The Common Council of the City of Richmond, Indiana met in regular session Monday, February 5, 2007,
in the Council Chambers in said City. President Pappin presided and the following business was
conducted:

Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry
Parker, Al Glover, Gil Klose and Diana Pappin.
APPROVAL OF MINUTES
Councilor Wissel moved to amend the proposed minutes to reflect the February 21 meeting to discuss
Tax Abatements is a Committee of the Whole of Common Council and an invitation to attend this meeting
will be extended to the Chamber of Commerce, the Economic Development Corporation, Richmond
Common Council, the Wayne County and Wayne Township Assessors. There was a second by
Councilor Sharp. Upon a vote viva voce, the motion passed. Councilor Welch moved to approve the
minutes of the meeting of January 16, 2007 meeting as amended, with a second by Councilor Parker.
Upon a vote viva voce, the motion passed.

COMMUNICATION FROM THE MAYOR
• Ms. Hutton announced a Legislative Session will be hosted by the Chamber of Commerce at the
Richmond Community Schools Administration Building at 9 AM on February 9,2007.
• Tammy Glenn has accepted the position of City Controller, Valerie Fonzer will assume the
responsibilities of Assistant City Controller and Bill Harris has agreed to remain as Human
Resource Director for the rest of the year.

Minutes of the February 1 and 8, 2007 meetings were accepted as presented.

ORDINANCE NO. 5 -2007 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM HAMBURGER HELPER
The Clerk read Ordinance No.5 -2007 on first reading by title only.
This Ordinance would authorize the City of Richmond Parks & Recreation Department to submit a grant
application to Hamburger Helper through its program, MyHometownHelper.com. The Parks Department
would also be authorized to accept said grant funding in an amount up to Five Thousand Dollars and Zero
Cents ($5,000.00). If awarded, this grant shall be appropriated to assist with the costs of supplies and
field trips for Just Us Kids Outdoors (J.U.K.O.)
Councilor Wissel moved to advance Ordinance No. 5 -2007 to second reading and to suspend the rules
and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed.

Council President Pappin declared Ordinance No. 5 -2007 on second reading and public hearing. There
being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance
No.5 -2007 with a second by Councilor Welch. Upon a vote viva voce, the motion passed.
Councilor Welch moved to advance Ordinance No. 5 -2007 to third and final reading and suspend the
rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion
passed.

Ordinance No. 5 -2007 was adopted with a 9 -0 roll call vote.
ORDINANCE NO. 6 -2007 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,

The Clerk read Ordinance No. 6 -2007 on first reading by title only.
This Ordinance would authorize the City of Richmond Parks & Recreation Department to submit a grant
application to the Wayne County Foundation. The Parks Department would also be authorized to accept
said grant funding in an amount up to Five Thousand Dollars and Zero Cents ($5,000.00). If awarded,
this grant shall be appropriated to assist with the costs of supplies and field trips for Just Us Kids
Outdoors (J.U.K.O.)

application to the American Eagle Outfitters Foundation. The Parks Department would also be authorized
to accept said grant funding in an amount up to Two Thousand Dollars and Zero Cents ($2,000.00). If
awarded, this grant shall be appropriated to assist with the costs of supplies and field trips for Just Us
Kids Outdoors (J.U.K.O.)
Councilor Sharp to advance Ordinance No. 7 -2007 to second reading and to suspend the rules and read
by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 8 -2007 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE PAYLESS SHOE SOURCE
FOUNDATION
The Clerk read Ordinance No. 8 -2007 on first reading by title only.
This Ordinance would authorize the City of Richmond Parks & Recreation Department to submit a grant
application to the Payless Shoe Source Foundation. The Parks Department would also be authorized to
accept said grant funding in an amount up to Four Thousand Five Hundred Dollars and Zero Cents
($4,500.00). If awarded, this grant shall be appropriated to assist with the costs of supplies and field trips
for Just Us Kids Outdoors (J.U.K.O.)
Councilor Sharp moved to advance Ordinance No. 8 -2007 to second reading and to suspend the rules
and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 9 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO
RECEIVE A DONATION FROM THE DRYER'S FOUNDATION

This Ordinance would authorize the City of Richmond to accept a Dryer's Foundation a donation of
Dryer's Ice Cream to be used for Just Us Kids Outdoors (J.U.K.O.) summer program through the Park
system.
Councilor Parker to advance Ordinance No. 9 -2007 to second reading and to suspend the rules and read
by title only with a second by Councilor Sharp on a vote viva voce, the motion passed.

ORDINANCE NO. 85 -2006 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1
The Clerk read Ordinance No. 85 -2006 on first reading by title only.
This Ordinance is a request by TBK America, Inc. for a ten -year tax abatement for equipment valued at
$3,114,000. The Tax Abatement Committee recommended approval with the following changes:
pg. 2 — Jobs Created: 2007 — 8 -10 jobs; 2008 — 55 -60 jobs; 2009 — 60 -65 jobs
Estimated New Value: $1,420,640. 00
pg. 3 - Eliminate the 2nd type of Equipment; and
Form SB -1 A — Average hourly wage for projected new positions - $9.00
Councilor Wissel moved to amend Ordinance No. 85 -2006 as recommended by the Tax Abatement
Committee with a second by Councilor Parker. Upon a vote viva voce, the motion passed.
Council President Pappin declared Ordinance No. 85 -2006, as amended, on second reading and public
hearing. There being no comments for or against the Ordinance, Councilor Elstro for engrossment of
Ordinance No. 85 -2006 with a second by Councilor Welch. Upon a vote viva voce, the motion passed.
Councilor Sharp moved to advance Ordinance No. 85 -2006 to third and final reading and suspend the
rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed.

STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.

This Ordinance is a request by the Palladium Item for a ten -year tax abatement for equipment valued at
$210,800.00. The Tax Abatement recommended approval with the following change:
pg. 2 - Estimated New Value: $192,800.00
Councilor Wissel moved to amend Ordinance No. 1 -2007 as recommended by the Tax Abatement
Committee with a second by Councilor Welch. Upon a vote viva voce, the motion passed.

hearing. There being no comments for or against the Ordinance, Councilor Sharp for engrossment of
Ordinance No. 1 -2007 with a second by Councilor Parker. Upon a vote viva voce, the motion passed.
