HomeMy Public PortalAbout032-2013 - Special - Interim Protection of 1225 South A StreetAMENDED ORDINANCE 32-2013 A SPECIAL ORDINANCE IN CONNECTION WITH INTERIM PROTECTION OF THE PROPERTY LOCATED AT 1225 SOUTH A STREET, RICHMOND, INDIANA WHEREAS, Section 158.05 of the City Code provides that the Common Council of the City of Richmond (hereinafter "Common Council") may approve or reject a designation of interim protection by ordinance in the event a property has been granted interim protection by the City of Richmond Historic Preservation Commission (hereinafter "HPC"); and WHEREAS, On April 19, 2013, the property located at 1225 South A Street in Richmond, Indiana, was affirmed by the Richmond Unsafe Building Commission (hereinafter "UBC") to be an unsafe and blighted property and a Continuous Enforcement Order was issued by the UBC ordering the property owners to repair or remove the structure, in accordance with Richmond City Code Chapter 98 and Indiana Code (IC) 36-7-9; and WEHREAS, The Continuous Enforcement Order issued by the UBC requires the property located at 1225 South A Street, Richmond, Indiana, to be repaired or removed within thirty (30) days subject to a one-year extension in the event the property owners submit a performance bond within the thirty (30) day period; and WHEREAS, On April 22, 2013, the property was submitted to the HPC for interim protection and on May 13, 2013, the HPC voted to grant interim protection to the property located at 1225 South A Street, Richmond, Indiana, despite knowledge that the property was subject to the Continuous Enforcement Order issued by the UBC on April 19, 2013; and WHEREAS, Interim protection of the property under Richmond City Code 158.05(d) would mean that the structure located on the property located at 1225 South A Street, Richmond, Indiana may not be demolished or removed and may not be conspicuously changed and in accordance with Richmond City Code Chapter 158.05(c) a structure placed under interim protection by the HPC remains under interim protection for ninety (90) days until approved or rejected in an ordinance by the Common Council; and WHEREAS, A map showing the single -site structure located at 1225 South A Street, Richmond, Indiana is attached hereto, made a part hereof, and marked as "Exhibit A" to this Ordinance; and WHEREAS, Because the property located at 1225 South A Street, Richmond, Indiana, had previously been deemed an unsafe and blighted property by the UBC, the granting of interim protection by the HPC may be inappropriate; and WHEREAS, It is in the best interest of the City of Richmond that the Common. Council make a determination to either accept or reject the interim protection granted by the HPC at its May 13, 2013, meeting, in order that the property located at 1225 south A Street, Richmond, Indiana, may either be protected under the interim protection granted by the HPC or in order that the property continue to be subject to the Continuous Enforcement Order previously approved by the UBC. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: The map attached as "Exhibit A," showing the address boundaries of the property located at 1225 South A Street, Richmond, Indiana, is hereby rejected and the interim protection granted by the Historic Preservation is rejected. Passed and adopted this 3rd day of June 2013, by the Common Council of the City of Richmond, Indiana.
