HomeMy Public PortalAbout037-2013 - General Ordinance - StormwaterORDINANCE NO. 37-2013 A GENERAL ORDINANCE AMENDING SECTIONS 57.04, 59.05, 59.12, 69.1.04 AND 59.1.10 OF THE RICHMOND CITY CODE WHEREAS, The City of Richmond has previously established, through Ordinance No. 63-1999 and Ordinance No. 47-2006, a Department of Stormwater Management pursuant to Indiana Code; and WHEREAS, Various ordinances of the Richmond City Code assign certain responsibilities in connection with stormwater management and conveyance systems, and the Department of Stormwater Management, to the Office of the City Engineer; and WHEREAS, It is desirable to transfer such responsibilities in connection with stormwater management and conveyance systems, and the functions of the Department of Stormwater Management, to the Richmond Sanitary District, while retaining its reporting to the separate Board of Stormwater Management established pursuant to ordinance and state law. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond that Sections 57.04, 59.050), 59.12(5), 59.1.04 and 59.1.10(a) be amended to read as follows: CHAPTER 57: EROSION AND SEDIMENT CONTROL 57.04 RESPONSIBILITY FOR ADMINISTRATION The City of Richmond shall administer, implement, and enforce the provisions of this Chapter by and through the Richmond Sanitary District. Any powers granted or duties imposed upon the City of Richmond may be delegated in writing by the City to persons or entities acting in the beneficial interest of or in the employ of the City. CHAPTER 59: DEPARTMENT OF STORMWATER MANAGEMENT 59.05 DEFINITIONS For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning: 6) Director: The Director of the Richmond Sanitary District of the City of Richmond, Indiana. 59.12 PRIVATE STORMWATER FACILITIES OUTLETTING TO PUBLIC DRAINAGE SYSTEM (5) No unauthorized person shall uncover, make connection with or open into, use, alter or disturb any public sewer or appurtenance thereof without first contacting the Richmond Sanitary District. CHAPTER 59.1: CONTROL OF POST CONSTRUCTION STORMWATER RUNOFF 59.1.04 RESPONSIBILITY FOR ADMINISTRATION The City of Richmond shall administer, implement, and enforce the provisions of this Chapter by and through the Richmond Sanitary District. Any powers granted or duties imposed upon the City of Richmond may be delegated in writing by the City to persons or entities acting in the beneficial interest of or in the employ of the City. 59.1.10 MAINTENANCE OF STORMWATER RUNOFF CONTROL MEASURES (a) Maintenance Easement Prior to the issuance of any permit that has a stormwater management facility as one of the requirements of the permit, the applicant or owner of the site shall execute a maintenance easement agreement that shall be binding on all subsequent owners of land served by the stormwater management facility. The agreement shall provide for access to the facility at reasonable times for periodic inspection by the City, or their contractor or agent, and for regular or special assessments of property owners to ensure that the facility is maintained in proper working condition to meet design standards and any other provisions established by this Chapter. The easement agreement shall be recorded by the Applicant in the Wayne County Recorder's Office. The applicant shall provide a copy of the recorded easement to the Richmond Sanitary District.
