CITY REPEALING CHAPTER 5 OF ARTICLE III AND ADOPTING A •NEW CHAPTER 5 INCORPORATING BY REFERENCE-ORDINANCE -NO. 4729 OF THE.COUNTY OF LOS ANGELES RELATING TO POUND REGU • LATIONS AND AMENDING SECTION 701 OF ARTICLE VII OF • ORDINANCE 4729 OF THE COUNTY OF LOS ANGELES RELATING TO THE LEASH LAW THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. Chapter 5 of Article III of the Temple City Municipal Code is hereby repealed. SECTION 2. A new Chapter 5, reading as follows, is hereby adopted as a portion of Article III of the Temple City Municipal Code: CHAPTER 5. POUND REGULATIONS 3600, "Animal Code. Except as hereinafter provided, Ordinance 4729, as amended and in effect July 1, 1974, of the County of Los Angeles, being the Pound Ordinance of the County of Los Angeles, be and thesame is hereby-adopted by reference as the Pond Ordinance of the City of Temple City,. and may be -cited as such. Three copies of said Ordinance No. 4729 of the County of Los Angeles, as amended and in effect July 1, 1974, are on file in the office of the City Clerk of: the City of-Temple City and may-be used and examined-by-the public. 3601: - -' Definitions. Whenever-- in-said ordinance. 4729 • the- terms: "County ", - "Board-of-Supervisors "County Pound Department ", "County:Poundmaster "`or "County- Clerk are used, the same shall be deemed -to mean: respectively, the "City of Temple City"',.- "City Council ", or "San Gabriel Valley Humane Society', as the case may be. 3602. Prevailing Contract. Notwithstanding the pro visions.of Sections 3600 and 3601, the specific provisions -of any contract between the City of.Temple City. and the San Gabriel Valley Humane Society shall supersede the provisions of said Ordinance 4729. ,3603. Prevailing Ordinances. 'Notwithstanding Sections 3600 and 3601, the specific provisions, of any other ordinance adopted by the City Council of the City of Temple City shall prevail and supersede any provisions of.Ordinance 4729 to the contrary, specifically with reference to land use, business licenses, and any other provision of the. Temple City Code. • 3604. Enforcement. The- Poundmaster and any officer, employee, San Gabriel Valley Humane Society or County Sheriff, are charged with enforcing the provisions of this Chapter, are. hereby authorized to take such lawful action as may be required. to enforce this Chapter, and are hereby invested with the powers. and duties of peace.officers of the City of Temple City for such purposes. SECTION 3.. Section 701 of Article .VII of Ordinance 4729 of the County of Los Angeles is hereby amended to read as follows: ARTICLE VII - ANIMALSRUNNING AT LARGE 360.5. No person owning or having charge, care, custody, or control ofany dog-shall cause, permit, or allow the same to be or to run at large upon-any-highway, street, Ordinance No . 7 4 -3 88 lane, property or premises other than those enclosed by fencing or structures sufficient to confine such dog in the .City, unless such dog be restrained by a substantial chain or leash not exceeding six (6) feet in length and is in the charge, care, custody, or control of a compe- tent person. SECTION 4. ,City Council finds that it is necessary for this ordinance to become immediately effective for the reason that loose dogs in the city are creating an existing nuisance and it is neces- sary to immediately correct the problems for the safety and welfare of the citizens. SECTION 5. The City Clerk of the City of Temple City shall certify to the passage and adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, published and circulated in the City of Temple City.
