HomeMy Public PortalAboutOrdinance 75-411ORDINANCE N0. 75 -411 AN ORDINANCE AMENDING ORDINANCE 'NO. 68 -268, OF THE CITY OF TEMPLE CITY BY ADOPTING BY REFER- ENCE THE LOS- ANGELES COUNTY MECHANICAL CODE AS CONTAINED IN-THE 1975 EDITION OF THE LOS ANGELES COUNTY BUILDING "LAWS "PUBLISHED BY THE BUILDING NEWS, INC. AND INCLUDING THE APPENDIX THERETO AND MAKING``OTHERAMENDMENTS. ' THE CITY COUNCIL OF THE CITY OF .TEMPLE CITY DO ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 68 -268- entitled "Mechanical Code" adopted June 6, 1972, as codified in Section 8150 et seq. of the Temple City Municipal Code, is hereby amended by adopting by reference, except as hereinafter °provided, that certain Mechani- cal Code known and designated as the Los Angeles County Mechani- cal Code as contained in the 1975 edition of the Los Angeles County Building Laws published by the Building News, Inc. and in- cluding the appendix to said Los Angeles County Mechanical Code and such code, except as herein provided, shall be and become the Mechanical Code of the City of Temple City providing for the issu- ance of permits and the collection of fees therefor and providing penalties for violation of such code. Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk of the City of Tem- ple City and shall be at all times maintained by said Clerk for use and examination by the public. SECTION 2. Whenever any of the following names or terms are used in said Los Angeles County Mechanical Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this-section as follows: "Board of Appeals" or "Board of Examiners of Plumbers" shall mean the Board of Examiners of Plumbers, Gas Fitters, and Sewerage Contractors of the County of Los Angeles established by Section 73 of the Los Angeles County Plumbing Code as published in the 1975 edition of the Los Angeles County Building Laws previously referred to in this ordinance. "Building Department" shall mean the "Building and Safety Division" of the Department-of the County Engineer. "Building Code", "Uniform Building Code" or "Los Angeles County Building Code" shall mean Section 8100 et seq. of the Tem- ple City Municipal Code. "Building Official" shall mean County Engineer of the County of Los Angeles. "City" shall mean the City of Temple City. "Electrical Code" shall mean Section 8200 et seq. of the Temple City Municipal Code. "Fire Code" or "Los Angeles County Fire Code" shall mean Section 3100 et seq. of the Temple City Municipal Code. --- -- "General Fund" shall mean the City Treasury of the City of Temple City. "Health Code ", or "Los Angeles County Health Code" shall mean Section 5100 et seq. of the Temple City Municipal Code. "Mechanical Code" shall mean Section 8150 et seq. of the Tem- ple City Municipal Code. "Plumbing Code" shall mean Section 8300 et seq. of the Temple City Municipal Code. Ordinance No. 75 -411 SECTION.3. Sections 108 of said Los Angeles County Mechanical Code is amended to read: Section 108. Violations and Penalties. It shall be unlawful for any person,.firm or corporation to erect, install, alter, repair, relocate, add to, replace, use or maintain heating, ventilating, comfort cooling, or refrig- eration equipment in the jurisdiction or cause the same to be done, contrary to or in violation of any of the provi- sions of this Code. Maintenance of equipment which was unlawful at the time it was installed and which would be unlawful under this Code if installed after the effective date of this Code, shall constitute a continuing violation of this Code. Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a mis- demeanor, and each person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500, or by imprisonment for not more than six months, or by both such .�,ne and imprisonment. SECTION 4. - Section/304 of said Los Angeles County Mechanical Code is amended to read as -follows: Section 304. PERMIT FEES Any person desiring a permit required by this Code shall, at the time of filing an application therefor, pay a fee as required by. this section. However, occupancy inspection corrective work, as defined in Section 306(a) of the Building Code, is exempted from further fees when the total valuation for all the corrective work is under $1,000. 1. For the issuance of each permit $ 4.50 2. For the installation, alteration or relocation . of each refrigeration compressor or absorption unit, and for each fuel buring furnace, heater, boiler, and vented decorative appliance in- cluding vents attached thereto: Up to and including 100,000 BTU More than 100,000 BTU to and including 500A00 BTU More tan 500,000 BTU to and including 1, -00 000`BTU More than 1;000,000'BTU to and including 2,000,000 BTU More than 2,000,000 BTU 3. For the installation, relocation or replace- ment of each appliance vent installed and not included in an appliance permit 4. For the alteration of an existing duct system for which a permit is not required Elsewhere in this Code 4.50 SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general cir- culation, printed, published and circulated in the City of Temple City.
