THIS SUPPLEMENTAL AGREEMENT, made and entered into this � day of

, 2013, by and between RUNDELL ERNSTBERGER ASSOCIATE'S, LLC, Indianapolis,
eremafier referred to as the "CONSULTANT", and the -City of Richmond, IN, hereinafter referred to
as the "LOCAL PUBLIC AGENCY" or "LPA"
W1:IEREAS, on August 196, 2010, the LPA entered into a Contract with the CONSULTANT for
services required for development of Contract Plans for the construction of the Cardinal Greenway and Starr-
Gennctt Area Redevelopment, Richmond, Indiana, INDOT Project Des. No. 0810267, herein after referred to as
the Contract, and
WHEREAS, the LPA and the CONSULTANT have determined that a modification of the -Contract is
required to include additional services requested by the LPA in Appendix A and to include additional fees for
these services in Appendix D of the Contract.
NOW, THEREFORE, the parties agree that the Contract shall be modified by this Contract Supplement
No. 4 in accordance with the following:
I. Appendix A of the Contract shall be modified as follows:
ADD the followingparagraphs:
"K. Upon request, the CONSULTANT shall assist the LPA in preparing and submitting a Stellar
Communities Grant Application for the 2013 grant cycle. Services are to include graphics and
renderings, cost opinions, and assistance with presentations."
"L. The CONSULTANT shall assist the LPA in preparing and submitting an IDEM work plan: for
construction activities in area included in an Environmental Restricted Covenant."
"M. The CONSULTANT shall assist perform additional geotechnical investigations and rock core
samplings.
"N. The CONSULTANT shall perform Archeological Trenching according to the plan approved by
MOT and SHPO. "
"O. The CONSULTANT shall include design of an additional gravity sewer service as directed by the
LPA."
11. Appendix D of the Contract shall be modified as follows:
Appendix D, Section A, paragraph I, shall be MODIFIED to read:
"l. The CONSULTANT shall receive as payment for the work performed under this Contract the
total fee not to exceed $449,351.00 in accordance with the following Fee Schedule, unless a
modification of the Contract is approved in writing by the LPA."
Appendix D, Section A paragraph 2, shall be MODIFIED to read:
"2. The CONSULTANT will be paid for the work performed under this Contract as indicated.
