HomeMy Public PortalAbout08-15-2005PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, AUGUST 15, 2005 The Common Council of the City of Richmond, Indiana met in regular session Monday, August 15, 2005, in the Council Chambers in said City. Vice President Diana Pappin presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GLOVER ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. Absent was Councilor Bruce Wissel. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of Monday, August 15, 2005 with a second by Councilor Sharp. The motion carried with a unanimous voice vote. COMMUNICATION FROM THE MAYOR Mayor Hutton commented on the following items: • Achieva Resources, Inc. will hold a public hearing regarding their CFF application to the Indiana Office of Rural Affairs on August 17 at 3 PM at the Achieva offices. • Hiking for Health will be at the COPE Environmental Center on Thursday, August 18. • The Richmond Bicentennial celebration will begin on August 27, 8:30 PM, with a Moonlight Parade. • The Mural on the Sim Hodgin Parkway bridge is complete. • Richmond schools begin classes on August 16. Watch for kids. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the July 21 and 28 meetings were accepted as presented REPORTS FROM DEPARTMENT HEADS City Attorney Walt Chidester announced that Ordinance No. 85 -2004 — A General Ordinance Amending Chapter 154 of the Code of Ordinances, Richmond, Indiana regarding the Aquifer Protection District (Section 154.39.00) would be held on second reading and public hearing at the September 6, 2005 Council meeting. MISCELLANEOUS BUSINESS Scott Zimmerman, City Planner, presented an update on the development of the Comprehensive Plan for the City of Richmond. Approximately 300 surveys were submitted from community members during this process. A drawing was held, and out of the 300 entries, the survey from Ron Oberle was picked. Mr. Oberle was presented with a $100 check. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 55, 56 and 57 -2005 on first reading by title only with a second by Councilor Lundy. The motion carried with a unanimous voice vote. ORDINANCE NO. 55 -2005 — A SPEIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM M -2 TO A SPECIAL USE DISTRICT The Clerk read Ordinance No. 55 -2005 on first reading by title only. Common Council Minutes August 15, 2005 Page 2 This Ordinance is a petition to rezone to a Special Use District in an M -2 zoning district to allow the owner to develop a hotel and office building on the site located at 425 Commerce Road. Ordinance No. 55 -2005 was referred to the Plan Commission for public hearing at its meeting on August 25, 2005. ORDINANCE NO. 56 -2005 - A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION The Clerk read Ordinance No. 56 -2005 on first reading by title only. Ordinance No. 56 -2005 would authorize the City of Richmond to accept a donation in the amount of one thousand dollars and no cents ($1,000.00) for the purchase of new carpeting in the office of the Richmond Municipal Airport. Councilor Welch moved to advance Ordinance No. 56 -2005 to second reading, suspend the rules and read by title only. There was a second by Councilor Parker. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 56 -2005 on second reading by title only Council Vice President Pappin declared Ordinance No. 56 -2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 56 -2005 with a second by Councilor Welch. The motion carried with a unanimous voice vote. Councilor Lundy moved to advance Ordinance No. 56 -2005 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 56 -2005 on third reading by title only. Ordinance No. 56 -2005 was adopted with an 8 -0 roll call vote. ORDINANCE NO. 57 -2005 — AN ORDINANCE AUTHORIZING THE SUBMITTAL OF THE CFF APPLICATION TO THE INDIANA OFFICE OF RURAL AFFAIRS AND ADDRESSING RELATED MATTERS The Clerk read Ordinance No. 57 -2005 on first reading by title only. Ordinance No. 57 -2005 was in response to a request of Achieva Resources, Inc. Achieva has asked the Mayor to prepare and submit an application for grant funding up to Five Hundred Twenty -Five Thousand Dollars and No Cents ($525,000.00) to address the construction of a building to house Adult Day Care Activity /Medically Fragile and Geriatric Programs, and to execute and administer a resultant grant including requisite general administration and project management, contracts and agreements pursuant to regulations of the Indiana Office of Rural Affairs and the United States Department of Housing and Urban Development. Matching funds in the amount of Ninety -Six Thousand Eight Hundred Ninety Five Thousand Dollars and No Cents ($96,895.00) would be provided by Achieva. Councilor Lundy moved to advance Ordinance No. 57 -2005 to second reading, suspend the rules and read by title only. There was a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 57 -2005 on second reading by title only. Council Vice President Pappin declared Ordinance No. 57 -2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Common Council Minutes August 15, 2005 Page 3 Ordinance No. 57 -2005 with a second by Councilor Welch. The motion carried with a unanimous voice vote. Councilor Welch moved to advance Ordinance No. 57 -2005 to third and final reading and suspend the rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 57 -2005 on third reading by title only. Ordinance No. 57 -2005 was adopted with an 8 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 39 -2005 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -3, ONE TO EIGHT FAMILY RESIDENCE, TO A SPECIAL USE DISTRICT The Clerk read Ordinance No. 39 -2005 on second reading by title only. This is a petition requesting a rezoning of two lots at 2501 and 2505 East Main Street from R -3 One to Eight Family Residence District to a Special Use District. The rezoning allows the owner to build a medical office. The Richmond Advisory Planning Commission conducted a public hearing on June 23, 2005. Research by the Planning staff has confirmed this is an appropriate use of the combined lots. The new development will not aggravate the existing drainage or sewage situation as verified by the City Engineer. The rezoning is a continuation of surrounding zoning and does not conflict with the City's Comprehensive Plan. The Richmond Advisory Planning Commission conducted a public hearing and voted 8 to 1 to recommend approval of the ordinance. Council Vice President Pappin declared Ordinance No. 39 -2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 39 -2005 with a second by Councilor Welch. The motion carried with a unanimous voice vote. Councilor Welch moved to advance Ordinance No. 39 -2005 to third and final reading and suspend the rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice vote.
