Hause, Administrative Services Director AGENDA ITEM 7.H SUBJECT: ADOPTION OF RESOLUTION NO. 14-5036 AUTHORIZING FACSIMILE SIGNATURES FOR THE DRAWING OF CITY WARRANTS AND CHECKS RECOMMENDATION: The City Council is requested to adopt Resolution No. 14-5036 (Attachment "A"), approving a change in the authorized signers for City warrants and checks. BACKGROUND: 1. On November 3, 2009, the City Council adopted Resolution No. 09-4640 authorizing facsimile signatures for City warrants and checks. 2. On April 3, the City Council adopted Resolution No. 12-4808, appointing Tracey Hause, Administrative Services Director as the City Treasurer. 3. On March 4, 2014, the City Council approved an employment agreement with Donald E. Penman as Interim City Manager. 4. On March 18, 2014, the City Council adopted Resolution No. 14-4978, adding Mr. Penman as a signer on all City warrants and checks. 5. On August 19, 2014, the City Council approved an employment agreement with Bryan Cook as City Manager. ANALYSIS: Pursuant to Government Code Section 37203, the mayor shall draw a warrant or warrants upon the city treasurer specifying the purpose for which drawn and the fund from which payment is to be made. The city clerk shall countersign the warrant. The City Council October 7, 2014 Page 2 of 2 legislative body, by ordinance or resolution, may prescribe an alternative method of drawing warrants and checks. The City in recent years had prescribed an alternative method for drawing (i.e. "signing") the City's warrants and checks. The City Council by Resolution No. 14-4978, authorized all warrants and checks have joint signatures (2) from the following authorized signatures: • Interim City Manager • Administrative Services Director; • Parks and Recreation Director; and • City Clerk Now that a permanent City Manager has been hired and to ensure the City can draw warrants and checks in a timely manner if other signers are unavailable, it is recommended the City Manager also be an authorized signer. CONCLUSION: In order to ensure the City is in accordance with Government Code Section 37203, adoption of the attached Resolution No. 14-5036 is recommended; requiring joint (2) signatures on all warrants and checks of the following officers: • City Manager, Bryan Cook; • Administrative Services Director/City Treasurer, Tracey L. Hause; • Parks and Recreation Director, Catherine Burroughs; and • City Clerk, Peggy Kuo FISCAL IMPACT: There is not fiscal impact of this action to the Fiscal Year (FY) 2014--15 City Budget. Resolution No. 14-5036 Attachment A RESOLUTION NO. 145036 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING FACSIMILE SIGNATURE FOR THE DRAWING OF WARRANTS AND CHECKS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE, DETERMINE AND ORDER: SECTION 1. Pursuant to Government Code Section 37203 the following method is prescribed for the drawing of all warrants and checks: All warrants and checks shall be drawn upon the joint signatures of two of the following officers: • City Manager • Administrative Services Director/City Treasurer; • Parks and Recreation Director; and • City Clerk SECTION 2. Donald E. Penman as Interim City Manager, is hereby removed as an authorized signer SECTION 3. The City Council of the City of Temple City does hereby authorize the City Treasurer to utilize Facsimile Signatures for the following personnel pursuant to Section 37203 of the Government Code, Bryan Cook, City Manager Tracey L. Hause, Administrative Services Director/City Treasurer Cathy Burroughs, Director of Parks and Peggy Kuo, City Clerk Recreation Director SECTION 4. These signatures are hereby approved for the drawing of warrants and checks. SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution.
