HomeMy Public PortalAbout10-17-2005PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, OCTOBER 17, 2005 The Common Council of the City of Richmond, Indiana met in regular session Monday, October 17, 2005, in the Council Chambers in said City. President Bruce Wissel presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR SHARP ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Welch moved to approve the minutes of the regular meeting of Monday, October 3, and the Memorandum of a Meeting of the Special Meeting of Thursday, September 29 and the meeting of the Committee of the Whole on Monday, October 10 with a second by Councilor Parker. The motion carried with a unanimous voice vote. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 3 -2005 — A RESOLUTION AUTHORIZING THE SUBMITTAL OF THE COMMUNITY DEVELOPMENT BLOCK GRANT ( "CDBG ") APPLICATION TO THE INDIANA HOUSING AND COMMUNITY DEVELOPMENT AUTHORITY; RECEIPT OF CDBG FUNDS; AND ADDRESSING RELATED MATTERS Resolution No. 3 -2005 would authorize the Mayor to apply for and receive an award in the amount of up to $300,000 in Community Development Block Grant funding to address conditions relating to the City of Richmond and to executive and administer the grant. Councilor Elstro moved to adopt Resolution No. 3 -2005 with a second by Councilor Lundy. The motion carried with a unanimous voice vote. RESOLUTION NO. 4 -2005 — A RESOLUTION FOR THE ADOPTION OF THE WAYNE COUNTY, INDIANA COUNTYWIDE ALL HAZARDS MITIGATION PLAN AND THE ESTABLISHMENT OF A WAYNE COUNTY COUNTYWIDE ALL HAZARDS MITIGATION PLAN CORE GROUP Resolution No. 4 -2005 would adopt the Wayne County all Hazards Mitigation Plan. Councilor Welch moved to adopt Resolution No. 4 -2005 with a second by Councilor Parker. The motion carried with a unanimous voice vote. COMMUNICATION FROM THE MAYOR • The funds for the exterior work at the City Building is from Redevelopment and the labor is being furnished by the Sanitation Department with design by the City Engineer. • The leaf season began on October 17 and will continue for the next six weeks. There is no set schedule • The road to the Veterans Monument in the Gorge area is ready for use. • The Police are not going to open their contract to renegotiate salaries. The Fire Department is still discussing the possibility and AFSCME's negotiations are contingent on the other union contracts. MISCELLANEOUS BUSINESS Richmond High School government students in attendance were Gabe White, Stephanie Belbin, Kim Stephens, Ron Cunnley- Effinger, Alex Miles, David Rickey, Jonathan Brookbank, Mary Edinger, Robin Verhasselt, Matt Boyer, Paul Gibbs, Juliann Cairns, Del Betz, Anne Monger, Tiffany Heron, Stephen Charles, Andrew Hoffman, Kyle Shipley, Emily Ehlers, Alyssa Horrigan, Jackie Stone, Tiggany Guridy, Jennifer Rios, David Band, Mitchell Fields, Justin Morris, Aaron Koger, Brandi Cawood and Jorden Lairson. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos.69, 70 71 & 73 -2005 on first reading by title only with a second by Councilor Parker. The motion carried with a unanimous voice vote. ORDINANCE NO. 69 -2005 — A SPECIAL ORDINANCE AMENDING THE ZONNG MAP FOR A CERTAIN PARCEL AS R -1 (ONE FAMILY RESIDENCE DISTRICT) TO PUD (PLANNED UNIT DEVELOPMENT DISTRICT — R -1) The Clerk read Ordinance No. 69 -2005 on first reading by title only. This ordinance is a petition requesting a Residential Planned Unit Development in an R -1, One Family Residence District, for use as an Assisted Living Center and Nursing Home Complex located on the South side of Hodgin Road, opposite South 37th Street. Ordinance No. 69 -2005 was referred to the Plan Commission for public hearing at its meeting on October 27, 2005. ORDINANCE NO. 70 -2005 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE UNITED STATES CORPORATION FOR NATIONAL SERVICE The Clerk read Ordinance No. 70 -2005 on first reading by title only. This ordinance would authorize the City of Richmond Parks and Recreation Department to submit a grant application to the United States Corporation for National Service and to accept the funding in an amount up to $38,547 to be used to fund programs and services provided by the Retired Senior Volunteer Program. In order to clarify the match required in this grant, Councilor Welch moved to amend Ordinance No. 70- 2005 as follows: WHEREAS, a total local match of Thirty Percent (3096) or Eleven Thousand Five Hundred Sixty -Five Dollars and No Cents ($11,565.00) is required, of which Three Thousand Dollars and No Cents ($3,000) shall be from the 2006 Budget of the Richmond Parks and Recreation Department. and 2. The City of Richmond Parks & Recreation Department is authorized to accept said grant funding in an amount up to Thirty -eight Thousand Five Hundred Forty -Seven Dollars and No Cents ($38,547. 00), contingent upon a total local match of 30% or Eleven Thousand Five Hundred Sixty -Five Dollars and No Cents ($11,565), of which Three Thousand Dollars and No Cents ($3, 000) shall be from the 2006 Budget of the Richmond Parks and Recreation Department. Councilor Parker seconded the motion. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Amended Ordinance No. 70 -2005 with a second by Councilor Pappin. The motion carried with a unanimous voice vote. Councilor Lundy moved to advance Amended Ordinance No. 70 -2005 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Amended Ordinance No. 70 -2005 on third reading by title only. Amended Ordinance No. 70 -2005 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 71 -2005 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE UNITED WAY OF THE WHITEWATER VALLEY The Clerk read Ordinance No. 71 -2005 on first reading by title only This ordinance would authorize the City of Richmond Parks and Recreation Department to submit a grant application to the United Way of the Whitewater Valley and to accept grant funding in an amount up to $8,700 to be used to fund programs and services provided by the Widowed Persons Service. Councilor Lundy moved to advance Ordinance No. 71 -2005 to second reading, suspend the rules and read by title only. There was a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 71 -2005 on second reading by title only. Council President Wissel declared Ordinance No. 71 -2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 71 -2005 with a second by Councilor Pappin. The motion carried with a unanimous voice vote. Councilor Welch moved to advance Ordinance No. 71 -2005 to third and final reading and suspend the rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 71 -2005 on third reading by title only. Ordinance No. 71 -2005 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 72 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND THROUGH ITS HISTORIC PRESERVATION COMMISSION TO REQUEST, ACCEPT AND ACKNOWLEDGE DONATIONS The Clerk read Ordinance No. 72 -2005 in its entirety. WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. Common Council Minutes October 17, 2005 Page 4 NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be requested, accepted and gratefully acknowledged by the citizens of Richmond. The request for donation of funds to the Richmond Historic Preservation Commission from owners of historic properties. The donations will be specifically used to purchase plaques recognizing their property as historic in nature. This ordinance is a request of the Historic Preservation Commission to request, accept and acknowledge donations to be specifically used to purchase plaques recognizing properties as historic in nature. Councilor Parker moved to amend Ordinance No. 72 -2005 to read: The donations will be specifically used to purchase plaques recognizing properties as historic in nature. The motion was seconded by Councilor Welch. The motion carried with a unanimous voice vote. ORDINANCE NO. 73 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Belden) The Clerk read Ordinance No. 73 -2005 on first reading by title only. Ordinance No. 73 -2005 is a request for a 10 -year tax abatement by Belden CDT Electronics Division for equipment valued at $3,000,000. Ordinance No. 73 -2005 was referred to the Tax Abatement Committee. ORDINANCES ON SECOND READING ORDINANCE NO. 52 -2005 — AN APPROPRIATION ORDINANCE FIXING THE ANNUAL COMPENSATION OF ALL ELECTED CITY OFFICERS FOR 2006 The Clerk read Ordinance No. 52 -2005 on second reading by title only. This ordinance establishes the salaries for all elected City Officers for the Year 2006. Council President Wissel declared Ordinance No. 52 -2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 52 -2005 with a second by Councilor Lundy. The motion carried with a unanimous voice vote. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 52 -2005 on third reading by title only. Ordinance No. 52 -2005 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 68 -2005 — A GENERAL ORDINANCE ADDING A NEW CHAPTER 59.1 TO THE CITY OF RICHMOND CODE The Clerk read Ordinance No. 68 -2005 on second reading by title only This ordinance would add Chapter 59.1 to Title V, Public Works of the Richmond Code which contains chapters concerning waterworks, electric utility, sewer usage, utility construction in flood hazard areas, stormwater illicit discharge, erosion and sediment control, landfill and stormwater. Ordinance No. 68- 2005 would add a chapter concerning control of post construction stormwater runoff. Councilor Sharp moved to amend Ordinance No. 68 -2005, pg. 13, section 59.1.14 (a) (4) to read: If, within five days after the expiration of the 14 -day period, in subsection (3) above, a permit holder does not comply with the erosion and sediment control plan or permit conditions, the City shall revoke the permit. Councilor Pappin seconded the motion. The motion carried with a unanimous voice vote. Council President Wissel declared Amended Ordinance No. 68 -2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Amended Ordinance No. 68 -2005 with a second by Councilor Parker. The motion carried with a unanimous voice vote.
