HomeMy Public PortalAbout19911119 - REGULAR MEETING MINUTES - 1991-16 TOWN OF AULT PUBLIC HEARING AND REGULAR BOARD MINUTES November 19, 1991 - (91-16) III The Town Clerk announced this was a public hearing to consider the adoption by reference Chapter 4, Title 6 - Animals. This public hearing took place at the Town Hall at 7:00 P.M. ROLL CALL The following Trustees were present: Trustee Rau Trustee Hovel Trustee Hoover Trustee Sheets Mayor R. Edgar Gieck Absent were: Trustee Marsh Trustee Hoff Also present: Town Clerk, Patricia J. Lesh Mayor Gieck stated this Public Hearing before the Ault Board of Trustees of Ault, Colorado for the purpose to consider the adoption by reference Chapter 4, Title 6 - Animals, Evans Municipal Code, 1984. The portion of the Code to be adopted is IIIChapter 4, Title 6, Animals of the Evans Municipal Code Published in 1984, as it existed on November 22, 1989. The purpose of Title 6 is to control and regulate all animals within the Town of Ault and provides for licensing, care and keeping of animals. The Mayor continued by stating this Ordinance may be adopted at the next regular meeting. The Mayor ask for questions from anyone present. Town resident and business owner, Barb McCorquodale was present and asked numerous questions. #1 - Defination of the word 'kennel ' meaning 3 dog and 3 cats over the age of 6 months. She wondered if that meant if a person had 2 dogs and 2 cats, would they need a kennel license and was that the intent of the Board. Trustee Hoover stated that the intent is to cut down on the number of cats in the town. He specified a number of problem areas in town concerning cats. The intent is to catch the animal in a cage and notify the owner that the cat has been caught and is being held. Trustee Hovel stated that he and the Police Chief had discussed the kennel portion and Trustee Hovel noted that it is hard to draw a line as to what constitutes a kennel . Trustee Hovel also stated that he knows there are people in town that have more animals than stated and he asked Barb McCorquodale what she thought a good number should be. She stated she thought much of what is in the Ordinance cannot apply to cats. As to a number of what is fair for a kennel , she stated that is doesn't have to be four animals, but feels that cats cannot be included as to require a kennel license. Many people are feeding stray cats but will not accept ownership for these cats, but still don't want these cats to go hungry. Trustee Sheets stated IIIthat is why the Town wants to get rid of the high number of stray cats in town. Barb McCorquodale felt anything over 4 dogs would require a kennel license. Page 2 PUBLIC HEARING - continued November 19, 1991 - 91 -16 Trustee Hovel stated that it is not the intent of the Board to make this Ordinance if it cannot be enforced. It also puts somewhat of a hardship on certain eo le P P but still the Board must look at what is good for the community. Now, because of the outdated Animal and Dog Ordinance, the Town has not been able to enforce as it is usually thrown out of court. Barb McCorquodale stated she felt that cats cannot be included under the kennel licensing. Town Clerk Pat Lesh read from the code book 17.08 170, page 200 - "Kennels means . . .premises on which 4 or more animals, at least 4 months of age are harbored. " Barb McCorquodale feels that it is harder to enforce licensing for cats when you cannot get people to buy licenses for their dogs. Trustee Hovel stated that the concern is for those people who do not take care of their animals and consequently everyone has to come to an agree- ment as to what is fair for all . Trustee Hovel stated that it is not the intent of the Board to hassle anyone who is taking care of their animals. Trustee Hovel stated he feels the intent of the Ordinance is to take care of the stray cat problem. Again it was stated that it is hard to prove ownership, but he feels in doing nothing there is a problem. Barb McCorquodale stated she had called the Town of Evans and they stated the wording is in content, but it is not enforced. Trustee Sheets questioned if the audience would rather the wording be 3 dogs and 3 cats, a total of 6 animals. Trustee Sheets felt this would be more enforceable when presented with a situation of, for example, someone with 15 cats. Next question concerned item L regarding "for pleasure rather than utility. " She questioned the defination of 'utility' . The difference was explained as one is a pet and the other is used for consumption. The Mayor stated he thought maybe this meant something similar to a seeing-eye dog - a working dog. Chief Hinz stated that some working dogs are also a family pet. Page 3, #6 regarding 'barking and howling dogs' - Barb questioned what was different about this statement so that it could be enforced. Chief Hinz stated that it has been enforced. Chief Hinz also stated the best way to make this effective is to have the person making the complaint, come to court - in which most cases, neighbors will not complain against a neighbor. ##8 - Public Parks with the exception of seeing-eye dogs. Barb felt she should be able to take her dogs through the park on a leash and cleans up after them if a mess is made. Trustee Sheets stated that the reasoning behind this is that many people do not clean up after they have walked their dogs. Trustee Sheets feels it is offensive that strangers who use the park to rest and walk their dogs and are gone but usually leave behind a mess for local residents to deal with. Again, this is a problem to enforce. Trustee Hovel stated he feels that the Park is not the place for an animal . But the concern was just walking across the park and according to the Ordinance, this would not be possible. A "Designated Walking Area for Dogs" was brought up. It was suggested that it would help the out-of-town visitors if such an area was provided. This town resident felt she should be able to use the park and have her dogs with her. Trustee Sheets commented that the City of Greeley does not allow dogs in the park. Regardless, it is hard to enforce as someone must always see if this dog is making a mess. Page 3 PUBLIC HEARING - continued November 19, 1991 - 91 -16 Regarding 'humane trap' - Barb complained that she had overheard the mention of anit-freeze as a quick remedy for eliminating cats. Trustee Hovel commented that it probably works, but that it is not humane and also commented that that is why traps should be used. Trustee Sheets commented that it is the job of the Police Dept. to catch the animals that are in violation and those animals placed with a local veterinarian. Item S - 'threat to the well-being of a human' - she wanted to know what constitutes a threat and a one-bite decision. Trustee Hovel stated he feels if a dog is protecting property that is different than a dog running loose and making every attemp to bite. The later would be a 'threat. ' If a dog breaks his leash and attacks someone in the street, this dog is not allowed one bite. Page 4 - Keeping cats under restraint. Trustee Hovel stated he would like to see that if there is a problem with cats and someone complains, he feels the entire matter begins with a complaint. If a complaint made, then the Town will set a trap and trap these animals. The registration is important because if this animal is trapped then someone can be notified to come and get this animal . It is not the intent of the Town to go out and dispose of someones pet cat/etc. Trustee Hovel continued and stated that a complaint should be a written, signed and by signing should show the importance of the complaint; the action would then start with the complaint. The expiration dates on the rabies certificate was brought up. This certificate shows expiration as of December 31st. Barb noted that her dogs receive shots in August and the question was that when she comes to the Town Hall in January, the Town Clerk cannot sell Barb tags because the shots for her dogs will be due in August. It was noted that this should read as . . . .with current shots. #6.04.090 - Cat and Dog Licenses - Barb questioned if the dogs and cats must wear the tags at all times. Trustee Sheets commented that if your dogs are on your own property and the dog/dogs getout and do not have their tags on, yes, there will be a problem, As long as the dogs are on the owners property, the tags do not have to be with the dog. Page 6 - Again, it was brought out that another statement about the Parks which indicated that a person can take the dog into a public park as long as any mess the dog may make is cleaned up. This is under item 'a' . It was noted that under 'c' it states that the dogs cannot run free. This obvious was a duplication and will be corrected. On the same page, it states "any dog that menaces. . . " and the question was what is meant by 'menaces' . Trustee Hovel states he feels it means attack or an animal presenting a problem. Page 7 - Use all reasonable means to abate such nuisance. Trustee Hovel and Trustee Hoover stated this has to do with noisy animals. The procedure again, is started with a signed complaint. Page 9, item D. Barb feels that guidelines should be set to determine what is meant by ". . . .investigating all complaints concerning vicious or dangerous animals. . . " ". . . .the officer shall determine whether such animal is vicious or dangerous. " Trustee Sheets feels that if a child is mauled by a dog, this is obvious a vicious animal . A case by, case will probable adhere in this instant. It was noted that "vicious" was previously discussed. Page 4 PUBLIC HEARING - continued November 19, 1991 - 91 -16 Page 12 - 6.04.270 - Impoundment - Disposition. The concern was for dogs/animals that were put away because the owner was away or could not be notified. Again, it was noted that it is the responsibility of the owner to keep the tags on their animals. The original time limit was three days and it has been increased to five days, as the Town also felt that three days was not sufficient time allowed to claim a pet. Trustee Rau stated that on unclaimed dogs, the town usually gets stuck with a bill . It was also noted that a responsible owner will begin to look immediately for a lost animal . Page 11 - Redemption Fee and Page 14 - Offense Fee. It was clarified that there is a difference between the redemption fee and the offense fee. It was further dis- cussed what happens if the animal is found and only 20 minutes have passed and no meals given. Another concern from the audience stated that it is impossible to collar a cat. Again the redemption fee was brought up. . It was suggested that possible re-wording or re-figuring of this fee might be a suggestion. The Town Board was asked what would it cost to get this Ordinance to completion. The Town Clerk stated there will probably be a special meeting before a work session and the changes will be noted at that time. The Clerk also noted that the Trash bids have not gone out and hopefully, those bids can be opened up on December 9th. It was noted from the audience that the recycling program is very important and hopefully the Town is also very interested in such a program. A final comment from the audience from town resident, Shirley Hinz. Ms. Hinz commented she felt that when Ordinances are written for a town, it is more a maintenance concern than a number concern. Mrs. Hinz also stated that she feels there has to be rules that all abide by and if her dog gets out and is borded then I have to pay the fee and maybe next time, I will watch my dog just a little closer. She also feels it is hard to get a set of rules that everyone will agree on - it must be done for the good of the town. Mayor Gieck asked for a Recess, as the Regular Meeting will continue. MAYOR GIECK CALLED THE REGULAR MEETING TO ORDER. CONFIRMATION OF AGENDA: The Mayor asked for any additions or corrections. There were no corrections or additions. APPROVAL OF MINUTES OF SPECIAL MEETING -91-15, September 24, 1991 TRUSTEE HOVEL MOVED TO APPROVE THE -SPECIAL MEETING MINUTES, 91 15, September 24, 1991 . Mayor Gieck asked for any additional discussion. No further discussion. A vote was taken and the motion approved unanimously. Page 5 REGULAR BOARD MEETING November 19, 1991 - 91 -16 111 APPROVAL OF MINUTES OF REGULAR MEETING 91-13, October 15, 1991 : TRUSTEE HOVEL MOVED TO APPROVE THE MINUTES OF THE REGULAR MEETING (91-13) , October 15, 1991 . Mayor Gieck asked for additional discussion. There was no additional disucssion. A vote was taken and the motion was approved unanimously. APPROVAL OF MINUTES OF SPECIAL MEETING, 91 -14, October 28, 1991 : TRUSTEE HOVEL MOVED TO APPROVE THE MINUTES OF THE SPECIAL MEETING, 91-14, October 28, 1991 . The Mayor asked for any additional discussion. There was no further discussion. A vote was taken and the motion approved unanimously. APPROVAL OF ACCOUNTS PAYABLE - November 1991 : Trustee Hovel requested that the Board take a few minutes and review the enclosed bills. Trustee Hovel stated while the Board reviewed the bills, that he and the Town Clerk feel that the payroll should be published quarterly, such as other small towns and show an explanation along with publishing these bills which will answer lots of questions for the public. The Mayor questioned the Board Members present as to any objection they might have. There were no objections from the Town Board members. TRUSTEE RAU MOVED TO APPROVE THE BILLS FOR NOVEMBER. The Mayor asked for any additional discussion. There was no further discussion. A vote was taken and the motion approved unanimously. PUBLIC COMMENTS: The Mayor ask if there were any public comments. There were no comments from the audience present. AGENDA ITEMS: A. Terry Salberg representating the Highland Recreation Association was present. Terry again stated that the HRA is here to provide recreational and educational opportunities for the youth in the rural areas, serving Nunn, Carr, Pierce and Ault. Terry passed out information regarding the budget for this organization. She pointed out on the actual budget for 1991 under Basketball registration fees which showed $272.00 ($690.00) , that should read 1990 and not 1991 . At the bottom showing totals for 1991 , it shows $15,964.32 for reg- istration fees and the estimated budget was $11 ,000 and so this was must better than anticipated. Expenses show $15,503.30 and that figure was also below what was estimated of $16,000. Terry feels she and staff are constantly working to keep the programs as cheap as possible so more youth of the community can have an opportunity to participate. She also stated that 69 youth are in the Wrestling program. Page 6 REGULAR BOARD MEETING - continued November 19, 1991 - 91-16 AGENDA ITEMS - continued Terry stated that the HRA was present this evening to ask the Town of Ault for their support for providing help to the youth of the community by providing $1 , 100.00 for this year. She also mentioned that other small communities will contribute $1 , 100.00 for 1992 and she was asking that the Town of Ault to match that amount. Trustee Hovel questioned numbers involved. Terry noted that the HRA served 385 youths of the area. Other classes, such as Crafts is still in the process before the end of the year. She also noted that the 69 youths in wrestling are not figured in the above figure. Trustee Sheets questioned how many of those youths are residents of Ault - there was no figure at this time. Trustee Hovel confirmed that the HRA would have an additional $4,000 in additional revenue over expenses. Trustee Hovel also questioned whether there were any goals in place for the coming years if the revenue continues to increase. Terry stated that the main goal is to find funding to provide a Director and it is impossible to continue year around without a Director. The cost for a Director would be about $20,000 a year as a full -time position. Presently, she feels it will take at least $1 ,000 a month for two directors. The Mayor ask for any additional comments or discussion. Mayor Gieck ask about the present contract with VISTA. Terry noted that the grant expires April 7th. VISTA pays the salaries of the two ladies present. This item will be tabled until the next regular board meeting. HORSESHOE CLUB - STORAGE SHED: Trustee Hovel suggested that it be tabled until the next board meeting. Trustee Sheets suggested waiting until after the budgeting is completed. DISSOLVEMENT OF AULT HOUSING AUTHORITY: Town Clerk, Pat Lesh stated that she has received notices from the State Auditors office because the Ault Housing Authority has not turned in an audit. The Auditors office has stated all that is necessary is a letter from the Town indicating that it is the Town' s wish that this Authority be dissolved and that this Authority is not a working authority. Trustee Sheets questioned what was the Ault Housing Authority. Mayor Gieck explained it began eight years ago and probably facilitate any expenditures to locating homes for low-income. Pat Lesh commented that the reason the state auditors picked this up is because there was a new law passed in 1990 that gave this to the state auditor's office. A letter is necessary to dissolve this authority. TRUSTEE RAU MOVED TO DISSOLVE THE AULT HOUSING AUTHORITY AND THAT A LETTER BE WRITTEN TO THE APPROPRIATE AGENCY ADVISING THEM OF OUR DECISION. The Mayor asked if there was any additional discussion. A vote was taken and the motion approved unanimously Page 7 REGULAR BOARD MEETING - continued November 19, 1991 - 91 -16 READING OF JANEAN DILLS RESIGNATION LETTER: Mayor Gieck asked Town Clerk, Pat Lesh to read the resignation letter. Pat Lesh read the letter in its entirety to the audience. Mayor Gieck commented that Janean Dill was not fired and that she had informed the Mayor that she had received a full -time position with the Oniongrowers in Pierce. As it was the end of the month, that Friday, November 1 , was her last day employed with the Town of Ault. Pat Lesh indicated that she has been paid for November 1st. She received two-day vacation pay, October 21st and October 22nd which still leaves 3 days of vacation pay that she is entitled to. The Board felt that since she was two months short of one year, the pay would be pro-rated. TRUSTEE SHEETS MOVED TO MAKE PAYMENT TO JANEAN DILL FOR UNUSED VACATION PAY PRO-RATED FOR THE 10-MONTHS OF EMPLOYMENT. Mayor Gieck asked for any additional discussion. There was no further discussion. A vote was taken and the motion approved unanimously. READING OF RESOLUTION 2-91 - RATIFICATION OF APPOINTMENT OF NEIL E. BEST AND DANIEL TEMPLETON TO BOARD OF TRUSTEES FOR THE WELD LIBRARY DISTRICT. Mayor Gieck stated that those trustees have already been appointed and that they will fill Greeley positions. Town Clerk, Pat Lesh read Resolution 2-91 in its entirety. TRUSTEE HOVEL MOVED TO APPROVE RESOLUTION 2-91 . The Mayor asked if there were any further discussions or comments. There were no questions. A vote was taken and the motion approved unanimously. ZONING VIOLATION - MOBILE HOME Trustee Hovel felt that this issue was still a little unclear as to where the Town stood on this matter. Trustee Hovel felt that Chief Hinz could check further for the Board as to what and where is the mobile home. Trustee Hovel felt it would be necessary to check as to what was the original agreement with this owner when he came in front of the board and it was felt that the mobile home, at that time, was not discussed. Chief Hinz stated that probably at the present time, it is not in violation. It is disconnected from all utilities and has been moved. Pat Lesh stated that it was moved in without permission from the town. It was used as an office, but he was also living in it. The owner of the building was aware that the issue must go in front of the Planning Commission and that the trailer was in violation of Town Ordinance now. The Board decided to keep the situation under observation, but presently the trailer has been moved and is not being used. Page 8 REGULAR BOARD MEETING - continued November 19, 1991 - 91 -16 LEAF DISPOSAL LOCATION: Mayor Gieck stated that he has been contacted by many residents to do something about leaf disposal as it is becoming a big problem in the city streets. Trustee Hoover and Trustee Rau felt the best way to get rid of the leaf problem was to just bag the trash. Trustee Hovel commented that last year the street--sweeper w.as brought in to clean the streets. He also noted that this year has been different and there are lots of leaves on the trees yet. PIERCE LAW ENFORCEMENT AGREEMENT: Trustee Hovel stated that there is an agreement, but the agreement has not be signed by Mayor VanWhy of Pierce. Chief Hinz stated that he could not find him today, but probably will locate him tomorrow. Chief Hinz commented that small changes are necessary and these changes will not affect the content at all . Trustee Hovel stated that he felt the current contract expired before the next regular board meeting. TRUSTEE HOVEL MOVED TO ACCEPT PIERCE LAW ENFORCEMENT AGREEMENT. The Mayor ask for any discussion. There was no further discussion. A vote was taken and the motion approved unanimously. WATERLINE REPLACEMENT: The Town Clerk stated that a location in town had recently indicated a leak during a leak-detection test. The leak is at a resident and the meter is in the basement, so the problem is that no water going through the meter. The pipe was replaced and an example of the very old pipe was present to view. The repair will cost about $325 for pipe. The Mayor feels that this is a serious problem that will have to be addressed by the Town Board. Trustee Hoover stated that the Town Ordinance is very clear on this matter. The Mayor indicated that an exception cannot be made or a change in the Ordinance. Trustee Hovel stated he feels the problem is with the meters in the house. Trustee Hovel also stated that when these lines are replaced, the meters should come back out to the curb where the meters belong for maintenance or whatever. The property owner is responsible for any water leak from the curb. to the meter. The Mayor noted that when other leaks appear, the must be fixed immediately and many are anticipated. Trustee Hovel recommended that the Water Authority look into this and have Trustee Hoover report back with any further findings. An arranangement with the present resident regarding payment will be made with the Town. Page 9 REGULAR BOARD MEETING - continued November 19, 1991 - 91-16 111 SEWER LINE CLEANOUT: Trustee Hovel stated this was regarding a problem with the car wash in town as to the sand traps at the car wash. The owner was notified that he would be responsible for the cleaning of the sand traps at the car wash. The owner stated that there was only a cup of sand. Trustee Hovel stated that during routine maintenance that it was 3/4 full of sand. Trustee Sheets wondered if there would be any way to check if the sand trap is being maintained. Trustee Hoover stated he went to the car wash and looked at the traps. One stall at the car wash appears to have all the necessary plumbing, but the other stall appeared not to have all the necessary plumbing; the overflow runs directly into the sewer lines. Trustee Hoover feels that one stall of the car wash is not operating as it should. Trustee Hovel feels that the Town should have that line jetted out on a quarterly basis just to cover the Town. Trustee Hovel also feels that the car wash owner should be billed for that expense. Trustee Hoover and Trustee Rau will contact the owner and again, present the problem. COMMITTEE REPORTS: POLICE: Chief Hinz stated that the only item for discussion would be Officer Greg Tarantino's pay raise. Chief Hinz felt it should be retroactive to the first of October. Chief Hinz indicated the necessary evaluation had been completed. PARKS AND CEMETERY: Trustee Hoff was absent. Trustee Hoover stated that servicing had been completed in draining the water sprinkler lines. LIBRARY: Mayor Gieck stated that a report will be submitted from the Library Board asking that Kay Backstrom, Marg Gieck and Charles Hoff be appointed to the Library Board. The Board will have to approve this appointment. TRUSTEE HOVEL MOVED TO APPROVE MAYOR GIECK'S APPOINTMENTS TO THE LIBRARY BOARD. The Mayor asked if there was any discussion. The was no further discussion. Trustees Sheets, Hovel , and Hoover voted in favor of the appointments. Trustee Rau voted against the appointments. Mayor Gieck voted in favor of the appointments. WATER AND SEWER: Trustee Hovel felt this had been previously discussed. STREETS AND ALLEY: Trustee Hovel feels that if the weather is good then the streets should be cleaned/sweeped. There seems to be a problem with the drain at the Post Office and the Town maintenance personnel will check this further. FINANCE AND BUDGET: Meetings must be scheduled for the budget. A public hearing must be scheduled and it was scheduled for December 11th. A budget meeting was scheduled for December 3rd Page 10 REGULAR BOARD MEETING - continued November 19, 1991 - 91 -16 COMMITTEE REPORTS - continued TREE BOARD: No report. AULT PLANNING COMMISSION: No report. AULT WATER PLANNING AUTHORITY: No report. There was another question from the audience as to what was the decision of the new dog/cat ordinance. Mayor Gieck explained that the ordinance had been covered for disucssion and possible corrections at the first of the meeting tonight. Another meeting regarding this ordinance will be set at a later date. The Mayor announced that he had received a letter of resignation from Ault Town Board member, Butch Marsh. The Mayor read the resignation letter in its entirety. MAYOR GIECK MOVED TO ACCEPT THE RESIGNATION OF AULT TOWN BOARD MEMBER, BUTCH MARSH. The Mayor asked for any additional questions or comments. It was noted that they intend to move out of state and their store in town will be closed. Trustee Hovel was grateful for Butch' s interest in the Town to serve as a board member and he wished him lots of luck. The Mayor noted that the Board should look for another replacement for this position. The Mayor suggested that it might be a good idea to look for a lady to serve on the board.
