MONDAY, SEPTEMBER 19, 2005
The Common Council of the City of Richmond, Indiana met in regular session Monday, September 19,
2005, in the Council Chambers in said City. President Bruce Wissel presided and the following business
was conducted:

ROLL CALL
Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry
Parker, Al Glover, Gil Klose and Diana Pappin.
APPROVAL OF MINUTES
Councilor Welch moved to approve the minutes of the meeting of Tuesday, September 6, 2005, with a
second by Councilor Sharp. The motion carried with a unanimous voice vote.
COMMUNICATION FROM THE MAYOR
• Mayor Hutton distributed the Fall Clean -Up Schedule which will be on weekends only. Tubs will
not be used.
• The City has received a $300,000 Housing Grant. Twenty homes (which have already been
chosen) will benefit from this grant.
• For -Sale signs for the Carpenter building will be up next week.
• Ms. Hutton gave an update on the curb, sidewalk and paving projects.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the August 25 and September 1 meetings were accepted as presented.
MISCELLANEOUS BUSINESS
The following government students from Richmond High School were in attendance: Shay Haynes, Lara
Lane, Kyle Woodcock, Emmanuel Bean, Sila Sams, Laura Jackson, Rachel Dickson, Danielle McGuire,
Dan Whitehead, Richard Goss and Josh DeLucio.
ORDINANCES ON FIRST READING
Councilor Elstro moved to suspend the rules and read Ordinance Nos. 52, 59, 64, 65, 66, 67 and 68 -2005
on first reading by title only with a second by Councilor Lundy. The motion carried with a unanimous
voice vote.
ORDINANCE NO. 52 -2005 — AN APPROPRIATION ORDINANCE FIXING THE ANNUAL
COMPENSATION OF ALL ELECTED CITY OFFCERS FOR 2006
The Clerk read Ordinance No. 52 -2005 on first reading by title only.
Due to advertising requirements, this cannot be passed until October 17.
Ordinance No. 52 -2005 will be on second reading and public hearing October 17, 2005.

ORDINANCE NO. 59 — 2005 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1
The Clerk read Ordinance No. 59 -2005 on first reading by title only.
This ordinance is a ten year tax abatement request from Gold Star Coatings for equipment valued at $1.5
million.
Ordinance No. 59 -2005 was referred to the Tax Abatement Committee.
ORDINANCE NO. 64 -2005 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE ASSISTANCE TO FIREFIGHTERS
GRANT PROGRAM
The Clerk read Ordinance No. 64 -2005 on first reading by title only
This ordinance would authorize the City of Richmond Fire Department to submit a grant application to the
Assistance to Firefighters Grant Program and to accept said grant funding in an amount up to $24,500.
No local match is required. This grant funding would be used to procure: (1) a robotic teaching
assistance (talking dog in a fire truck) and related teaching handouts; (2) infant and child car seats for
distribution at car seat checkpoints; and (3) smoke alarms and batteries for distribution to senior citizens
Councilor Lundy moved to advance Ordinance No. 64 -2005 to second reading, suspend the rules and
read by title only. There was a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

Council President Wissel declared Ordinance No. 64 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 64 -2005 with a second by Councilor Sharp. The motion carried with a unanimous voice vote.
Councilor Lundy moved to advance Ordinance No. 64 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

Ordinance No. 64 -2005 was adopted with an 9 -0 roll call vote.
ORDINANCE NO. 65 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO
RECEIVE A DONATION
The Clerk read Ordinance No. 65 -2005 on first reading by title only.
This ordinance would authorize the City of Richmond to accept the donation of funds from
individuals and non - profits in an amount not to exceed Thirty Thousand Dollars and No Cents
($30,000.00) that shall be used to match an Economic Development Income Tax (EDIT) grant
from the Economic Development Corporation Board of Directors to help fund a market analysis
specific to retail operations in Richmond and Wayne County, Indiana.
Councilor Lundy moved to advance Ordinance No. 65 -2005 to second reading, suspend the rules and
read by title only. There was a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

rules and read by title only with a second by Councilor Lundy. The motion carried with a unanimous voice
vote.

ORDINANCE NO. 66 -2005 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE ECONOMIC DEVELOPMENT
CORPORATION OF WAYNE COUNTY, CONSOLIDATED
The Clerk read Ordinance No. 66 -2005 on first reading by title only.
This ordinance would authorize the City of Richmond to submit a grant application to the Economic
Development Corporation of Wayne County, Consolidated and to accept said grant funding in an amount
up to Thirty Thousand Dollars and No Cents ($30,000.00). This grant shall be used, in conjunction with
individual and non - profit donations, to fund a market analysis specific to retail operations in Richmond,
Wayne County, Indiana.
Councilor Lundy moved to advance Ordinance No. 66 -2005 to second reading, suspend the rules and
read by title only. There was a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

vote.

ORDINANCE NO. 67 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.

The Clerk read Ordinance No. 67 -2005 on first reading by title only.
This ordinance is a ten year tax abatement request by FDR Development Corp. for real estate valued at
$3.6 million.
Ordinance No. 67 -2005 was referred to the Tax Abatement Committee.
ORDINANCE NO. 68 -2005 — A GENERAL ORDINANCE ADDING A NEW CHAPTER 59.1 TO THE CITY
OF RICHMOND CODE

This ordinance would add Chapter 59.1 to Title V, Public Works of the Richmond Code which contains
chapters concerning waterworks, electric utility, sewer usage, utility construction in flood hazard areas,
stormwater illicit discharge, erosion and sediment control, landfill and stormwater. Ordinance No. 68-
2005 would add a chapter concerning control of post construction stormwater runoff.
There will be a meeting of the Committee of the Whole on Monday, October 10, 2005, 7 PM in the
Council Chambers.
ORDINANCES ON SECOND READING
ORDINANCE NO. 48 -2005 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2006
BUDGET
The Clerk read Ordinance No. 48 -2005 on second reading by title only.
Proof of Publication of the proposed 2006 budget on September 6 and 16 was presented by the
Controller's Office.
Ordinance No. 48 -2005 will be on public hearing September 29
ORDINANCE NO. 49 -2005 — AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT FOR
SERVICES FROM THE RICHMOND SANITARY DISTRICT, RICHMOND POWER & LIGHT, MOTOR
VEHICLE HIGHWAY AND PARKS AND RECREATION DEPARTMENT FUNDS TO THE GENERAL
FUND IN 2006
The Clerk read Ordinance No. 49 -2005 on second reading by title only.
There are services for executive departments are paid from the Richmond General Fund and it is
necessary to transfer monies to such fund from the Richmond Sanitary District, Richmond Power & Light,
Motor Vehicle Highway and Parks and Recreation Department funds pursuant to the allocations herein.
Council President Wissel declared Ordinance No. 49 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 49 -2005 with a second by Councilor Pappin. The motion carried with a unanimous voice vote.
Councilor Lundy moved to advance Ordinance No. 49 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

AMENDED ORDINANCE NO. 51 -2005 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE
2006 SALARY ORDINANCE
The Clerk read Amended Ordinance No. 51 -2005 on second reading by title only.
Amended Ordinance No. 51 -2005 fixes the compensation of each appointive officer, deputy and other
employees of the city departments, except police officers and firefighters, for the Year 2006.
Amended Ordinance No. 51 -2005 will be heard on public hearing at the October 3, 2005 meeting of
Common Council.
ORDINANCE NO. 60 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.

This ordinance is a request by Innatech, LLC for a ten -year tax abatement. This abatement is for
equipment valued at $30,000,000.
Council President Wissel declared Ordinance No. 60 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 60 -2005 with a second by Councilor Lundy. The motion carried with a unanimous voice vote.
Councilor Welch moved to advance Ordinance No. 60 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice
vote.

ORDINANCE NO. 61 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1 (Innatech - Real Estate)
The Clerk read Ordinance No. 61 -2005 on second reading by title only.
This ordinance is a request by Innatech, LLC for a ten -year tax abatement. This abatement is for real
estate valued at $6,500,000.
Council President Wissel declared Ordinance No. 61 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 61 -2005 with a second by Councilor Parker. The motion carried with a unanimous voice vote.
Councilor Lundy moved to advance Ordinance No. 61 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.
