HomeMy Public PortalAbout029-2013 - Grant -Community Development Block GrantORDINANCE NO.29-2013 AN APPROPRIATION ORDINANCE OF THE CITY OF RICHMOND, INDIANA AS APPLICANT, AUTHORIZING THE SUBMITTAL OF THE COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") APPLICATION TO THE INDIANA HOUSING AND COMMUNITY DEVELOPMENT AUTHORITY, RECEIPT OF CDBG FUNDS; AND ADDRESSING RELATED MATTERS WHEREAS, In accordance with Indiana Code (IC) 36-1-4-10, a municipality may execute any documents necessary to receive money from the state or federal government or any other source, and said documents are prepared and executed by the City executive administration, provided that the Common Council of the City of Richmond as the legislative body of the City approves an ordinance for the appropriation of any monies received in accordance with IC 364-6-18; and WHEREAS, The Housing and Community Development Act of 1974, as amended, allows the Indiana Housing and Community Development Authority ("IHCDA") to award grants to local units of government to meet the affordable housing and community development needs of low and moderate income persons; and WHEREAS, The IHCDA has Community Development Block Grant ("CDBG") funding available for the Owner -Occupied Rehabilitation ("OOR") program in the amount of up to Three hundred Seventy -Two Thousand Dollars and Zero Cents ($372,000.00); and WHEREAS, The City of Richmond as Applicant recognizes the need to stimulate growth and to maintain affordable housing to benefit its citizens; and WHEREAS, The City of Richmond as Applicant has conducted or will conduct a public hearing prior to the submission of an application to IHCDA, to assess the housing, public facilities, and economic needs of low and moderate income residents; and WHEREAS, It is in the best interest of the City of Richmond that the Common Council support and encourage the application by the City of Richmond, Indiana of the Community Development Block Grant ("CDBG"); and WHEREAS, Any local match that may be required will be supplied by a banked match from the IHCDA. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: 1. The City of Richmond, by the Mayor and the Richmond Department of Metropolitan Development, has submitted or will submit, as authorized by IC 36-1-4-10, an application to receive the Community Development Block Grant ("CDBG") award from the Indiana Housing and Community Development Authority ("IHCDA"). 2. The City of Richmond is authorized to accept said grant award funding in an amount up to Three hundred Seventy -Two Thousand Dollars and Zero Cents ($372,000.00) from the IHCDA. NOW THEREFORE, be it also ordained by the Common Council of the City of Richmond, Indiana, that the Mayor of the City of Richmond as Chief Elected Official is authorized to apply for and receive an award of up to the sum of Three hundred Seventy -Two Thousand Dollars and Zero Cents ($372,000.00) in Community Development Block Grant ("CDBG") funding to address conditions relating to the City of Richmond in Richmond, Indiana, and to execute and administer the resulting grant including requisite general administration and management, contracts, and agreements according to the terms and conditions as are more particularly set forth in IHCDA's and the U.S. Department of Housing and Urban Development's ("HUD") published policies, procedures and regulations, as amended from time to time, and as are set forth in the application. NOW THEREFORE, be it also ordained by the Common Council of the City of Richmond, Indiana, that funds in the amount of ten percent (1011/o) of the CDBG award shall be and hereby are set aside for this activity. Such commitment fulfills the minimum leverage requirement for the CDBG request and is to be contingent upon receipt of CDBG funding from the IHCDA. NOW, THEREFORE, be it also ordained by the Common Council of the City of Richmond, Indiana, that the following individuals be, and each hereby is, authorized, empowered, and directed to execute, acknowledge, and deliver in the Applicant's name and on its behalf any and all applications, grant agreements, documents, covenants binding real estate, instruments or writings, as are necessary and/or as appropriate to consummate the application and receipt of CDB Funds: Sharon Palmer, Community Development Specialist; and Joyce McCarty, President, Star Development.
