MONDAY, NOVEMBER 21, 2005
The Common Council of the City of Richmond, Indiana met in regular session Monday, November 21,
2005 in the Council Chambers in said City. President Bruce Wissel presided and the following business
was conducted:

Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry
Parker, Al Glover, Gil Klose and Diana Pappin.
APPROVAL OF MINUTES
Councilor Welch moved to approve the minutes of the meeting of Monday, November 7, 2005 with a
second by Councilor Parker. The motion carried with a unanimous voice vote.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
RESOLUTION NO. 6 -2005 — RESOLUTION APPROVING THE SALE OF REAL ESTATE KNOWN AS
THE CARPENTER PROPERTY
This Resolution would authorize the sale of the Carpenter property to Groundlevel Properties, LLC for the
amount of $1,500,010. The Redevelopment Commission recommended the sale. Councilor Parker
moved to approve the sale of the real estate known as the Carpenter Property for the amount of One
Million Five Hundred Thousand Ten Dollars ($1,500,010.00) with a second by Councilor Welch. The
motion carried with a unanimous voice vote.
COMMUNICATION FROM THE MAYOR
• Many thanks to Jimmy Johnson (JJ) who is on the maintenance staff at the Municipal Building.
JJ has spent many, many hours (on and off duty) showing the Carpenter site to potential bidders
and on maintenance of the property.
• The City Engineer, Terry Dull, will be leaving Richmond for another position in Columbus, Ohio on
December 2.
• The Firefighters have voted to accept a 1.5% increase in pay for the year 2006 in lieu of 3 %.
• The improvements around the Municipal Building will continue in the Spring. The Sanitary
Department has done an outstanding job.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the October 27 and November 3, 2005 meetings were accepted as presented.
MISCELLANEOUS BUSINESS
Karl Sharp attended an IACT conference and will distribute information regarding "Solutions to
Solving Indiana's Financial Needs" to each Councilor.
• HUMAN RIGHTS COMMISSION — Etta Lundy moved to appoint Barbara Armstead to the
Richmond Civil Rights Board of Directors with a second by Councilor Glover. The motion carried
with a unanimous voice vote.

• WAYNE COUNTY TOURISM — Councilor Welch moved to appoint Linda Von Pein of the Travel
Industry and Linda Porter of the Lodging Industry to the Richmond -Wayne County Tourism
Bureau Board of Directors with a second by Councilor Parker. The motion carried with a
unanimous voice vote.
ORDINANCES ON FIRST READING:
Councilor Elstro moved to suspend the rules and read Ordinance Nos. 81 and 82 -2005 on first reading by
title only with a second by Councilor Lundy. The motion carried with a unanimous voice vote.
ORDINANCE NO. 81 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1 (Ahaus Tool)
The Clerk read Ordinance No. 81 -2005 on first reading by title only.
This Ordinance is a request for a five -year tax abatement for equipment by Ahaus Tool and Engineering,
Inc. for equipment valued at $375,000.
Ordinance No. 81 -2005 was referred to the Tax Abatement Committee.
ORDINANCE NO. 82 -2005 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE UNITED STATES
ENVIRONMENTAL PROTECTION AGENCY BROWNFIELDS CLEANUP GRANT PROGRAM
The Clerk read Ordinance No. 82 -2005 on first reading by title only.
This Ordinance would authorize the City of Richmond to submit a grant application to the United States
Environmental Protection Agency Brownfields Cleanup Grant Program to assist with the costs associated
with expenses to perform environmental cleanup of the Indiana Gas Building site. This Ordinance would
also authorize the City to accept grant funding in an amount up to Two Hundred Thousand Dollars
($200,000). There is a 5% match for this grant.
Councilor Lundy moved to advance Ordinance No. 82 -2005 to second reading, suspend the rules and
read by title only. There was a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

Council President Wissel declared Ordinance No. 82 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 82 -2005 with a second by Councilor Welch. The motion carried with a unanimous voice vote.
Councilor Welch moved to advance Ordinance No. 82 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice
vote.

Ordinance No. 82 -2005 was adopted with a 9 -0 roll call vote.
ORDINANCE NO. 83 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO
RECEIVE A DONATION
The Clerk read Ordinance No. 83 -2005 on first reading in its entirety.
WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a
specific purpose; and

WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such
property for the intended purpose.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the following shall be accepted and gratefully acknowledged by the citizens of Richmond:
The donation of funds from the Indiana Finance Authority in an amount not to
exceed Forty Thousand Dollars and No Cents ($40, 000.00) that shall be used as
the local match for a grant from the USEPA Brownfields Cleanup Grant Program
to assist with environmental cleanup activities at the Gas Building located on
East Main Street, Richmond, Wayne County, Indiana.
Councilor Welch moved to advance Ordinance No. 83 -2005 to second reading, suspend the rules and
read by title only. There was a second by Councilor Sharp. The motion carried with a unanimous voice
vote.

ORDINANCES ON SECOND READING
ORDINANCE NO. 58 -2005 — A SPECIAL ORDINANCE VACATING A PUBLIC WAY (between North B and C
in the 200 block)
The Clerk read Ordinance No. 58 -2005 on second reading by title only.
Ordinance No. 58 -2005 is a request by J. Scott Porter to vacate a portion of a public right -of -way
commonly known as a twenty foot wide alley spanning North and South between North B Street and
North C Street. This vacation would be subject to the preservation of easements for existing utilities and
would allow the owner to pursue development of the entire block. The Plan Commission approved this
Ordinance with an 11 -0 vote at public hearing on November 16, 2005.
Council President Wissel declared Ordinance No. 58 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 58 -2005 with a second by Councilor Pappin. The motion carried with a unanimous voice vote.
Councilor Elstro moved to advance Ordinance No. 58 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Pappin. The motion carried with a unanimous
voice vote.

ORDINANCE NO. 75 -2005 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.

This ordinance is a request by Osborn International for a ten -year tax abatement for equipment valued at
$2,400,000.
Council President Wissel declared Ordinance No. 75 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 75 -2005 with a second by Councilor Welch. The motion carried with a unanimous voice vote.
Councilor Elstro moved to advance Ordinance No. 75 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Pappin. The motion carried with a unanimous
voice vote.

ORDINANCE NO. 77 -2005 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6-1.1-12.1 (Progress Investment Group, LLC)
The Clerk read Ordinance No. 77 -2005 on second reading by title only.
This ordinance is a request by Progress Investment Group, LLC for a ten -year tax abatement for real
estate valued at $950,000.
Council President Wissel declared Ordinance No. 77 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Parker moved for engrossment of Ordinance
No. 77 -2005 with a second by Councilor Welch. The motion carried with a unanimous voice vote.
Councilor Welch moved to advance Ordinance No. 77 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice
vote.
