HomeMy Public PortalAbout007-1989-ZONING - RICHMOND MUNICIPAL AIRPORT FROM AZ AIRPORT ZOAMENDED ORDINANCE NO. 7-1989 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325- 1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT THE RICHMOND MUNICIPAL AIRPORT FROM AZ AIRPORT ZONE DISTRICT TO AZ SU AIRPORT ZONE SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY FOR THE LAND APPLICATION OF DIGESTED SEWAGE SLUDGE. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as AZ Airport Zone District the property located at the Richmond Municipal Airport; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from AZ Airport Zone District to AZ SU Airport Zone Special Use District, and to authorize the Special Use of said property for the land application of digested sewage sludge; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of , 1989, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to in favor of/in opposition to recommending the passage of Ordinance No. 7-1989. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to AZ SU Airport Zone Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being the north half of Section 35, Township 13 North, Range 1 West, also the South half of Section 13 North, Range 1 West, and also a part of the Northwest Quarter of Section 26, Township 13 North, Range 1 West, more particularly described as follows: Beginning at the southwest corner of the northwest quarter of Section 26, Township 13 North, Range 1 West, thence north along the west line of said Section 26, 191.90 feet to the center of Bulla Road; thence east parallel with the south line of northwest quarter of said Section 26, 2336.90 feet; thence south parallel with the west line of the northwest quarter of said Section 26, 191.990 feet to a point in the south line of the northwest quarter of said Section 26, said point 313.50 feet measured westwardly from the southeast corner of the northwest quarter of said Section 26; thence west on the south line of the northwest quarter of said Section 26 to the place of beginning; containing in all of the above described areas, 651.88 acres more or less. ALSO, being a part of the Southwest Quarter of Section 25, Township 13 North, Range 1 West, more particularly described as follows: Beginning at the northwest corner of the southwest quarter of said Section 25; thence south 89 degrees 46 minutes and 40 seconds east, along the north line of said southwest quarter 1875.67 feet; thence south 0 degrees 02 minutes and 10 seconds east 518.99 feet; thence south 55 degrees 28 minutes and 25 seconds west 2278.26 feet to a point on the west line of said southwest quarter; thence north along said west line 1817.55 feet to the place of beginning, containing an area of 50.337 acres. There being a total of 702.217 acres in the entire Airport property. A tract of land situation in a part of Section 26 and 35, Township 13 North, Range 1 West, Boston Township, City of Richmond, Indiana more particularly described as follows: The north half of Section 35; the south half of Section 26, and a part of the Northwest Quarter of Section 26, said fractional quarter being described as follows: Beginning at the southwest corner of said Quarter Section; a distance of 191.90 feet to a point in the center of Bulia Road; thence east along a line parallel to the south line of said Quarter Section a distance of 2336.89 feet to a point; thence south parallel to the west line of said Quarter Section a distance of 191.90 feet to a point on the south line of said Northwest Quarter Section said point being 313.50 feet west of the southeast corner of said Quarter Section; thence west along the south line of said Quarter Section to the point of beginning, containing in all 651.89 acres more or less, subject to all legal highways and/or right-of-ways. SECTION 2. That as provided in Articles 36 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed for the land application of digested sewage sludge. SECTION 3. That as a condition of being granted the Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a. The Special Use site plan and narrative submitted in the Special Use petition shall be marked Exhibit "A" and made a part of this Ordinance. b. The digested sewage sludge applied to the land described above shall be limited to the digested sewage sludge generated by the Richmond Sanitary District. c. The digested sewage sludge applied to the land described above shall be applied by soil injection solely with no surface application to be permitted. d. The digested sewage sludge applied to the land described above shall not be applied within 300 ft. of all boundaries. e. The digested sewage sludge applied to the land described above shall not be applied within 300 ft. of any drainage ditches. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required.
