for Local Comprehensive Planning (Chapter 110-
12-1); and,
WHEREAS, the Tybee Island 2016-2036 Comprehensive Plan was prepared in accordance with the
Standards and Procedures for Local Comprehensive Planning (Chapter 110-2-1) effective March 1, 2014,
and established by the Georgia Planning Act of 1989; and,
WHEREAS, on August 22, 2016, the City transmitted the Plan to the Coastal Regional Commission (CRC)
and the Georgia Department of Community Affairs for official review; and,
WHEREAS, the Plan has been found by the Georgia Department of Community Affairs to be in
compliance with the above-mentioned Minimum Standards and Procedures;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF TYBEE ISLAND, GEORGIA, AND IT IS
HEREBY RESOLVED that Tybee Island 2016-2036 Comprehensive Plan is hereby approved and adopted.
BE IT FURTHER RESOLVED that the City staff be directed to provide a copy of this adoption resolution
within seven (7) days of local adoption of the approved Plan to the CRC, and to publicize the availability
of the adopted Plan as public information by posting the Plan on the City’s website.

EMERGENCY ORDINANCE / RESOLUTION
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia
to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of
the citizens of Tybee Island, Georgia, including the environment thereof; and
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia
(the “City”), is the Mayor and Council thereof; and
WHEREAS, the City was recently included in a Declaration of Emergency due to
Hurricane Matthew which caused damage, destruction and significant emergency conditions; and
WHEREAS, the City participates in the Chatham County Emergency Management
program and coordinates with the Chatham Emergency Management Agency (CEMA); and
WHEREAS, the City is faced with a crisis that implicates matters of public safety, health,
property and infrastructure and damage caused thereto necessitating removing debris in various
areas, suspension of certain fees, authorizing actions by staff to secure appropriate bids or
proposals consistent with FEMA requirements and to seek appropriate reimbursements; and
WHEREAS, the City has entered into certain contracts with respect to debris removal and
the monitoring of removal pursuant to Federal Emergency Management (FEMA) guidelines; and
WHEREAS, certain locations within the City are served only by private drives and/or
consist of gated communities; and
WHEREAS, the Chairman of the Chatham County Commission has declared an
emergency pursuant to the Chatham County Emergency Management ordinance; and
WHEREAS, the County ordinance, to which the City submits under its own ordinances,
authorizes the use of private property and the performance of necessary functions to promote and
secure the safety and protection of the civilian population of the City; and
WHEREAS, the County ordinance, as well as the ordinances of the City and the policies
it has adopted pursuant thereto, recognize that the Georgia Emergency Management Act of 1981,
as amended, authorizes municipalities to exercise emergency governmental powers [Chatham
County Emergency Management Ordinance 4-309.2(v)(1)(4) and 4-309.2.b]; and

WHEREAS, the City Charter, Section 2.24, authorizes the City to adopt an emergency
ordinance subject to the provisions thereof.
NOW, THEREFORE, It is hereby ordained by the Mayor and Council of the City of
Tybee Island that a Declaration of Emergency has been declared by the Mayor of the City and
that, therefore, all provisions of The Code of the City of Tybee Island, Georgia, Chapter 18-1, et
seq., shall be in place and the Emergency Operation Plan has been activated in light of the state
of emergency declaration. Pursuant to Section 18-5 and the Emergency Management Act of
1981, the City hereby implements orders consistent with the provisions above in order to
accomplish the protection of the community and its citizens, including the right and obligation
for emergency access to be available and accomplished to all appropriate areas of the City
including, but not limited to, those areas within gated communities and/or located on private
drives and any prohibitions on the rendering of services by the City with respect to private roads
or drives be suspended and superseded hereby to the extent legally permissible and that the City
dedicate such services and equipment as is needed in order to remove the public health and
safety risk and emergency to the extent necessary for the protection of life and property, subject
to the City securing authorization from FEMA in advance of performing such services.
Further, any City Code or provision of law which would otherwise be applicable to the
conduct of City business, including the procedures and Rules of Council with respect to the
adoption of resolutions or ordinances shall be superseded hereby in order so as not to hinder or
delay the implementation of the disaster recovery for a period of thirty (30) days or until
additional action by the Mayor and Council, whichever shall first occur pursuant to the
provisions of Section 18-6(6) of The Code of Ordinances of The City of Tybee Island, Georgia,
as well as Section 2.24 of the Charter thereof.
Further, it is determined to be in the immediate public interest of the City to authorize the
removal of obstructive debris prohibiting access to residents in need of ongoing emergency
access and restoration efforts and, therefore, the staff of the City may solicit bid proposals and
make reasonable efforts to secure rights of entry and indemnity agreements from the owners of
any private property which might be impacted by the actions and procedures of the City in the
recovery effort and, to the extent possible, the owner of any property impacted by the actions of
the City be given an opportunity to present any objections or comments to the City Manager or
designated emergency official for the City during the process.

It is further resolved by the Mayor and Council of the City of Tybee Island that Hurricane
Matthew did widespread damage throughout the City resulting in massive storm debris and other
material from building and houses, damage with such magnitude that the City as a whole,
including public and private streets and gated communities, in need of public assistance for the
removal of storm damage debris and/or in need of emergency protection services and it is in the
public interest to remove and establish access and abate the hazardous conditions to the extent
they constitute a threat to life, public health and safety to all citizens and to promote a
meaningful economic recovery of the City. Due to the declaration of an emergency, the City
considers itself obligated to provide services, including storm debris removal and abatement on
public and private property to promote the public health, safety and to allow for the economic
recovery of the City as a whole. Therefore, the Mayor and Council of the City of Tybee Island
do hereby find that, given the emergency conditions that exist, City staff should immediately
seek to obtain proper approvals from FEMA officials to allow the removal of storm and other
related debris material from private roads and property in gated communities, as well as in the
public areas to the extent necessary for the public interest, health, safety and welfare and to
promote the economic recovery.
Further, the City will suspend fees related to the disposal of storm related household
items and debris in the City dump and will waive late fees for October utility bills and
hotel/motel tax returns; suspend cutoffs for water customers who are late for October and,
further, instruct staff to prepare all appropriate RFPs for storm-related damage of household
contents and construction debris removal in the City right of way and City property, as well as to
provide for the monitoring thereof and for staff to prepare appropriate RFPs for yard debris and
storm-related damaged household contents and construction debris removal from the shoulders
of private side streets, including within gated communities, upon FEMA approval of said actions
and for staff to prepare appropriate RFPs for the monitoring of any and all debris removal from
provide side streets and/or gated communities with appropriate FEMA approval and to seek
FEMA approval thereof and to take any and all necessary actions to ensure or seek to require or
achieve the maximum amount of allowable FEMA reimbursement under the circumstances.
In the event advance FEMA approval is not timely received for the removal of trees, yard
debris, storm related/damaged household contents and construction debris removal from the

shoulders of private streets and/or with gated communities, the Mayor and Council will consider
further action depending on conditions and responses to solicitations for bids or proposals on
such tasks and the monitoring thereof by way of further action of counsel.

Meeting Minutes: September 21, 2016
Vision: To improve the quality of life for those that live, work, and visit Tybee Island and enhance the cultural experience while preserving
the community's barrier island heritage. The Mission of the Tybee Island Development Authority / Main Street Program is to:
- facilitate efforts to revitalize, redevelop, and enhance that which improves the quality of life; - create a sense of place and improve the quality of life for residents, business owners, and visitors using the Main Street Four Point
Approach; - encourage quality economic growth and development while preserving Tybee Island's unique architectural and community heritage;
- support and encourage the arts as a cultural endeavor and economic engine on the Island.

DEVELOPMENT AUTHORITY / MAIN STREET BOARD OF DIRECTORS MINUTES
Motion was made by Brenda, which was seconded by Vicki, to approve the minutes of the Tybee Island
Development Authority / Main Street Board of Directors August 17, 2016 meeting. Motion carried.
COMMITTEE UPDATES
Business Assistance
Ted reported that the next Merchant Meetup will be on November 1 from 9am until 10:30am.
Chantel will reserve the Guard House. Directors discussed topics for the meetup. All agreed that
the focus should be about the holiday season activities that business are / can participate with
and other ways to promote the holidays.
Design
Vicki confirmed that the committee now includes more members with the arts association for this
particular project. The committee is meeting next Tuesday to regroup and review the details for
the second and third murals with representatives of the arts association. Although the first mural
has elements that were not originally planned, the artists did an amazing job with her vision and it
looks wonderful. Recommendations for the second and third murals will be provided that
directors will be asked to consider for approval prior to proceeding.
Directors discussed the pedestrian friendly enhancements for Tybrisa Street that were discussed
at their mid-year workshop last week. Follow up information has been emailed regarding the idea
of a gazebo and picnic benches in the roundabout. Improvements for Tybrisa Street such as
adding benches between the murals, improving the landscaping and adding planters and / or
hanging baskets were discussed. Chantel reiterated that Melissa M. had expressed that these
improvements should connect the surrounding areas (i.e. the roundabout, the pier, Strand

Avenue, etc.) for connectivity with planning purposes. All agreed that picnic tables would be
better suited closer to the stairs on the southside of the pier and pavilion instead of at the
roundabout.
Vicki noted that if there is time to discuss these design concepts at the committee meeting she
will bring it up for a recommendation. In the meantime, Chantel will reach out to the design
studio staff through the Office of Downtown Development at the Georgia Department of
Community Affairs (DCA) to do a conceptual rendering.
Promotions
Brenda reported that this year’s Community Day was another success. Although the temperature
was higher than past years, it is estimated that at least 300 people attended. Ted commented
that Jim and he noticed an influx of people at the grill around 3pm. $86 was donated by
attendees for next year’s Community Day. Three television station news reporters interviewed
Brenda. Their segments aired during their evening news programming and/or online. Directors
discussed possibly giving away reusable water bottles next year.
Brenda announced that the next committee meeting will be on September 28 at 6pm to review
details for the Interactive Art Street Party and the holiday season.
PROJECT REVIEW
Façade Improvement Grant
Directors discussed creating a revolving loan fund that would be available through the city and
administered with the program’s assistance. Details will be discussed at a later time. Julie
reviewed the need for long-term housing, mixed use in particular areas, and that parking
requirements are being revised in C2.
Vicki reviewed the current Façade Improvement Grant Opportunity application and processes
that were discussed at their mid-year workshop last week. Discussion ensued regarding having
design guidelines to go with the grant award requirements. These guidelines would be based on
what the Historic Preservation Commission has drafted. The Community Development Director,
George Shaw, is reviewing for inclusion. Vicki stated that the design requirements for grant
awards would be applicable for applicants that are requesting matching funds for making changes
to their building façade. The guidelines are in keeping with the architectural features and styles
representative of Tybee. If the applicant is making improvements that do not alter the existing
façade style then the guidelines are not applicable. Motion was made by Vicki, which was
seconded by Brenda, to propose increasing the matching funds to be a total of $10,000, which
would allow for up to four grant awards of $2,500 per year. Motion carried.
Property/Uses
Directors reviewed the various properties and potential uses that were discussed at their mid-
year workshop last week. Details will be presented to city officials in terms of utilizing the
development authority for needed and sustainable economic development purposes. Each
location discussed should have restrooms and / or showers available for the public. Short-term
uses include a police substation, visitor substation, downtown museum extension in partnership
with the Historical Society, work stations for the public to utilize the internet and have printing
capabilities. The property use could evolve as needed for long-term planning. The proposed use
is to utilize the space(s) as a business incubator, which has been identified as a need with the
increase of entrepreneurs wanting to start a business with limited capital to start a business.

Chantel will prepare a presentation with the above information included. This presentation will be ready
for directors to review at the next board meeting. Once finalized, directors will present at the October 27
city council workshop as requested.
