APPROVING PROFESSIONAL SERVICES CONTRACT -
JAMES F. CLARKIN, III, ESQ.
WHEREAS, the Borough of Carteret is in need of specialized legal services with
regard to the defense of the matter of Fourth MPPL Realty and Construction Co.,
a Partnership vs. Zoning Board of Adjustment of the Borough of Carteret,
Superior Court of New Jersey, Law Division - Middlesex County, Docket No.
MID-L-5856-02; and
WItEREAS, James F. Clarkin, III, Esq. presently serves as the attorney for the
Zoning Board of Adjustment and possess the requisite experience and expertise to
provide said Specialized Legal Services; and
WHEREAS, the Borough Attorney has recommended the appointment of James
F. Clarkin, III to defend the Carteret Zoning Board of Adjustment in the above
referenced matter at an hourly rate of $125.00 per hour not to exceed a maximum
cost of $2,500.00; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be
available for said purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret that the James F. Clarkin, III, Esq. is hereby appointed
Special Counsel to defend the Carteret Zoning Board of Adjustment in the above
described matter at an hourly rate of $125.00 for a maximum cost not to exceed
$2,500.00.
BE IT FURTHER RESOLVED, that this appointment is made as a professional
service as defined by N.J.S.A. 40A: 11-2(6).
