SUBJECT : APPEAL OF THE PLANNING COMMISSION 'S DECISION TO APPROVE
A CONDITIONAL USE PERMIT FOR THE ESTABLISHMENT OF A
WIRELESS TELECOMMUNICATIONS FACILITY AT 9677 LONGDEN
AVENUE
RECOMMENDATION:
The City Council is requested to :
1. Rev iew the staff report and minu te s of the Planning Commission meeting of Ju ly 22 ,
2014 (Attac hm ents "B" and "C");
2 . Open the pub lic hearing ;
3. Accept any public testimony ; and
4 . Adopt Resolution No . 14-5037 upholding the Pl anning Commission 's decision and
approv ing the Conditional Use Permit.
BACKGROUND:
1. On February 21, 2014 , the City re ceived a Cond itional Use Permit application to
construct a wi rel ess telecommu nications fac ility on the property lo cated at 9677
Longden Avenue . The proposed faci li ty would be disgu ised as a 59-foot tal l
eucalyptus tree .
2 . On June 14 , 2014 , the appl ication was deemed complete .
3 . On Ju ly 22 , 20 14, the Planning Commission held a public hearin g to consider the
City Council

application . The Plann ing Commission voted 4-0 to approve the Conditional Use
Permit.
4 . On August 4 , 2014 , the City Clerk received an appeal of the Planning
Commiss ion 's decision (Attac hment "0 ").
ANALYSIS :
As discussed in greater detail in the attached Planning Commission staff report , staffs
recommendation to the Planning Commission to approve the Conditional Use Permit was
based on the ability of the project to satisfy the required Conditional Use Permit f indings .
Further, the applicant submitted evidence supporting the need for the facility to fil l existing
gaps in wireless coverage in the area ; and submitted evidence that it had considered
alternative locations for the facility , inc luding another location that was previously denied
by the City.
In appealing the Planning Commission approval , the appellant presented a number of
issues as follows :
1. The need for additional ti me to evaluate the health and aesthetic impacts of the
proposed facility;
2 . The need to gather information regarding the potent ial negative impacts of the
facility on property values ;
3 . The proposed tower would be visually unpleasant for the neighborhood ; and
4 . Concerns that some neighbors may not be aware of the proposed facility due to a
language barrier.
In respo nse to the appellant's concerns, staff prov ides the follow ing analysis :
1. Any potential health and safety impacts resulting from the radiofrequency
emissions of the fac i lity are under the exclusive purview of the Federal
Communications Commission (FCC). Federal law and case law provide that cities
may not consider the potential health effects of wireless telecommunications
facilities . Wireless carriers are required to operate their facilities in compliance
with FCC regulations , which address safe leve ls of radiofrequency emissions . In
making its decision on the Conditional Use Permit appl ication , the City Council is
lim ited to considering the aesthetics of the proposed facil ity, the need for the
facil ity to provide wireless coverage , and the need for this location in relat ion to
possible alternative locations.

Regarding aesthetics, the facil ity would be camouflaged to imitate a eucalyptus
tree . There are numerous large trees in the v icinity that are of comparable height
to the proposed 59 -foot tall facility . The proposed facility would be placed between
two bu il dings on the site that have he ights of 22 feet and 24 feet respect ively. As
such the bottom part of the wireless tower would not be visible from the street.
2 . The potential impact of wireless facilities on property values is related to the
aesthetics of the facil ity and the visual impact on the neighborhood . The City
Cou ncil can therefore address th is issue through the discussion about the
aesthetics of the facility . There are no clear matrix or independent market studies
that City staff is aware of that address this issue in an objective manner.
3 . The aesthetics of the proposed facility are d iscussed above and in the attached
Plann ing Commiss io n staff report . Staff also notes that this is the second site the
appl icant has requested for this facility . In 2013 , the applicant submitted a
Cond iti onal Use Permit application requesting to install w i reless antennas on one
of the light standards on the athletic field of Temple City High School. After
reviewing the project , the Planning Comm issi on denied the re quest for aesthetic
reasons. The applicant has stated that the proposed facility is an alternative
location for the facility originally proposed at Temple City High School.
4 . Pub lic notices for the Pla nning Commiss ion and City Council hearings have been
provided as required by state law and the Temple City Municipal Code . At the
appe ll ant's request , the City has arranged for a Mandarin Chinese translator to be
present at the public hearing .
CONCLUSION:
Based on the project's ab ili ty to meet the required Conditional Use Perm it findings , staff
recommends that the City Council uphold the Planning Commiss ion 's decision of July 22 ,
2014 , approving the Cond it ional Use Permit to allow the installation of the proposed
wireless telecommunications facility . If the City Council decides that the aesthetic design
of the project is not satisfactory, staff recommends that the Council remand the case to
the Planning Commission for further exploration of alternative designs , rather than
denying the application .
FISCAL IMPACT:
This item does not have an impact on the Fiscal Year (FY) 2014-15 City Budget.

THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY
RESOLVE:
SECTION 1. Based upon information contained in the staff report to the Planning
Commission dated July 22 , 2014 , the staff report to the City Council dated October 7 ,
2014, and the Planning Commission minutes of July 22, 2014 ; and based upon a rev iew of
the subm itted project plans and testimony rece ived at a noticed publ ic hearing before the
City Council on October 7 , 2014, the City Council hereby upholds the decision of the
Planning Commission and approves the Conditional Use Permit to construct a wireless
telecommunications facility at 9677 Longden Avenue based upon the findings set forth in
Planning Commission Resolution No . 14-2411 PC .
SECTION 2. Accordingly, the Conditional Use Permit (File No. 140000048) is hereby
approved , subject to the conditions set forth in Planning Commission Resolution No. 14-
2411 PC .

BACKGROUND :
The subject property is located in the Light Multiple Family (R-2) Residentia l zone and is designated
Institution al by the City's Gener al Plan. Th e site is developed w ith a synagogue (Temple City Beth David)
cons isti ng of two separa t e buildings with a tota l floor area of approximately 16,424 square feet. The
front buildi ng co ntains a f l oor area of app roximate ly 11,000 square fee t and the rear bui ld ing co ntains a

floor area of approximately 5,424 square fee t. The front build ing is currently used for religious activities
and the rear building is u sed by A-plus Learning Cen ter, a tutoring business.
AT&T proposes to install a wireless tower o n th e subject site. The tower will be located to the north of
the easter ly wing of the front building in the open area wh ich separates the two buildings. The tower
will be 59 feet tal l carrying 12 antennas, 24 Remote Radio Units (RRUs), and one backhaul antenna. The
antennas and RRUs will be mounted at t he height of 50 feet vert ic ally from the ground. Each antenna
pane l wil l measure 12 inches wide, 8.6 inches t hick, and 96 inches tall. Each RR U will measure 11 inches
wide, nine inches thick, and 24 inches tall. The tower will be camouflaged to im itate a eucalyptus tree.
The eq uipment cabinet wi ll be located eight f eet to the east, measuring 10 feet in both dimensions on
the ground and eigh t feet four inches in height.
Section 9-1F-10 of the Temp le City Municipa l Code requires a Conditional Use Permit for the
estab lishment of a wire less fac ility.
ANALYSIS:
After revie wing the project plans and co nsidering critical factors pertaining to the project, staff
recommends approval of the Conditional Use Permit. The following provides analysis on the concerning
issues which support staff's position:
1. Compliance with Federal Communications Commission (FCC)
Pursuant to the Telecommuni catio n Act of 1996, radio frequency leve l of a wireless tower is
regu late d by the Federal Communication Commission (FCC). Comp liance with the standards set
forth by the FCC is required. A loca l jurisdiction, when reviewing an application for a new
wireless tower, may not review the environmental effect of radio frequency emission (RF) and its
impact on the public health. As such, staff includes a condition of the approva l, as contained in
the attached Resolution, whic h requ i res t hat the RF (rad io f requency) and EMF (electromagnetic)
emissions of the project will fall with in the most recent ly adopted FCC standards for safe human
exposure to such forms of non-io ni zing electromagnetic radiat ion when operating at ful l
strength and capacity.
2. The need for the site
Th e project will result in significant improvement in the availability and strength of signals
provided for an area comprising a good number of blocks between Temple City Boulevard and
Baldw in Avenue. The Coverage Maps demonstrating the case are included in the application.

The project proposes to put the tower in the open space between the two buildings on the site,
providing a 64-foot setback to the north, a 79-foot setback to the west, and a 45-foot setback to
the east. Considering that the site is sur rounded by residential properties and providing certain
setbacks for the neighboring properties are desired, the proposed location is deemed
acceptable. Also, th e two buildings currently developed on the site will offer some view
obstructions, making the presence of the camouflaged tower less conspicuous from the street.
4. Visibility/Aesthetics
The proposed wire less towe r will be camouflaged like a eucalyptus tree; the antennas and RRUs
will be placed among the foliage an d branches; and the antennas will be painted to match the
color of the foliage. Giv ing that the foliage will provide good cover, as illustrated in the photo
sim ulations, and there are some big trees in the vic ini ty, staff concludes that the proposed
project will be vis uall y compatible with the surroundings.
5. N oise from equip ment cabinet
The equipment cabinet will be located in the same area near the tower, ha ving a 19 feet four
i nches setback from the nearest property line on the east. The amount of noise that will be
generated from the equipment is equivalent to that of a residential air conditioning unit.
Therefore, the noise impact will not be significant.
REQUIRED FINDINGS :
The findings required in Section 9-1F-11 of the Temple City Municipal Code for Conditional Use Permit
are co ntained in the attac hed Resolution No. 14-2411 (Attachmen t 1).
ENVIRONMENTAL REVIEW :
Staff has determined that thi s project is exempt pursuant to Section 15303 (New Construction or
Conversion of Small Structu res) of the CEQA Guidelines.

Community Development Department.

codes.
3 . Publi c co mments , written and ora l, rece iv ed and/or submitted at or prior to the
public hearing , supporting and/or opposing the applicant's re quest.
4 . T esti mony and/or comments from the applicant and its representatives submitted
to the City in both written and ora l form at or prior to the public hea ring .
5. All related documents received and/or submitted at or prior to the public hearing .
SECTION 2. Based on the foregoi ng evidence , the Planning Commiss ion finds that:
1. On February 21 , 2014 , the applicant submitted the application .
2 . On June 12 , 2014 , the application was dee med compl ete.
3. Notice of the Jul y 22 , 2014 Planning Commission publ ic heari ng was published in
the newspaper.
4. Notice of the Planning Commission public hearing was mailed to property owners
within a 500-foot radius at least ten (1 0) days prior to the hearing.

requirements set forth in Government Code Section 65009 (b)(2).
6. The subject property is located in the Light Multiple-family Reside ntia l Zone (R-2)
which is improved with a synagogue utilized by a religions entity known as Temple

SECTION 3. Based up on a public hearing for a Conditio nal Use Permit, Fil e No.
140000048, the Planning Commission finds :
1. That the site for the proposed use is adequate in size , shape , topog raphy and
circumstances in that:
The site co ntains 39 ,3 00 square fee t of land area and is flat i n topography. The
project is an unma nned wireless tower w hic h will not result in requiring additiona l
parking or affe ct i ng existin g onsite pa rking. Th erefore , the project meets th is
finding.
2. That the site has sufficient access to st re ets and highways, ade q uate in width and
pavement type to carry the quantity and quality of traffic generated by the proposed
use .
The site directly abuts Longd e n Avenue, a local collector street with a 60 foot righ t-
of-way and 40 foot roadway. The project wi ll not generate addit ional traffic as it wi ll
be an unmanned facility. Therefo re , the project meets this finding.
3. That the propos ed use will not have an adverse effect upon the use , enjoy ment
o r valuation of adjacent or neighboring properties or upon the public welfare .
Th e design of th e wireless tower will be compat ib le with the surrounding as it will be
camo ufl a ged to imitate a euca lyptus tree . Th ere are som e big trees in the vicinity
whi ch wi ll have an effect of mitigating th e presence of a new 59-foot euca lyptus . In
additio n, all the antennas will be mounted withi n th e canopy of the tree and the two
buildings of the site will offer so me obstruction fo r t he facility. Therefore , the project
meets this finding.
SECTION 4 . This proj ect is found to have no significant effects upon the environme nt,
and is categorica lly exempt fro m the environmental review in accordance with Section
21840(a) and Section 15303(New Construction o r Conve rsion of Small Structures) of the
CEQA Guidelines.

SECTION 5. Accordingly , File No. 140000048 is approved and is subject to the
following conditions:
1 . The proposed development shall be in substantial compliance with the p lans and
photo si mulations submitted on and date-stamped February 21 , 2014 , except as
modified herein after.
2. This approval is subject to the revocation procedures outlined in Section 9-1 F-40
of the Temple City Municipal Code.
3. The operation of the wireless facility sha ll strictly comply with the regulations and
guidelines provided by the Federa l Communications Commission (FCC ) to ensure
public safe ty. The electromagnetic e mis sio n from thi s comm un ications facility
shall not exceed the applicab le public exposure standards specified by the
Federal Communications Commission (FCC), nor any other applicable exposure
standards for this type of facility, which may be specified in the future by the
FCC . The applicant shall provide written verification that the proposed project
RFR (radiofrequen cy) and EMF (electromagnetic) emissions will fall within the
m ost rece ntly adopted FCC standards for sa fe human exposure to such forms of
non-1on1z1ng e lectromagne tic radiation w hen operating at full strength and
capacity.
4. It shall be the responsibility of the applica nt to obta in all necessary and
appropriate permits and/or approvals and to mainta i n the screening as well as
the antennas in good conditio n.
5 . The density of the foliage s hall be adequate to fully cover the presence of the
antennas , and to the satisfaction of the Community Development Director. In
addition , the branches shall be arranged so that the tree has a rounded top as
opposed to a flat top .
6. N oise shall not exceed the City's noise ordinance during demolit ion and/or
construction. Construction wo rk shall be limited to 7 :00 a .m . to 6:00 p.m . Monday
t hrough Saturday. No co nstruction work sha ll occur on Sundays or national
holidays .
7 . The property sha ll be co nsi stently maintai ned in full co mp liance with all
applicable ordinance and approvals . Any modifi cation to the fac i lity may be
subject to the review and app roval of this grant ing body through a publ ic h earing.
8 . Building permits sh a ll be obtained fo r all new construction and any mod ificat ions .
Such mod ifications and /or alterations s hall be subject to the review and approval
of the Community Development Department of the C ity of Temp le City .

9. The applica nt/property owne r s hal l meet a ll requi rements of the National
Pollutant Disc harge Eliminatio n System (N PDES) related to po llu tants , runoff or
non-storm wate r discharges.
10 . The Cond itio ns of Approval co nta in ed i n t h is Resolution may be enforced by t he
Sheriff's Offi ce as wel l as City Staff. Any violation of any condition is a
misdemeano r a nd may be processed di rectly by crimina l co m plai nt.
11 . This Conditio nal Use Permit shal l expire 24 months from the date of approval if said
Cond itio nal Use Permit is not exercised with in that time. If the project is not
commenced prior to the expiration date , the applicant may apply in writing for an
extension of time at least forty (40) days before t he expiration date .
12. A copy of the approved resolut ion shall be incl uded in the construction plans as
construction notes .
13. This Reso luti on shall not become valid unti l suc h time that the applicant/property
owner has signed the Acceptance of Project Conditions acknowledging
accepta nce of th e Condi tio ns of Approva l.
Section 6 . The Secretary shal l cert ify to t he adoptio n of this Resolution.

project is an a lternative to a previously denied wireless tower at Temple
City High School. The previous wireless tower was den ied by the
Planning Commiss ion due to aesthetics . The current proposed wireless
tower provides improved aesthetics including a eucalyptus tree design .
Felip Dajkovich , resident , spoke in opposition to the request due to
aesthetics and potential exposure to radiation .
V ivi an L. Cha ng , resident, is not favor of the aesthetics of the wireless
tower, is concerned that property value may decrease , and of ra diation
exposure to childre n.
Michael Leong , resi dent, is not in favor of cellular sites i n residential areas .
Gerie Richardson , resident, is opposed to the request due to aesthetics
and possible radiation exposure.
Charlton Chen , res ident, spoke in opposition of the project due to poor site
placement and health concerns .
Edision Shu , resident, spoke aga inst the request due to potentia l health
issues , noise and potential electrical fires .
Jerry Ambrose . AT&T Mobility , applicant, clarified that common locations
for wireless towers include schools and churches in residential areas ,
typ ically within one mile of each other. No generator will be stored onsite ;
therefore, the noise generated by the wireless tower should be minimal.

I, Robert D. Knox, hereby submit an appeal to the Temple City Council regarding the Planning
Commission's decisi on rendered as resolution# 14-2411 on July 22, 2014.
I am appealing the decision based on the following issues and concern s;
1. The advanced notice of the Planning Commission's hearing on the matter of a new cell
phone tower installation was se nt out as an English only notice and many of the local
population who are of Chinese origin may not have been able to fully understand the
notice and thus did not atte nd or voice their opinion at the hearing.
2. I have initiated a correspondence with the Federal communication commission (FCC) on
the issue of the effects of having many cell phone towers in close proximity to one
another and have asked if any statute exists for cell phone tower density within a given
area and if any study ha s been performed on the health effects of such a density. I have
not yet received an answer to these questions from the FCC and need time to receive
the answers.
3. Our neighbors believe cell phone tower installation s decrease property values and I am
currently researching real estate records to determine if there is any evidence to
support that assumption . I need more time to complete that research.
4. The proposed cell tower height is 59 ft. and thus the neighbors with two story homes in
the near vicinity to the new tower will have to look almost directly at the cell tower
from their upstairs windows from a di stance of just 100ft. Though it may be disguised as
a tree, it would still--be an unpleasant sight for them.
5. We are contacting the neighbors in our neighborhood to form a petition opposing this
cell phone tower in stallation and would like more time to contact as many of our
neighbors as possible to determine the majority of opinion on this issue .
