A RESOLUTION TO APPROVE A SECOND SUPPLEMENTAL SUBDIVIDER'S
AGREEMENT FOR DEERVIEW ESTATES SUBDIVISION
Whereas, it has been determined that it is in the best interest of the City to enter into a
second supplemental subdivider's agreement with Subdivider, and;
Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa approves the
attached Second Supplemental Subdivider's Agreement, and the Mayor and City Clerk of
Tiffin, Iowa, are hereby authorizing to execute the attached Agreement if the agreement and
release have been timely executed and delivered by Subdivider.
Now, therefore be it resolved that this offer shall be automatically withdrawn, null and void,
and of no force and effect whatsoever if Subdivider does not timely execute the agreement
and deliver to City the fully executed attached Agreement and Release on or before
December 5, 2012 at 5:00 p.m.
On the 28th day of November 2012, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Kahler introduced Resolution No. 2012 -79, A RESOLUTION TO DECLARE
NECESSITY AND ESTABLISH AN URBAN RENEWAL AREA, PURSUANT TO SECTION
403.3 OF THE CODE OF IOWA AND APPROVE URBAN RENEWAL PLAN AMENDMENT
FOR THE NOVEMBER 2012 ADDITION TO THE TIFFIN URBAN RENEWAL AREA and
made a motion for approval. Motion seconded by Councilperson Ryan.
Ayes: Upton, Bartels, Ryan, Kahler
Nays: none.
Absent: Phillips
Whereupon four Council members were present and voted approval and Mayor Berner
declared that the Resolution No. 2012 -79, A RESOLUTION TO DECLARE NECESSITY
AND ESTABLISH AN URBAN RENEWAL AREA, PURSUANT TO SECTION 403.3 OF THE
CODE OF IOWA AND APPROVE URBAN RENEWAL PLAN AMENDMENT FOR THE
NOVEMBER 2012 ADDITION TO THE TIFFIN URBAN RENEWAL AREA to be adopted and
signified his approval of the same by affixing his signature thereto.
Passed by the City Council on the 28th day of November, 2012.
