(Pub 1 i shed in the Da i 1 y '-R-e-e-e-f'-tl- the CW1 day of tfk>lInnht"ll' 1981) THE CITY OF BEL AIRE, KANSAS ORDINANCE NO.~ AN ORDINANCE PERTAINING TO WEAPONS; PROVIDING FOR THE UNLAWFUL USE; DESCRIBING ACTS WHICH CONSTITUTE UNLAWFUL USE; PROVIDING FOR EX~MPTIONS THERETO AND PROVIDING PENALTIES FOR VIOLATIONS. Be It Ordained by the Governing Body of the City of Bel Aire, Kansas: SECTION 1. Weapons--Unlawful use prohibited. It is unlawful for anyone within tne Clty to unlawfully use any weapons. SECTION II. Acts Constituting unlawful use. weapons is knowingly: A. Selling, manufacturing, purchasing, possessing or carrying any bludgeon, sandclub, shotgun with a barrel less than eighte~n inches in length, metal knuckles or any knife, commonly referred to as a switchblade, which has a blade that open automatically by hand pressure applied to a button, spring or other device in the handles of the knife, or any knife having a blade that opens or falls or is ejected into position by the force of gravity or by an outward, downward, or centrifugal thrust or movem~nt; or Unl awful use of B. Carrying concealed on one's person, or possessing wi.th intent to use the same unlawfully against another, a dagger, dirk, billy, blackjack, sling shot, dangerous knife, straight-edged razor, stiletto or any other dangerous or deadly weapon or instrument of like character; provided, an ordinary knife with no blade more than four inches in length shall not be construed to be a dangerous knife, or a dangerous or deadly weapon or instrument; or C. Carrying on one's person or in any land, water or air vehicle, with intent to use the same unlawfully, a tear gas or smoke bomb or projector or any object containing a noxious liquid, gas or substance; or D. Carrying any pistol, revolver or other firearm concealed on the person except when on his land or in his abode or fixed place of business; or E. Setting a spring gun; or F. Possessing any device or attachment of any kind designed, used or intended for use in silencing the report of any firearm; or G. Selling, manufacturing, purchasing, possession or carrying any firearms designed to discharge or capable of discharging automatically more than once by a single function of the trigger; or H. Carrying either concealed or unconcealed weapons On one's person or in any land, water or air vehicle, any loaded firearm of any kind, SECTION III. Exemptions from Ordinance applicability. A. Subsection A, B, C, D, and G of Section Two (2) shall not apply to or affect any of the following: 1. Law enforcement officer, or any person summonded by any such officers to assist in making arrests or preserving th peace while actually engaged in assisting such officer; 2. Wardens, superintendents and keepers of prisons, penitentiaries, jails and other institutions for the detention of persons accused or convicted of crime; '"""-'" -.. ". -...._._--~_.~..,._._"'"._.,~"._"~--,-----,~ 3. Members of the armed services or reserve forces of the United States or the Kansas National Guard while in performance of their official duty; 4. Manufacture of, transportation to, or sale of weapons to persons authorized under 1 through 3 of this subsection to possess such weapons. B. Subsection D of Section Two (2) shall not apply to or affect the following; 1. Watchmen while actuall,y engaged in the performance of the duties of their employment; or 2. in hunting or fishing; or Licensed hunters or fishermen while engaged 3. Persons 1 icensed as private detectives by the state, detectives or special agents regularly employed by railroad companies or other corporations to perform full-time security or investigation. service. an exemption. C. It shall be a defense if the defendant is within SECTION IV. Violation--Pena1tY--Destruction of weapons authorized when. Any person who violates any of the provisions of this chapter is guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed Five hundred dollars ($500.00).
