HomeMy Public PortalAbout027-2013 - Revise Chapter 58 of the City Code - Landfill Fee.pORDINANCE NO.27-2013 OF THE CITY OF RICHMOND, INDIANA AN ORDINANCE AMENDING SECTION 58.02 OF THE RICHMOND CITY CODE WHEREAS, Chapter 58 of the Richmond City Code sets forth the fee schedule for the landfill user fees for commercial, industrial, institutional and residential residents within and without the Richmond Sanitary District; and WHEREAS, There have been circumstances where the City needs to permit City, subject to recommendation of the Sanitary District Director and as approved by the Board of Directors of the Richmond Sanitary, that waste collected on City of Richmond project or on behalf of the City of Richmond projects, could be waived in full or partially waived or reduced; and WHEREAS The proposed change would be beneficial to the City of Richmond in that it would enable the City to reduce the cost it charges itself in order to make the City cleaner and more free of junk, debris or materials, construction or demolition waste materials; and WHEREAS, The Richmond Sanitary District Board of Directors has approved the concept of waiving of fees, on a case by case basis, of waste fees on projects on behalf of the City of Richmond or that directly benefit the City of Richmond. NOW THEREFORE, BE IT ORDAINED BY COMMON COUNCIL, OF THE CITY OF RICHMOND, THE FOLLOWING SUBSECTION OF CHAPTER 58 OF RICHMOND CITY CODE BE AMENDED TO READ AS FOLLOWS: CHAPTER 58: LANDFILL SECTION 58.01 Develop and Implement Fees 58.02 Fee Schedule 58.03 Definitions 58.01 DEVELOP AND IMPLEMENT FEES The Richmond Board of Sanitary Commissioners is hereby authorized to develop and implement a landfill fee system for disposal of trash, garbage and rubbish at the Richmond Sanitary Landfill. 58.02 FEE SCHEDULE: The Landfill shall collect user fees as follows: (1) Commercial, Industrial and Institutional residents within the Richmond Sanitary District shall be charged the following fees for the different types of wastes set forth below accepted by the Landfill for disposal subject to a minimum fee of $4.50, except that, only as to construction/demolition waste as set forth in subsection (E) below, upon the recommendation of the Director of the Richmond Sanitary District, and subject to the unanimous approval of the Richmond Sanitary District Board of Commissioners, the fees for City of Richmond projects, or projects on behalf of the City of Richmond that directly benefit the City of Richmond, may be waived in full or may be partially waived or reduced, to -wit: (A) ORDINARY SOLID WASTE Solid Waste generated by operations. The term does not include: special waste, infectious waste, coal or fly ash - $27.00/ton (B) INDUSTRIAL PROCESS WASTE Identified as any byproduct of a manufacturing process outside of normal waste - $32.00/ton (C) SPECIAL MANAGEMENT WASTE Identified as any waste requiring special handling by Landfill Personnel - $55.00/ton (D) APPROVED WASTE FOR ALTERNATIVE DAILY COVER - $9.00/ton (E) CONSTRUCTION/DEMOLITION WASTE-$23.00/ton This subsection also includes residential residents within the Richmond Sanitary District. (2) Commercial, Industrial and residential waste generated outside the Richmond Sanitary District will be charged the following fees for all waste accepted By the Landfill for disposal subject to a minimum fee of $4.50, to wit: (A) ORDINARY SOLID WASTE Solid waste generated by operations. The term does not include: special waste, infectious waste, or results from combustion of coal - $33.00/ton (B) INDUSTRIAL PROCESS WASTE Identified as any byproduct of a manufacturing process outside of normal waste - $38.00/ton (C) SPECIAL MANAGEMENT WASTE Identified as any waste requiring special handling by Landfill Personnel — $55.00/ton (D) APPROVED WASTE FOR ALTERNATIVE DAILY COVER - $9.00/ton (E) CONSTRUCTION/DEMOLITION WASTE The Landfill will charge for all construction/demolition waste - $29.00/ton (3) An additional charge of $2.00 per ton will be assessed on all disposals as required by applicable State and Local regulations. (4) Residential residents within the Richmond Sanitary District shall not be charged any fee for normal, customary, household waste, disposed of at the Landfill. (5) MATERIALS SEGREGATED FROM WASTE STREAM For all customers, the following charges shall apply, if such waste is segregated. (A) Clean Fill dirt, brick, block, cement, etc - $9.00/ton (B) Raw wood compost able waste: brush, wood pallets, yard waste - $19.50/ton (C) Freon Units: refrigerators, air conditioners, de-humidifier-$35.00/unit (D) Ferrous Metal, cardboard, and recyclable No charge (6) TIRES Disposal by truckload or in mass numbers shall not be permitted. The disposal of individual tires shall result in the following fees: (A) Car Tires and pick up truck tires - $5.00 per tire (B) Truck Tires - $15.00 per tire (C) Tractor Tires - $30.00 per tire (D) Tires on Rims — ADDITIONAL - $5.00 per tire (7) All fees will be due and payable at the time of disposal unless a monthly billing arrangement is approved in advance by the Richmond Sanitary District. (Ord. 7- 2004) 58.03 DEFINITIONS (1) "SPECIAL WASTE' for all uses above, is defined as determined or classified by Indiana Department of Environmental Management (I.D.E.M). Ord.
