ADOPTION OF RESOLUTION NO . 14-5012 AMENDING THE CITY'S RECORDS RETENTION SCHEDULE City Council Minutes August 5 , 2014 Page 3 of 13 The City's Records Retention Schedule is a written policy which governs the period records are ret a ined in the City . It provides the legal authority for the disposition of city records and demonstrates compliance with governmental regulations . Regu lar review and update of the C ity 's Record Retention Schedule is necessary to ensure the City is in compliance with changes in State law and guidelines issued by the Cal ifornia Secretary of State. Action : Adopted Resolution No. 14-5012 adopti ng the City's amended Records Retention Schedule and authorized the City C lerk to amend the C ity's Reco rd Retention Schedule as needed from time to time to reflect changes in State law and new guidel ines issued by the Cal iforn ia Secretary of State . E. FINAL SUBDIVISION MAP APPROVAL FOR TRACT MAP NO . 66417 , A FIVE- UNIT CONDOMINIUM PROJECT AT 44 3 1 -4439 ELLIS LANE The final map is in compliance with the tentative map and is ready for rec ordat ion . The map has been reviewed and approved by the City Engineer. The applicant has signed the Subdivis ion Improvement Agreement and placed the security deposit for street improvements . City's certification of the final map w ill allow the developer to record said map and start construction of the project. Action : 1) Received the Subdivision Improvement Agreement; 2) Approved the final subdivision map for Tract Map No . 66417 and dedications indicated on the map ; 3) Authorized the Interim City Manager to execute the Subdiv ision Improvement Ag re ement; and 4 ) Authorized the C ity Clerk to certify Tra ct Map No. 66417. F. FINAL SUBDIVISION MAP APPROVAL FOR FILE TRACT MAP NO . 72407 , TO CONSTRUCT A 74-UNIT SINGLE -FAMILY ATIACHED AND DETACHED RES IDENTIAL PROJECT, LOCATED AT 9250 LOWER AZUSA ROAD (APNS : 8592 -005 -00 3 AND 8592-005-0004 ) The Final Map for Tract No. 72407 is con sistent with the approved tentative map , and has been reviewed and approved by the City Engineer. The F inal Map meets the requirements of t he Subdivision Map Act and conditions imposed by the City. City's certification of the final map w ill allow the developer ,------------- City Council Minutes August 5, 2014 Page 4 of 13 to record Final Map for Tract No . 7240 7 and begin construction of the 74-unit single family subdivision project. Action : 1) Received the Subdivision Improvement Agreement ; 2) Approved the final tract map for Tract Map No . 66417 and dedications indicated on the map ; 3) Authorized the Interim City Manager to execute the Subd ivision Improvement Agreement ; and 4) Authorized the City Clerk to certify Tract Map No . 72407 . G. ADOPTION OF RESOLUTION NO . 14-5017 APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolut ion No . 14-5017 authorizing the payment of bills for Fiscal Year 2013 -14 . Act ion: Adopted Resolution No . 14-5017 . H. ADOPTION OF RESOLUTION NO . 14-5018 APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No . 14-5018 authorizing the payment of bills fo r Fiscal Year 2014-15 . Action : Adopted Resolution No . 14-5018 . D . ADOPTION OF RESOLUTION NO . 14 -5015, APPROVING THE MUSCATEL AVENUE ENGINEERING AND TRAFFIC SURVEY AND RECOMMENDED SPEED LIMITS AND TRAFFIC CALMING IMPROVEMENTS Muscatel Avenue currently has a posted speed limit of 35 mph . The purpose of the Traffic Study was to review the relevant issues that affect the residents and traffic along this segment. The area is primarily a residential neighborhood with an elementary school located at Muscatel Avenue and Emperor Avenue , which li es with in unincorporated Los Angeles County . Public Safety and Services Manager Sahagun gave a brief summary of the staff report. Jana Robbins , Transtech , gave a brief overview of the traffic survey . City Council Minutes August 5, 2014 Page 5 of 13 Mayor Blum opened public comment. James Cleary, Temple City resident , spoke in opposition of approving the traffic survey . James Jambazian , Temple City business owner, asked if bicycle lane can be added if the travel ing lanes were to be narrowed . Dan DeBoer, Temple City resident, thanked the City Council for helping the residents on Muscatel for addressing this issue . Hearing no further request to speak from the public , Mayor Blum closed public comment. Mayor Pro Tern Chavez made a motion to adopted Resolution No . 14-5015, approving the Muscatel Avenue Engineering and Traffic Survey and recommended speed limits and traffic calming improvements . Seconded by Councilmember Sternquist and unanimously carried by the following votes : AYES : ABSTAINED : NOES : 8. PUBLIC HEARING Councilmember-Sternquist, Vizcarra , Yu , Chavez, Blum Councilmember-None Councilmember-None A. ADOPTION OF RESOLUTION NO . 14-5016 CERTIFYING CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP ) FOR JUNE 1, 2 01 3 TO MAY 31 , 201 4 The City is in full c ompliance with the CMP in that all of the development review requirements have been codified into the Zoning Code and all mon itoring has been exempted . Adopting Resolution No . 14-5016 adopts the 2014 Local Development Report (LOR ) and certifies the City's conformance w ith the CMP . Associate Planner Gulick gave a brief summary of the staff report. Mayor Blum opened public comment. Hearing no request to speak from the public , Mayor Blum closed public comment. Councilmember Yu made a motion to adopt Resolut ion No . 14-5016 certifying conformance with the Los Angeles County Congestion Management Program . Seconded by Counc ilmember Sternquist and approved unanimously by the following votes : AYES : Counci lmember -Sternquist , Vizcarra , Yu , Chavez , Blum City Council Minutes August 5 , 2014 Page 6 of 13 ABSTAINED : Councilmember-None NOES: Councilmember-None Mayor Pro Tern Chavez recused himself from the discussion and voting on this item as S ing Tao Newspapers Los Angeles L TO was one of his business client. 9. UNFINISHED BUSINESS A. REQUEST FROM SING TAO NEWSPAPERS LOS ANGELES L TO. FOR THE CITY TO HOST AND CO -SPONSOR THE 2015 SING TAO LUNAR NEW YEAR STREET FESTIVAL Sing Tao's orig inal proposal included 10 items that the City was requested to provide . The app lication also included a request to sell and prov ide free samples of alcoholic beverages , which was the subject of some City Council discussion on June 17. During further discussion with staff on Ju ly 3, Sing Tao revised and clarified their original proposal. S ing Tao further stated that they are willing to pay $10 ,000 to the City to help offset the cost of hosting the event, with the City to absorb the remaining costs . Community Development Director Forbes gave a brief summary of the staff report . Mayor Blum asked S ing Tao why the event was extended to a two day event. Melissa Lee, Genera l Manager for Sing Tao , answered Mayor Blum 's question . Mayor Blum expressed concerns for closing down Las Tunas for two days, Saturday and Sunday . He also commented that Sing Tao should equally share the cost with the City for having this event. Mayor Blum opened public comment. Jerry Jambazian , Temple City bus i ness owner, spoke in favor of the festival but spoke against the C ity contributing monetarily and co-sponsoring the event. William Man , Temple City resident , spoke in favor of the festival. Mary Kokayko , Temple City resident, spoke in opposition of the City contributing monetarily and to co-sponsoring the event. Mark Enkelaar, Temple City resident , spoke in favor of having celebrations in the City but spoke in opposition of the C ity contribut ing monetarily to the event. Carol Daugherty, Temple City resident , expressed concern about the festival's City Council Minutes August 5, 2014 Page 7 of 13 hours on Sunday . She felt those attending Church on Sunday would have to compete for parking with those attending the event. Lucy Liu , Temple City resident , suggested that City Council cons ider comparing the cost of similar events in the surround i ng cities . Beverly Guan , Temple City res ident, asked if the City contributes money towards any other festivals in the City . Hearing no further request to speak from the public , Mayor Blum closed public comment. Councilmember Sternquist spoke in favor of the festival but expressed concerns about some of the requests made by Sing Tao (i .e ., exclusive rights to the park, request for 300 parking spaces , extending the event to two days , etc .). Councilmember Vizcarra spoke in favor of keeping the festival to one day but allowing the hours to be extended . He expressed concerns regarding the sales of alcohol during this event. Councilmembe r Yu spoke in favor of the two day festival. He expressed the importance of hav ing events like the Lunar New Year in the C ity as the demographic of the C ity is changing . Mayor Blum spoke in favor of the festival but expressed concerns about possible interruption to local businesses along Las Tunas and lack of parking if the festival was extended to two days. He commented that Sing Tao should contribute half of the cost to host the event and suggested revising the name of the event from 2015 Sing Tao Lunar New Year Festival to 2015 Lunar New Year Festival. Councilmember Yu made a motion to host and co-sponsor the two day festival with the condition to rename the event to Lunar New Year Street Festival , for S ing Tao to share t he cost for the event with the City, limit the City's monetary contribution to a maximum of $16 ,000 , adjust the festival 's Sunday hours from 9 a .m . - 7 p.m . to 12 p .m . -7 p.m ., and directed staff to work with Sing Tao to resolve traffic , parking and any other issues . App roval of fest ival contingent upon Sing Tao completing conditions set by the City by December 2 , 2014 . NEW BUSINESS A. APPROVAL OF AN ANNUAL CONSULTANT SERVICES AGREEMENT WITH THE TEMPLE CITY CHAMBER OF COMMERCE The draft annual Consultant Services Agreement with the Chamber for 2014-15 incorporates most of the same provisions as the agreements the City Council approved for the Chamber in 2012 -13 and 2013-14 . Although the majority of the Chamber tasks remain the same , the City Council may wish to consider some changes in the Scope of Services the Chamber provides . Interim City Manager Penman gave a brief summary of the staff report . Mayor Blum opened pub lic comment. Rita Padilla , Chairman of the Board of Director for Temple City Chamber of Commerce , thanked C ity Council for their continuing support . Jerry Jambazian , Temple City business owner , commented about the lack of accountability from the Temple City Chamber of Commerce . Hearing no further request to speak from the public, Mayor Blum closed the public comment. Councilmember Sternquist expressed the importance for the City Council to meet jointly with the Chamber of Commerce . Councilmember Yu spoke in support of extending the agreement on a monthly bas is . Mayor Pro Tern Chavez commented about the tasks listed in the agreement. He felt it would be important to determine which tasks are real istic . Mayor Blum spoke in support of a joint meeting of City Council and the Chamber Board and suggested approving the agreement for three month . City Attorney Vail reminded City Council that the agreement with the Chamber can be cancelled any time with a 30 days ' notice . He emphasized the importance of having an agreement i n place since the City continues to make the monthly installments to the Chamber without an agreement. Mayor Blum asks Councilmember Sternquist, City's lia ison to the Chamber of Commerce , to work with Peter Choi (Chamber President and CEO) and Rita Padilla (Chamber Executive Board President) to put together a jo i nt meeting City Council Minutes August 5, 2014 Page 9 of 13 agenda . Councilmember Vizcarra made a motion to approve a Consultant Services Agreement with the Temple City Chamber of Commerce for Economic Development Services in an amount not to exceed $70 ,000 , payable in 12 monthly installments of $5 ,833.33 for Fiscal Year (FY) 2014-15 ; and authorize the Interim City Manager to finalize and execute the Consultant Services Agreement with Temple City Chamber of Commerce and set up a joint meeting with the Chamber's Executive Board within the next three months . COMMUNICATIONS -None 12. UPDATE FROM CITY MANAGER Interim City Manage r Penman made the follow announcements: Wednesday , August 6 , National Night Out , at Temple City Pa rk , 6 p .m . Live music follows at 7 p .m . with The Answer , playing classic rock from the Beatles to Tom Jones ; Wednesday, August 13 , Ne ighborhood Watch Meeting at Golden West Baptist Church for those living in the neighborhoods bound by Olive Street, Baldwin Avenue , Lower Azusa Road and Temple City Boulevard . The meeting starts at 5 :30 p.m ; Parks and Recreation Commission met last week to prioritize phases for potential biking and walking trails , which will be included as part of a $240 ,000 grant application to Supervisor Mike Antonovich . More information will be provided and presented at the next City Council meeting ; Wednesday , August 6 , Public Arts Commission will review design concepts for a planned publ ic art sculpture at the Linden Walk subdivision . The advisory body will also discuss options regarding development of an art mural program . Those wanting more information on Commission actions can download meeting agendas , minutes and staff reports from the City 's website at www.templecity .us . Interim City Manager Penman also reminded the public that new weekly street sweeping schedule started August 4 . Cars will be ticketed if it is parked on the street during street sweeping days.
