All members voting YESv MOTION CARRIED ACCOUNTS PAYABLE After review, MOTION WAS MADE BY TRUSTEE -- FEBRUARY 92 HOFF, to approve the February 1992 .. accounts payable as presented. All members voting YES, MOTION CARRIED AUDIENCE MEMBER Dale Hall , a candidate for County INTRODUCED Commissioner at Large was present in the audience and introduced himself . STEWART MOBILE Roger Prenzlow, owner of Stewart Mobile HOME F`ARK, Home Park referred to the agreement WATER METERS arrived at last summer for private metering of water . The agreement was ' satisfactory except for Item #8, where there are two points in disagreement. The first point refers to the total acre feet of water that Stewart Mobile Home Park has furnished the Town. Research of records by Trustee Hoover and Mr. Prenzlow revealed that at the time the mobile home park was annexed to the Town , there was 5 acre feet of water � dedicated to the Town by Resolution 7/7/71 . PAGE ONE 19921 FEBRUARY 18 - _ July, 1983 the park was expanded and an additional 4. 5 acre feet of water was dedicated to the Town. After research , Mrs. Stewart produced a check � . � written August 4 , 1972 for final water for 31 spaces, $2650. 00. During that period of time the price for an acre foot of water was $265. 00. It would appear that this $2,650. 00 check was for 10 acre feet of water. On September 191 1972, page 102 of the minute book. there was recorded that $27650. 00 was transferred to the water bond account. Mr. Prenzlow requested that the Town acknowledge that Stewart Mobile Home Park has furnished the Town of Ault with a total of 19. 5 acre feet of water. MOTION WAS MADE BY TRUSTEE HOOVERr to accept 19. 5 acre feet as the negotiated total for water dedicated to the Town of Ault. All members voting YES, MOTION CARRIED The second point in contention , is the surcharge in the event Stewart Mobile Home Park over users their allocation. Mr. Fly-enzlow stated that historically the park has used less than 15 acre feet of water per year. Water consumption of . the park should drop upon installation of imdividual meters. The present agreement provides that the park pay a surcharge of $5. 00 per thousand on usage over 15 acre feet per year. Mr . Prenzlow 's attorney talked with Robert Burroughs, Town attorney. It was concluded that one class of customer can not be the only one that you charge a surcharge to. Therefore, the present agreement would not be enforceable, unless all water users were assessed the same surcharge. Mr. Prenzlow would like that item restated so as not to be punitive, but rather it was a pass through of any charges that the Town of � Ault sustained , because of something � that happened beyond the master meter � that the park couldn ' t control . � � PAGE TWQ 1992, FEBRUARY 18 --' -^ ` , Trustee Rau expressed his concern for lawn irrigation with the 1/4 share of water provided by the Park. The Town . needs some type of enforcement to make sure North Weld Water is not used for lawn irrigation. Discussion was held on � yield to be allowed in accordance with allotment. Trustee Hoff commented that 100% of yield should be allowed , the same as an acre foot is allowed for residential customers. Discussion was held concerning the possibility of not being able to take delivery on the quarter share of Water Supply and Storage. Trustee Hoover suggested that if the Park could not be supplied with the quarter share of Water Supply and Storage, that the Town of Ault would have right of first refusal on the purchase of that quarter of share, and transfer that water into the North Weld system. Mr. Prenzlow didn 't think this was a problem. M()IFI()p4 WAS MADE BY 11 RUSTBHOOVER, to amend Item 4:18 tox In the event that Stewart Mobile Home Park exceeds its � water allocation of 19. 5 acre feet in any calendar year , the Town of Ault shall have the right to charge a surcharge in addition to the regular .. water usage rates, to the owner of Stewart Mobile Home Park. The surcharge shall be equal to the current charges at the time of the infraction , over the minimum rate per thousand � gallons of water. If the mobile home park owner desires to avoid the surcharge, he or she may do so by: � a. Supplying the Town of Ault with � additional water rights, or ' b. Requesting the Town to rent � additional water , if available, and reimbursing the Town of Ault for any costs involved. RECORDED VOTE AS FOLLOWS: YEAS: Trustee Hoff , Lucero, Hoover , Mayor- Gieck. . . . . . . . . . . . . . . . . . . . . . . . . . 4 NAYS: Trustee Sheets, Rau, Hove1 . . . . 3 MOTION CARRIED Romero Sewer Arthur Romero, representing his Mother , requested that the residence at 261 East 4th Street be hooked to the Town ' s sewer .' system. Mrs. Romero 's septic tank has to be pumped every month and a half . The sewer line runs north and south along fence line of Catholic Church � property , 78 feet to the east of the Romero residence. The property tax I otice brought into the Clerk shows that this property has been annexed into the Town. Grade was discussed. Trustee Hovel suggested that a meeting be set With Sewer Committee in the immediate future. The septic tank is in back of the house. The annexation was probably done at the same time Stewart Mobile Home Park was expanded. There are three ' other houses to the west of this | property not hooked on to the Town � sewer. The Town is responsible for furnishing the sewer main , and the property owners are responsible from the main to the house, plus the sewer tap fee of $850. 00, and $6. 50 per month sewer charge. PAGE FOUR 1992, FEBRUARY 18 r� � | PRE-PAROLE PROPOSAL Bernie Diamond with Management & Training Corporation , Ogden Utah and Kip ' Kautsky with Colorado Department of ��� Corrections met with Mayor 8ieck and Clerk Lesh today concerning the pre- parole facility proposal that must be submitted by April 171 1992. A draft of the letter of endorsement to be submitted with proposal packets was distributed to the Board for there consideration. After extensive discussion , MOTION WAS MADE BY TRUSTEE HOVEL., that the letter be approved as presented. SEWER JETTING MOTION WAS MADE BY TRUSTEE HOVEL, to schedule jetting of all sewer mains by Royal -T for a cost of $1500. 00. All members voting YES, MOTION CARRIED ��N PAGE FIVE 1992, FEBRUARY 18 � / ~ | MOW1NG CONTRACT Trustee Hovel announced that he had � conversation with Clyde McNeece, the � contractor that had the mowing contract ' for the 1991 mowing season. Mr. McNeece ' agreed to mow Liberty Park , West 1st Street , Wayside Park , U. S. Highway and 3rd Street , and the Cemetery for $325. 00 per week. This bid would exclude the Public Library, 110 West First Street , Town Shop , 51:h & Graefe, and Eastside Park. Trustee Hovel felt that these three smaller lawns could be maintained by the Town Maintenance Man. MOTION WAS MADE BY TRUSTEE HOVEL, to award the bid for the 1992 mowing contract to Clyde McNeece for Liberty Park , Wayside Park , and the Cemetery for $325. 00 per week. Trustee Rau questioned if the Town currently owned lawn mowers. The response from Trustees Hoover and Hovel was that the Town owns a riding mower and a push lawn mower. The bid for 1992 is $25. 00 higher than in 1991 . By having the Town maintenance man mow the � � Library, Town Shop , and Eastsi(Ice Park , a � $100. 00 per week savings would be � realized. The trash fees will have to be adjusted. The new fee from Browning Ferris Inc. will be $4. 10 pickup per month, a fifty cent increase � over the current fee The customers are ' . � currently paying $5. 25 per month. Trustee Hovel explained that he will � refrain from voting , because he uses his dumpster at his place of business for � trash disposal and therefore is not a part of paying those fees. In the 1992 Budget a $1 . 00 per month increase was allowed. MOTION WAS MADE BY TRUSTEE � SHEETS, to raise trash fees to $6. 25 per month. MOTION WAS MADE BY � TRUSTEE RAU~ to accept the proposal from � Classic Constructors for playground � installation as presented. All members voting YES,, MOTION CARRIED The Parks Committee will meet Saturday to map out equipment installation. LEAK DETECTION A year ago we had a leak detection test � performed tol, Utility Technical Services � aI d it proved to be worth while. Our water loss for 1991 was 17334520 gallons. During November andDecember are loss was 4/% each month. There are .. two additional leaks that have not been repaired , but are scheduled to be repaired in the immediate future. MOTION WAS MADE BY TRUSTEE HOVEL,, to schedule with Utility Technical Technical Services for run a leak detection test. All members voting YES, MOTION CARRIED VOTING BOOTHS After discussion of voting booths, audience member , Ghirley Hinz stated ' that we may be able to rent some form of privacy shields from Weld County. Clerk Lesh will check with the county. If they do not have shields, this will be addressed at the next work session. COMMITTEE REPORTS: POLICE: The new car should be delivered the first part of March. PARKS AND CEMETERY: No report. ��0 PAGE SEVEN 1992, FEBRUARY 18 LIBRARY: Trustee Hoff was unable to attend the meeting. Mayor Gieck reported that the Library Board ordered Waterman 's to keep their van out of the | Library parking lot. Waterman 's told t � � hem that a Town Board member told them they could park there. Trustee Rau stated that he told them that he could | park there and that it had been discussed in a Board Meeting. ` WATER AND SEWER: Water line replacement and installation of meter pits was brought up by Trustee Sheets. The Ault Wate� Authority will meet and discuss | this. Trustee Hovel stated that we budgeted | for water purchase in 1992. He stated | that water should be purchased for water collected for in new construction. During 1990, $2,580. 00 was collected for two acre feet of water at $1000. and $1580 respectively. During 1991 $5,250. i was collected for three acre foot of water @$1750. This total to $7830. In the 1992 budget Capital Outlay in the Water Fund totals $15,000. MOTION CARRIED STREET AND ALLEY: Trustee Hovel reported that the new blade purchased | for the tractor is doing a good job. This summer the blade will be boxed in. FINANCE AND BUDGET: No report TREE BOAR[): Trustee Hovel suggested that if the Town would take the base of ' two trees, he would take the base of the next two trees, and possible other merc11 1ants would be responsible for the base of the other trees. The one the Town did last year worked out , and it would be nice if they were all done that way next summer. Trustee Rau asked about moving the new trees in the Cemetery. Trustee Hoff stated that the Cemetery Board voted to move the trees and in the future plant trees only along the roadway. PAGE EIGHT 1992, FEBRUARY 18 --- �. , AULT PLANNING COMMISSION: ' Trustee Hoff | stated that Mr. Tatro had requested | ' putting a trailer on the back half of his lot. Trustee Hoff stated this was against Ordinance. AULT WATER PLANNING AUTHORITY: No report . The next work session will be March 9, 1992 at 7: 00 p. m. The Police Committee will meet prior to this at Trustee Hovel suggested that two Conduct of Meeting Books at a cost of $15. 00 be ordered.
