HomeMy Public PortalAboutORD 69/01f!� !� ) /I a ORDINANCE NO. 0-1 AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, RELATING TO THE REGISTRATION OF FELONS; REQUIRING FELONS WHO COME INTO THE TOWN TO REGISTER WITH THE CHIEF OF POLICE; MAKING VIOLATION OF ORDINANCE UNLAWFUL AND PRESCRIBING PUNISHMENT FOR VIOLATION; AND OTHER MATTERS RELATING THERETO. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA: Section 1. Definitions. For the purposes of this ordinance the term "Town" shall mean the Town of Gulf Stream, Florida. Section 2. Registration, fingerprinting and photo- graphing of persons convicted of felonies -- Required. Every person who, within the period of ten years immediately prior to his arrival in the Town of Gulf Stream, Florida, has been convicted in any federal court of any crime which is deemed, designated or specified to be a felony, accord- ing to the United States Criminal Code, or who, within the period of ten years immediately prior to his arrival in the Town, has been convicted of any crime in a court of any state of the United States, which crime is deemed, designated or specified to be a felony in the state in which such conviction occurred, or who, at any time within the period of ten years immediately prior to his arrival in the Town has been, follow- ing conviction for a felony, held in custody in any federal prison or in prison in any state of the United States, who comes into the Town from any point outside of the Town whether in transit through the Town or otherwise, shall report to the chief of police of the Town within seventy -two hours after his arrival within the Town and shall furnish to the chief of police, in a written statement, signed by such person, the true name of such person, and each other names or alias by which such person is or has been known, a full and complete description of himself, and the names of the crimes of which he shall have been convicted, together with the name of the place where each such crime was committed, the name under which he was convicted, and the date of the conviction therefor, the name if any, and the location of -1- each prison, reformatory or other penal institution in which he shall have been confined as punishment therefor, together with the location or address of his residence, stopping place or living quarters in this Town and each one thereof, if more than one, or the address or location of his intended residence, stopping place or living quarters in this Town and each one thereof, with a description of the character of each such place, whether a hotel, apartment house, dwelling house or otherwise, giving the street number thereof, if any, or any description of the address or location thereof as will so identify the same as to make it possible of location, and the length of time for which he expects or intends to reside within the territorial boundaries of the Town. At any time of furnishing the informa- tion required herein, such person shall be photographed and fingerprinted by the chief of police, and such photograph and fingerprints shall be made a part of the permanent records of the police department of the Town. Section 3. Information as to change of address. In the event that any person required to register under this ordinance shall change his place of residence, stopping place or living quarters to any new or different place within the Town other than the place last reported to the chief of police in such report provided for in section 2 or 3 hereof, such person shall, within seventy -two hours after removing himself from the place of abode first given, notify the chief of police, in a written and signed statement of such change of address, and shall furnish in such written statement to the chief of police his new address. Section 4. Not required of pardoned or paroled persons. Nothing in the two preceding sections shall be deemed or construed to apply to any person who has or shall have re- ceived a pardon for each such crime whereof he shall have been convicted, or to any person who is or shall be on parole or pro- bation under the laws of any state wherein he was convicted or incarcerated or both, for any of the crimes hereinabove enumer- ated. -2- book. Section 5. Access to and examination of registration No persons, except members of the police department and town commissioners of the Town shall have access to or be permitted to examine the registration book or affidavits herein- above mentioned. Section 6. Any person violating the provisions of this ordinance upon conviction thereof shall be fined in an amount not to exceed $100.00 for each offense, or imprisoned in the Town jail or worlmd at hard labor on the streets or other public works of the Town for a term of not more than one month, or punished by both such fine and imprisonment. Each day of violation shall constitute a separate offense. Section 7. This ordinance shall become effective immediately upon passage and proper posting according to the charter of the Town.
