Donathan DBAADDENDUM THIS ADDE UM, (Number 1 to Contract No. 39-2013) is made and entered into this Z � day of 2013, by and between Richmond, .Indiana, a municipal corporation acting thro office its Board of Public Works and Safety with its oce at 50 North 5d` Street, Richmond, Indiana, (hereinafter referred to as "City"), and Robert A. Donathan DBA Donathan's Inspections and Removal, 3504 North Linden Street, Muncie, IN 47304 (hereinafter referred to as "Contractor"). WHEREAS, City and Contractor entered into Contract No. 39-2013 on April 1, 2013, which contract set forth four (4) NSP-3 properties currently owned by the City to be inspected and tested for asbestos; and WHEREAS, City wishes to include an additional NSP address located at 200 South 14' Street in Richmond, Indiana, to also be tested for asbestos. as set forth within the scope of Contract No. 39-2013. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated recitals, City and Contractor hereby agree as follows: 1. The City and Contractor executed and entered into Contract No. 39-2013, on April 1, 2013. Both parties expressly agree that an additional. property shall be inspected by Contractor, which property is owned by the City and is located at 200 South 14" Street in Richmond, Indiana, and, pursuant to Section 4.2 of said Contract, the Stipulated Sum shah be increased by Three Hundred Dollars and Zero Cents ($300:00), making the total Stipulated Sum a total amount not to exceed One Thousand Five Hundred Dollars and Zero Cents ($1,500.00) for completion of the work under Contract No. 39-2013. 2. City and Contractor expressly agree that all other terms, conditions, and covenants contained in Contract No. 39-2013, shall be applicable to the work performed pursuant to this Addendum, unless such term, condition or covenant conflicts with this Addendum Number 1, in which case this Addendum Number 1 shall be controlling. 3. Both parties hereby agree that with the exception of the addition of the above - referenced property to also be tested for asbestos in accordance with Contract No. 39-2.0;13, Contract No. 39-2013 shall remain intact and unchanged and in full force and `effect. Both parties agree that any person executing this Contract in a representative capacity hereby warrants that he or she has been duly authorized by his or her principal to execute this Addendum.
