MONDAY, DECEMBER 19, 2005
The Common Council of the City of Richmond, Indiana met in regular session Monday, December 19,
2005, in the Council Chambers in said City. President Bruce Wissel presided and the following business
was conducted:

Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry
Parker, Al Glover, Gil Klose and Diana Pappin.
APPROVAL OF MINUTES
Councilor Pappin moved to approve the minutes of the meeting of Monday, December 5, 2005 with a
second by Councilor Parker. The motion carried with a unanimous voice vote.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
RESOLUTION NO. 8 -2005 — A RESOLUTION ESTABLISHING THE RICHMOND RIVERFRONT
DEVELOPMENT DISTRICT
This Resolution would allow for and authorize the issuance of specified, non - transferable permits to sell
alcoholic beverages on premises for consumption in a restaurant on land or in a historic river vessel
within a municipal riverfront development project funded in part with state and city money. The area
selected would be bounded by North and South "A" Streets from 5th to 12th Streets. This Resolution was
approved unanimously and recommended for approval by the Redevelopment Commission.
Councilor Elstro moved to adopt Resolution 8 -2005 with a second by Councilor Klose. Resolution No. 8-
2005 was approved with a 9 -0 roll call vote.
COMMUNICATION FROM THE MAYOR
• Property owners /occupants are responsible for snow removal on sidewalks. This law has been in
effect since 1914. The City is working diligently to remove snow from the streets and sidewalks
of City owned property.
• The closing for the Carpenter property will be after January 1.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the December 1 and 8, 2005 meetings were accepted as presented.
REPORTS FROM STANDING COMMITTEES
• Street Tree Commission — Councilor Pappin nominated Ron Itnyre to the Street Tree
Commission. Nominations will be open until the January 3, 2006 meeting.
MISCELLANEOUS BUSINESS
• The Chamber of Commerce presented the nomination of Dana Weigle as a member of the
Wayne County Tourism Board of Directors. Councilor Welch moved to appoint Mr. Weigle with a
second by Councilor Sharp. The motion carried with a unanimous voice vote.

ORDINANCES ON FIRST READING
Councilor Elstro moved to suspend the rules and read Ordinance Nos. 88, 89, 90, 91, 92, 93 and 94 -2005
on first reading by title only with a second by Councilor Lundy. The motion carried with a unanimous
voice vote.
ORDINANCE NO. 88 -2005 — A GENERAL ORDINANCE AMENDING SECTION 75 OF THE CITY OF
RICHMOND CODE REGARDING SNOW EMERGENCY ROUTES
The Clerk read Ordinance No. 88 -2005 on first reading by title only.
This ordinance amends the current Snow Emergency Routes Ordinance which are reflected in Chapter
75 of the Municipal Code. The routes would then be consistent with Wayne County's Travel and Snow
Emergency Ordinance.
Councilor Elstro moved to advance Ordinance No. 88 -2005 to second reading and to suspend the rules
and read by title only with a second by Councilor Parker. The motion carried with a unanimous voice
vote.

being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 88 -2005 with a second by Councilor Parker. The motion carried with a unanimous voice vote.
Councilor Lundy moved to advance Ordinance No. 88 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

ORDINANCE NO. 89 -2005 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1 (Yukiya)
The Clerk read Ordinance No. 89 -2005 on first reading by title only.
This ordinance is a ten -year tax abatement request by Yukiya U.S.A. Gasket & Sealing Co., Ltd. for
equipment valued at $85,000.
Ordinance No. 89 -2005 was referred to the Tax Abatement Committee.
ORDINANCE NO. 90 -2005 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE 51 -2005
KNOWN AS THE 2006 SALARY ORDINANCE
The Clerk read Ordinance No. 90 -2005 on first reading by title only.
This Ordinance is necessary to reflect the addition of the new Assistant City Attorney and the 3% salary
increase for 17Transit Bus Drivers.
Councilor Lundy moved to advance Ordinance No. 90 -2005 to second reading and to suspend the rules
and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote.
Councilor Sharp moved to correct a typographical error on Ordinance No. 90 -2005 to change the year to
reflect 2006 in the columns for Bi- Weekly Salary, Hourly Rate and Annual Salary with a second by
Councilor Pappin. The motion carried with a unanimous voice vote.

The Clerk read Amended Ordinance No. 90 -2005 on second reading by title only
Council President Wissel declared Amended Ordinance No. 90 -2005 on second reading and public
hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment
of Ordinance No. 90 -2005 with a second by Councilor Pappin. The motion carried with a unanimous
voice vote.
Councilor Lundy moved to advance Ordinance No. 90 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

Ordinance No. 90 -2005 was adopted with a 9 -0 roll call vote.
ORDINANCE NO. 91 -2005 - AN APPROPRIATION ORDINANCE AMENDING THE 2005 BUDGET
The Clerk read Ordinance No. 91 -2005 on first reading by title only
This Ordinance relates to transfers in the 2005 budget for the following Departments: Human Rights,
Controller, Metropolitan Development, Police and Fire.
Councilor Welch moved to advance Ordinance No. 91 -2005 to second reading and to suspend the rules
and read by title only with a second by Councilor Pappin. The motion carried with a unanimous voice
vote.
Council President Wissel declared Ordinance No. 91 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 91 -2005 with a second by Councilor Lundy. The motion carried with a unanimous voice vote.
Councilor Lundy moved to advance Ordinance No. 91 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice
vote.

ORDINANCE NO. 92 -2005 - AN APPROPRIATION ORDINANCE AMENDING THE 2005 BUDGET

This Ordinance relates to transfers in the Motor Vehicle Highway 2005 budget
Councilor Welch moved to advance Ordinance No. 92 -2005 to second reading and to suspend the rules
and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice vote.
Council President Wissel declared Ordinance No. 92 -2005 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Lundy moved for engrossment of Ordinance
No. 92 -2005 with a second by Councilor Elstro. The motion carried with a unanimous voice vote.
Councilor Welch moved to advance Ordinance No. 92 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice

Councilor Welch moved to advance Ordinance No. 93 -2005 to second reading and to suspend the rules
and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice vote.

being no comments for or against the ordinance, Councilor Lundy moved for engrossment of Ordinance

ORDINANCE NO. 94 -2005 - AN APPROPRIATION ORDINANCE AMENDING THE 2005 BUDGET

This Ordinance relates to transfers in the Roseview Transit 2005 Budget.
Councilor Welch moved to advance Ordinance No. 94 -2005 to second reading and to suspend the rules
and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice vote.

being no comments for or against the ordinance, Councilor Parker moved for engrossment of Ordinance
No. 94 -2005 with a second by Councilor Pappin. The motion carried with a unanimous voice vote.

ORDINANCES ON SECOND READING
ORDINANCE NO. 76 -2005 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A
CERTAIN PARCEL FROM R -2 TO C -2 (2929 National Road West)
The Clerk read Ordinance No. 76 -2005 on second reading by title only.
This Ordinance is a petition requesting a rezoning from R -2, One Family Residence District to C -2,
Commercial District for use as a branch bank located at 2929 National Road West. The rezoning would
allow the owner to build a branch bank on the site. The Plan Commission voted 6 -0 to recommend
approval of the ordinance.
Council President Wissel declared Ordinance No. 76 -2005 on second reading and public hearing. John
Rusie of First Bank Richmond spoke in favor of the Ordinance. There being no comments against the

ordinance, Councilor Parker moved for engrossment of Ordinance No. 76 -2005 with a second by
Councilor Welch. The motion carried with a unanimous voice vote.
Councilor Welch moved to advance Ordinance No. 76 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Sharp. The motion carried with a unanimous voice
vote.

Ordinance No. 76 -2005 was adopted with a 9 -0 roll call vote
ORDINANCE NO. 84 -2005 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A
CERTAIN PARCEL FROM PART C -4 and PART R -3 TO C -4 (5309 -5501 National Road East)
The Clerk read Ordinance No. 84 -2005 on second reading by title only.
This ordinance is a petition to rezone from R -3 One to Eight Family Residence District, to C -4 General
Business District, the former Longer Trailer Court and Holiday Inn properties at 5309 and 5501 National
Road East. The rezoning would allow the owner to market the sites under one zoning classification. The
Plan Commission voted 6 -0 recommending approval of the rezoning.
Council President Wissel declared Ordinance No. 84 -2005 on second reading and public hearing. Greg
Merchanthouse of First Richmond Realty spoke in favor of the Ordinance. There being no comments
against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 84 -2005 with a second
by Councilor Pappin. The motion carried with a unanimous voice vote.
Councilor Welch moved to advance Ordinance No. 84 -2005 to third and final reading and suspend the
rules and read by title only with a second by Councilor Parker. The motion carried with a unanimous
voice vote.
