HomeMy Public PortalAbout01-16-2007PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, TUESDAY, JANUARY 16, 2007 The Common Council of the City of Richmond, Indiana met in regular session Tuesday, January 16, 2007, in the Council Chambers in said City. President Pappin presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PAPPIN ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, AI Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the Special Meeting and Regular Meeting of January 2, 2007, with a second by Councilor Welch. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS JOANN STEWART, Wayne County Voter Registration Office, presented information about Wayne County being selected as part of the Vote Center Pilot Program for the 2007 Muncipal Elections. ■ RECOGNITION OF THE ROSE VIEW BUS DRIVERS —Mayor Hutton presented certificates to Rose View Bus Drivers for their accident free driving for the Year of 2006. COMMUNICATION FROM THE MAYOR ■ Mayor Hutton praised all city personnel involved in fighting a major fire on the West side of Richmond on January 16. ■ Only three homes were flooded during the recent rains. None of these were on SW 4th due to the efforts of the Sanitary District. ■ Mayor Hutton and Fire Marshal Farris visited Charles Elementary School on January 16 to honor a student — Collin Smith. Collin called 911 for a house fire and said he knew the proper procedure because of training by Mr. Farris at the Fire Department Smoke House. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the December 28, 2006 and January 4, 2007 meetings were accepted as presented REPORTS FROM DEPARTMENT HEADS Metropolitan Development: Tony Foster announced there will be a joint meeting of the Economic Development Commission, the Redevelopment Commission and Common Council at 6 PM, February 5 in the Council Chambers prior to the Richmond Power & Light Board Meeting. This meeting has been called to review and approve all documents relative to the Johns - Manville project (establishing a TIF District and bond issue). An invitation to attend this meeting will be extended to the Chamber of Commerce, the Economic Development Corporation, Richmond Common Council, the Wayne County and Wayne Township Assessors. The purpose of this meeting is to discuss Tax Abatements. • A meeting has been scheduled with Richmond Community Schools and Common Council at 6:30 PM, January 29 at the Richmond Community Schools Administration Building, 300 Hub Etchison Parkway. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 1, 2, 3 & 4 -2007 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 1 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Pal Item — equipment) The Clerk read Ordinance No. 1 -2007 on first reading by title only. This Ordinance is a request by the Palladium Item for a ten -year tax abatement for equipment valued at $210,800.00. Ordinance No. 1 -2007 will be referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 2 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Pal Item — equipment) The Clerk read Ordinance No. 2 -2007 on first reading by title only. This Ordinance is a request by the Palladium Item for a ten -year tax abatement for equipment valued at $195,900.00. Ordinance No. 2 -2007 will be referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 3 -2007 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY The Clerk read Ordinance No. 3 -2007 on first reading by title only This Ordinance would authorize the City of Richmond Police Department to submit a grant application and accept grant funding in an amount up to Nineteen Thousand One Hundred Ten Dollars and no cents ($19,110.00). If awarded, Seven Thousand Five Hundred Ten Dollars ($7,510.00) of said funds will be appropriated for K -9 equipment, training for a handler and K -9 and to purchase educational materials to be handed out at public presentations on the use of K -9's. The remaining Eleven Thousand Six Hundred Dollars ($11,600.00) shall be appropriated to purchase a digital recorder and two (2) ICOP in -dash video recorders. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 3 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 3 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 3 -2007 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 3 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 3 -2007 on third reading by title only. Ordinance No. 3 -2007 was adopted with a 9 -0 roll call vote ORDINANCE NO. 4 -2007 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INTERNET CRIMES AGAINST CHILDREN TASK FORCE The Clerk read Ordinance No. 4 -2007 on first reading by title only This Ordinance would authorize the City of Richmond Police Department to submit a grant application and accept grant funding in an amount up to Five Thousand Dollars and no cents ($5,000.00). If awarded, these funds shall be appropriated to purchase equipment and /or training relating to the investigation of internet crimes against children and to assist RPD's participation with the Indiana Crimes Against Children Task Force. Councilor Welch moved to advance Ordinance No. 4 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 4 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 4 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 4 -2007 with a second by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 4 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 4 -2007 on third reading by title only. Ordinance No. 4 -2007 was adopted with a 9 -0 roll call vote ORDINANCES ON SECOND READING ORDINANCE NO. 64 -2006 — A GENERAL ORDINANCE AMENDING SECTION 154.04 OF THE CITY OF RICHMOND CODE REGARDING ZONING (PORTABLE STORAGE UNITS - PODS) The Clerk read Ordinance No. 64 -2006 on second reading by title only. This Ordinance would be an addition to Chapter 154 of the Zoning Code and would control the use of portable storage units (POD's). The Plan Commission passed a recommendation for approval at their November 16, 2006 meeting. Common Council Minutes January 16, 2007 Page 4 of 4 Councilor Welch moved to amend Ordinance No. 64 -2006, paragraph (e)(ii) as follows: ... such property owner may file a written appeal with the Board of Public Works and Safety for rescission or adjustment of such notice or bill within ten (10) days after the date of such notice or bill. There was a second by Councilor Wissel. Upon a vote viva voce, the motion passed. Councilor Wissel moved to amend Ordinance No. 64 -2006 by adding paragraph (f): This ordinance shall take effect May 1, 2007. There was a second by Councilor Lundy. Upon a vote viva voce, the motion passed. Council President Pappin declared Ordinance No. 64 -2006 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 64 -2006 with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 64 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 64 -2006 on third reading by title only. Ordinance No. 64 -2006 was adopted with an 8 -1 roll call vote. Dissenting was Councilor Parker. ORDINANCE NO. 82 -2006 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -2 TO R -2, SPECIAL USE (21 South 34th Street The Clerk read Ordinance No. 82 -2006 on second reading by title only This Ordinance is a request to change the zoning designation at 21 South 34th Street to an R -2, Special Use District in order to allow the owner to use said real estate as an accessory off - street parking adjacent to Bank building and use located in C -2 District. The Plan Commission passed a recommendation for approval at their November 16, 2006 meeting. Council President Pappin declared Ordinance No. 82 -2006 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 82 -2006 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 82 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker.
