HomeMy Public PortalAboutOrdinance 74-392ORDINANCE NO, 74 -392 AN ORDINANCE OF THE CITY OF TEMPLE CITY ENACTING AN INTERIM ZONING ORDINANCE PURSUANT TO THE 'PROVISIONS OF SECTION . 65858 OF THE CALIFORNIA GOVERNMENT CODE RELATING TO A MORATORIUM ON THE CONSTRUC- TION OF MULTIPLE UNITS OF GREATER DENSITY THAN DEPICTED ON THE GENERAL PLAN THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council does hereby find and deter- mine that: 1) That there is currently certain residentially zoned real property within the City of Temple City which is zoned so as to authorize development at densities in excess of those which are authorized by the General Plan of the City; and 2) That there is currently certain residentially zoned real property within the City of Temple City which is zoned so as to authorize development at densities below those which are authorized by the General Plan of the City; and 3) That pending the resolution of these conflicts between the Zoning Code and the General Plan, the public safety, health and welfare require the adoption of an interim measure to prohibit development in excess of the densities shown on the general plan within certain areas of the City. SECTION 2. The Council further finds that the processing of such studies is contemplated within the next few months, . and that to permit further inconsistent density construction prior to the consummation of the appropriate hearings thereon would in large measure emasculate the benefits to be derived therefrom and would be contrary to the best interests and general welfare of the residents of this City. SECTION 3. Pending completion of such studies, and pursuant to the provisions of Section 65858 of the Government Code, a moratorium is hereby imposed upon the construction (in the hereinafter described area). in excess of the density . standards for such (specific) areas as depicted in the General Plan (as amended) of the City: a) Area bounded by McCulloch and Santa Anita Avenues, between Freer Street and Live Oak Avenue and both sides of Farago between Freer Street and Grand Avenue - R -3 zoning (13 -24 units per acre). b) Area bounded by Oak and Encinita Avenues between Workman and Woodruff Avenues - R -3 zoning (13 -24 units per acre). Ordinance No. 74 -392 c) Both sides of Hermosa Drive, Rosemead to Encinita Avenue, and area from Myda Avenue to Encinita Avenue between Hermosa Drive and alley northerly of Las Tunas Drive - R -3 zoning (13 -24 units per acre). d) West side of Encinita from Las Tunas Drive to Workman Avenue - R -3 zoning (13 -24 units per acre). e) North side of Lower Azusa. Road, Agnes to. Glickman - R -4 zoning (25 -36 units per acre). f) North side of Lower Azusa Road, both sides of. Camellia - R -4 zoning (25 -36 units per acre). SECTION 4. All provisions of the Temple City Municipal Code inconsistent herewith are suspended during the term of this Ordinance. SECTION 5. This Ordinance shall expire upon the latest date authorized by Section 65858 of the California Government Code. SECTION 6. This Ordinance shall become immediately effective pursuant to the provisions. of Section 65858 of the Government Code and for the reasons above stated,, and is adopted pursuant to the authority of Anderson v. Pleasant Hills, 229 CA 2d 79; Metro Realt v. Count of El Dorado, 7777A 2d 508; Hunter v. '•ams, :0 C AG Ops 14; and Slater v. Los An eles, 238 CA 2d 864; West Coast Adv. v. San Francisco, C357; and Candlestick v. San Francisco Ba Conservation and Development Commission, 11 CA 3d 557, 't antic Ric ie • v, Boar•, 0 C' 1-' 3rd Civ. 14057. SECTION 7. The City shall certify to the adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, published and circulated in the City. of Temple. City. APPROVED and ADOPTED this 17th day of September 1974.
