INTRODUCTION AND FIRST READING OF ORDINANCE NO. 14-995
AMENDING SECTION 3-5D-9.D AND ADDING SECTION 3-5D-11 OF
ARTICLE A OF CHAPTER 5 OF TITLE 3 OF THE TEMPLE CITY
MUNICIPAL CODE (TCMC) RELATIVE TO DOGS IN PUBLIC PARKS
RECOMMENDATION:
The City Council is requested to :
a) Introduce Ordinance No. 14-995 (Attachment "A") for first reading by title only,
amending Section 3-5D-9.D and adding Section 3-5D-11 of Article A of Chapter 5
of Title 3 of the Temple C ity Municipal Code (TCMC);
b) Waive further reading of Ord inance No . 14-995 ; and
c) Schedule the second reading of Ordinance No . 14-995 for September 2 , 201 4.
BACKGROUND:
1. On October 21 , 2013 , a public meeting was held at Live Oak Park to present
preliminary f indings f rom the Parks and Open Space Master Plan (Master Plan).
Discussion focused on key survey f i ndings, user t rends and priorities , and
recommendations for future parks and open space. The findings showed that the
community's interest in pet-friendly spaces ranked amongst the top seven priorities
fo r improving the City's parks .
2 . On April 2 , 2014, the City Council adopted the Master Plan as presented includ ing
a recommendation to revise the existing TCMC to allow dogs in the City's parks .
3 . On May 21 , 2014 , the Pa rks and Recreat ion Commission reviewed Sectio n 3 -5D -
9 .D of the Temple C ity Municipal Code relating to domestic animals in the City's

parks. The Commission suggested that staff survey park stakeholders and public
groups and directed staff to proceed with revisions to Section 3-50-9.0 to allow
dogs in City parks .
4. On May 27, 2014, staff began an open-ended survey, gathering public opinion
relating to allowing leashed dogs within City parks via the City website and on -site
at Live Oak Park .
5. On June 18, 2014, the Parks and Recreation Commission suggested that staff
further research legal language utilized in other cities ' municipal codes. The
Commission also requested staff discuss the proposed code amendment with
Park Patrol and Community Preservation Officers .
6 . On July 16, 2014, the Parks and Recreation Commission approved the proposed
amendment to the TCMC allowing leashed dogs in certain areas of the parks and
recommended approval to the City Council.
7. On August 7 , 2014, a public hearing notice regarding Ordinance No .14-995 was
published in the Temple City Tribune .
ANALYSIS:
Currently, the City prohibits the entrance of any dog or domesticated animal within City
parks pursuant to Section 3-50-9.0 of the Temple City Municipal Code. However, with
the approval of the Parks and Open Space Master Plan on April 2 , 2014 , Parks and
Recreation staff noticed a discrepancy between the needs of the community and the
banning of dogs from parks.
In preparation of the Master Plan, a Community Needs Assessment was conducted to
ensure that the community's perceived needs for parks and open space were
documented and prioritized . The Assessment revealed that the public considered "pet-
friendly spaces" to be an opportunity for park/facility improvement. According to the
statistically valid survey from the Master Plan, 58% of respondents showed support for
park facility improvements to include pet-friendly spaces. These pet-friendly spaces
ranked 61h of 22 that community members felt were a facility/amenity priority for the City.
Parks and Recreation staff realized the opportunity to address this particular community
need and researched surrounding cities for ordinances relative to allowing pets,
specifically dogs, within City parks (Attachment "B"). At their regular meeting on May
21, 2014, the Parks and Recreation Commiss ion reviewed the information provided by
staff and requested that staff gather additional input from the public and park users. A
general public survey, made available online and in-person, was conducted between
May 27 and June 13, 2014. The survey revealed an approximate 70% majority of over
170 survey-takers were supportive of a code amendment allowing leashed dogs within
City Council

the parks (Attachment "C"). Staff returned to the Commission with these findings on
June 18 , 2014 along with proposed revisions to the municipal code .
During the June 18, 2014 meeting , the Parks and Recreat ion Commission requested
that staff research the legal language used in other city municipal codes specifically
pertaining to dogs being under the control of a "capable " and "competent" person
(Attachment "D"). The Comm ission also advocated discussing the code amendment
with staff responsible for enforcing the municipal code at the parks .
Staff prov ided a copy of the proposal ordinance to the Park Patrol Officers and
Community Preservation Officers . The main issue expressed by enforcement staff was
a concern about the poss i ble increase of dog-related issues (e .g . bites , aggression ,
etc.). Staff looked into surrounding cities that allow dogs in parks and safety issues that
may have arisen . Consensus amongst the cities was that reported bites were very rare
and that dog behavior has been re latively peaceful w ithin the parks . Though still rare (1
to 2 times every 1 to 2 years ), most reports and animal control intervention occurred :
1. W ith wild life such as coyotes com ing down i nto cities located near the foothills ;
2 . When a dog was running off-leash ; or
3 . A dog -related incident within city boundaries , not park boundaries .
The Parks and Recreation Commission , at the ir July 16 , 2014 regular meeti ng ,
approved the proposed amendment to the TCMC to allow leashed dogs in certain areas
of the C ity's parks and recommended approval of the code amendment to the City
Council. The City Attorney has reviewed , provided input , and approved proposed
Ordinance No . 14-955.
CONCLUSION:
Ordinance No . 14-995 amends Section 3-5D -9 .D and adds Section 3-5D-11 of Article A
of Chapter 5 of Title 3 of the Temple City Municipal Code . Adoption of Ordinance No .
14-995 will allow leashed dogs in certain areas of the City's parks finalizing a
recommendat ion from the recently adopted Master Plan .

SECTION 3-5 D-11 OF ARTIC LE A OF CHAPTER 5 OF TITLE 3 OF
THE T EMPLE CITY MU NICIP AL CODE RELATIN G TO DOGS IN
PUBLIC PARKS
WHEREAS, Titl e 3, Chapter 5, Article D of the Temple City Municipal Code governs behavior in city
parks; and ,
WHEREAS , Title 3, Chapter 5, Article D Sec tion 3-5 D-9 .D of th e Temple City M unicipal Code , which
prohibits dogs and oth er domestic animals in city parks , has not been amended since the City incorporated in
1960;and
WHEREAS , the City Council adopted a Parks and Open Space Master Plan on April 2, 2014 which
identified pet friendly pa rk s as a high priority among residents ; and
WHEREAS , the Ci ty wants to update the provisions of Title 3, Chapter 4 , Article D to better reflect
the community's nee ds ; and ,
WHEREAS , the Parks and Recreation Commission cons idered an amendment to T itle 3, Chapter
5, Arti cleD of the Temple City Mu nicipal Code on Ma y 21 , 2014 , Jun e 18 , 2014 and July 16 , 2014 wh ic h
would allow leashed dogs in specific areas of the City 's parks ; a nd
WHEREAS , this Ord inance is consistent wi t h the recommendation provided by the Parks and
Recreation Commission when approving the amendment on Ju ly 16, 2014 ,
THE CITY COU NCIL O F TH E CITY OF TE MPLE CITY HEREBY ORDAINS AS FOLLOWS:
SECTION 1: Section 3-5D-9 .D is hereby amended and Section 3-5D-11 is hereby added to the
Temple City Municipal Code to read as set forth in Exhibit "A" to this Ordinance.
SECTION 2: Severability.
The City Counc il hereby declares that , should an y provision , section , subsection , pa ragraph ,
sen tence, clause , phrase , or word of this Ordinance or any part thereof, be ren dered or declared inv alid or
unconstitutional by any final court action in a court of competent j urisdiction or by reason of any preemptive
legisla tion, such decision or action shall not affec t the validity of the remaining section or portions of the
Ordi na nce or part there of. T he City Council hereby declares tha t it would have indepen dently adopted the
remaining provis ions, sections , subsections , paragraphs , sentences , clauses, phrases , or words of this
Ordinance irrespective of the fact that any one or more provisions , sections, subsect ions , paragraphs,
sentences , clauses, phrases, or words may be declared invalid or un constitu ti onal.
SECTION 3: Publication .
The City Clerk shall certify to the passage and adoption of this Ordinance and to its approval by the
Ma yor and shall cause the same to be published ac cording to law .
SECTION 4: Effective Date.
This Ord inance shall take effect thirty (30) days after its adoption by the City Council.

3-5D-9. BEHAVIOR
No person in a park or civic center shall, except as express written permission is granted by the parks and
recreation commission:
D. Have been responsible for the entry of a dog or other domestic animal into a city park
except for dogs under the circumstances as prov ided for in Section 3-5D-11 areas other
than automobile parking concourses and walks immediately adjacent thereto, and in such
other areas as may be clearly marked by signs bearing the words "Domestic Animal
Permitted In This Area". Nothing herein shall be construed as permitting the running of
dogs at large. All dogs in those areas where such animals are permitted shall be
restrained at all times on adequate leashes not greater than four feet (4') in length;
Note: Sections A – C and E – Q of this section remain unchanged.
3-5D-11 DOGS
A. Dogs are prohibited in the following areas of the parks:
1. Building interiors, patios, and covered walkways immediately adjacent thereto;
2. Performing Arts Pavilion;
3. Playgrounds;
4. Picnic shelters;
5. Tennis courts;
6. Basketball courts;
7. Athletic fields;
8. Baseball/softball fields;
9. Bleachers; and
10. Areas temporarily designated by the Director during special events.
B. Dogs are permitted in passive grass areas and walkways of the parks, not included in A.
above, or in areas designated from time to time by the Director. The following
requirements shall be adhered to by the person(s) responsible for the dog:
1. Dogs must be securely restrained by a leash no longer than six feet (6’) of
sufficient strength, and under the full care, custody an d proper control of a
competent and capable person. Dogs shall not be left unattended at any time.
2. Persons responsible for the dog shall immediately remove and properly dispose of
any dog waste.
3. The presence of a dog shall constitute implied consent of t he dog’s owner or any
person responsible for the dog, to strictly follow the rules of this section and shall
constitute a waiver of liability to the city, its elected officials, officers and
employees, and assumption of all risks, and an agreement and undertaking to
protect, and indemnify, defend and hold harmless the city, its elected officials,
officers and employees, for any injury or damage to persons or property during
any time that the dog is in the park or civic center.
C. Dogs controlled by law enforcement and legitimate service dogs and guide dogs are
exempt from the prohibitions in Section 3-5D-11A.
D. Any person who violates any provision of this section is guilty of an infraction pursuant to
Section 1-2-0-2 of the Temple City Municipal Code and may be subject to a penalty of $100
for the first offense and $200 for the second offense; subsequent violations shall be
deemed “misdemeanors” and are subject to a penalty of $500.

Article IV, Cha12ter 1, Part 2, Division 3, Section 4123 PROHIBITED :
No person owning or having charge , care , custody or control of any dog shall cause ,
permit, or allow the same to be or to ru n at large upon any highway, street, lane, alley,
Arcadia court or other publ ic place, or upon any private property or premises other than those of
the person owning or having charge , care, custody or control of such dog, unless such
dog be restrained by a substantial chain or leash not exceeding s ix (6) feet in length and
is in the charge, care, custody or control of a competent person .

(G) Animals . No person shall bring into any public park any cattle , horse, mule, goat,

CLEANUP .
(A) No person owning or having the charge , care , custody or control of any dog sh all
cause , permit o r allow the same to be or to run at large upon any st reet , lane, alley,
court or other public place in t he c ity, or upon any private property or premises in the city
other than those of the person owning or having the charge care , custody or control of
such dog , unless such dog shall be restrained by a substantial c hain or leash not
exceeding six feet in length and is in the care, custody or control of a competent
person .

permit, or allow the same to e or run at large upon any highway, street, lane, property or
Sierra Madre premises other than those enclosed by fencing or structures sufficient to confine such
dog in t he city , unless s uch dog be restrained by a substantial chain or leash not
exceeding six (6) feet in length and is in the charge, care, custody, or control of a
competent person.
NOTE : Many cities utilize an amended version of a Los Angeles County Animal Control Ordinance:
The followi ng provisions of said Ordinances of the County of Los Ange les are hereby amended to read as
follows :
(A) Sect ion 701 of the A nimal Control Ordinance, designated as Ordinance No. 9454 of the County of Los
Ange les, is hereby amen ded to read as follows: "701 . No person owning or having charge , care , custody or
