MONDAY, OCTOBER 3, 2005
The Common Council of the City of Richmond, Indiana met in regular session Monday, October 3, 2005,
in the Council Chambers in said City. President Bruce Wissel presided and the following business was
conducted:

ROLL CALL
Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry
Parker, Al Glover, Gil Klose and Diana Pappin.
APPROVAL OF MINUTES
Councilor Parker moved to approve the minutes of the meeting of Monday, September 19, 2005, with a
second by Councilor Welch. The motion carried with a unanimous voice vote.
COMMUNICATION FROM THE MAYOR
Mayor Hutton reported nothing has been resolved relative to the Police and Fire Departments' 2006
salaries.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
The minutes of the September 8 and 15, 2005 meetings were accepted as presented.
MISCELLANEOUS BUSINESS
• The following Richmond High School government students were in attendance: Jon Buckley,
Craig Price, Jerail Poole, Krystal Hunter, Jenny Erbse, Amber Cooper, Brandon Krofta, Jake
Carr, Melaney Wierspinski, Charles Patterson and Alicia Sherer.
• Representing the Richmond Celebrates committee, the official Town Crier and the Bicentennial
Queen's Court — Senior Princess Carla Blum and Queen Amy Lies — invited the community to
participate in the Bicentennial events through August 20, 2006. In particular, the Queen's Ball
which will be held August 8.
• There will be a meeting of the Committee of the Whole on Monday, October 10, 2005. This
meeting is to discuss Ordinance No. 68 -2005.
ORDINANCES ON FIRST READING
Councilor Elstro moved to suspend the rules and read Ordinance No. 58 -2005 on first reading by title only
with a second by Councilor Lundy. The motion carried with a unanimous voice vote.
ORDINANCE NO. 58 -2005 — A SPECIAL ORDINANCE VACATING A PUBLIC WAY
The Clerk read Ordinance No. 58 -2005 on reading by title only.
Ordinance No. 58 -2005 is a request by J. Scott Porter to vacate a portion of a public right -of -way
commonly known as a twenty foot wide alley spanning North and South between North B Street and
North C Street. This vacation would be subject to the preservation of easements for existing utilities.
Ordinance No. 58 -2005 was referred to the Plan Commission for public hearing on October 27, 2005.

ORDINANCES ON SECOND READING
ORDINANCE NO. 52 -2005 — AN APPROPRIATION ORDINANCE FIXING THE ANNUAL
COMPENSATION OF ALL ELECTED CITY OFFICERS FOR 2006
The Clerk read Ordinance No. 52 -2005 on second reading by title only.
Due to advertising requirements, this ordinance cannot be passed until October 17.
ORDINANCE NO. 59 -2005 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1 (Gold Star)
The Clerk read Ordinance No. 59 -2005 on second reading by title only.
This ordinance is a ten year tax abatement request from Gold Star Coatings for equipment valued at $1.5
million.
Council President Wissel declared Ordinance No. 59 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 59 -2005 with a second by Councilor Welch. The motion carried with a unanimous voice vote.
Councilor Lundy moved to advance Ordinance No. 59 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

Ordinance No. 59 -2005 was adopted with a 9 -0 roll call vote
ORDINANCE NO. 63 -2005 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A
CERTAIN PARCEL FROM R -2 TO C -1.
The Clerk read Ordinance No. 63 -2005 on second reading by title only.
Ordinance No. 63 -2005 is a request to change the zoning designation at 1810 South "L" Street from an R-
2 One Family Residence District to a C -1 Limited Commercial District in order to allow the owner to
operate a beauty salon and office from this location.
Council President Wissel declared Ordinance No. 63 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 63 -2005 with a second by Councilor Lundy. The motion carried with a unanimous voice vote.
Councilor Lundy moved to advance Ordinance No. 63 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

Ordinance No. 63 -2005 was adopted with a 9 -0 roll call vote
ORDINANCE NO. 67 -2005 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1.
The Clerk read Ordinance No. 67 -2005 on second reading by title only.
This ordinance is a ten year tax abatement request by FRR Development Corp. for real estate valued at
$3.6 million.

Councilor Welch moved to amend the ordinance to read FRR in lieu of FDR (owners). There was a
second by Councilor Parker. The motion carried with a unanimous voice vote.
As a representative of the Tax Abatement Committee, Councilor Pappin reported the committee did not
reach a consensus. Historically, Richmond has not allowed abatements to hotels /motels. Ms. Pappin
moved to amend the request to five years. The motion died for lack of a second.
Council President Wissel declared Ordinance No. 67 -2005 on second reading and public hearing.
Speaking in favor of this ordinance were George Sowers, Esq., Jeff Hanna of First Richmond Realty and
Mary Walker of the Richmond Wayne County Tourism Bureau. There being no further comments for or
against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 67 -2005 with a second
by Councilor Parker. The motion carried with a unanimous voice vote.
Councilor Welch moved to advance Ordinance No. 67 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Parker. The motion carried with a unanimous
voice vote.

Ordinance No. 67 -2005 was defeated with a unanimous roll call vote
