ORDINANCE NO; 75 -416
AN ORDINANCE OF.THE CITY OF TEMPLE
CITY ADDING NEW SECTION 9518 TO THE
TEMPLE CITY MUNICIPAL CODE RELATING
TO THE PROCESSING OF LOT SPLITS AND
PARCEL MAPS, AND PROVIDING THAT THIS
ORDINANCE SHALL BECOME IMMEDIATELY
EFFECTIVE
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The City Council finds and determines that
Ordinances 75 -400 and 75 -400A were added to the Temple City
Municipal Code as interim provisions to comply with the new
Subdivision Map Act of the State of California, and to meet
minimum requirements until such time as a permanent ordinance
has been processed by the Planning Commission and City Council
SECTION 2. The City Council now finds that Ordinances
75 -400 and 75 -400A are inadequate with respect to the processing
of certain parcel maps in that the same do not provide a reason-
able alternative procedure in the event of the failure of the
Planning Commission to act in expeditious fashion.
SECTION 3. That there are certain time limitations
provided by the Subdivision Map Act and hardship imposed
upon certain developers if parcel maps are not acted upon
expeditiously, and accordingly it is appropriate that this
ordinance be enacted as an urgency ordinance in order not to
jeopardize the City because of statutory time limitations,
nor because of inordinate delay.
SECTION 4. Section 9518, reading as follows, is hereby
added to the Temple City Municipal Code:
9518. Processing By Council. Whenever the
City Council finds that the time limits provided
by the Subdivision Map Act or hardship to a particu-
lar developer will be involved in the processing of
a parcel map, because of the schedule of meetings of
the Planning Commission, or the failure of the
Planning Commission to attain a quorum, then the
City Council may exercise original jurisdiction over
such tentative or final parcel maps, and in every
manner act and process such tentative and final
parcel map in the place and stead of the Planning
Commission, in which case the decision of the City
Council shall be final.
SECTION 5. This ordinance shall take effect immediately
upon its adoption.
SECTION 5. The City Clerk of the City of Temp;le City
shall certify to the passage and adoption of this Ordinance
and to its approval by the Mayor and shall cause the same to
be published in the Temple City Teimes, a newspaper of general
circulation, printed, published and circulated in the City of
Temple City.
