RESOLUTION NO. 2020.038
A RESOLUTION OF THE CITY COUNCIL APPROVING THE
AMENDMENT NO. 1 TO THE FREEWAY MAINTENANCE AGREEMENT
BETWEEN THE STATE OF CALIFORNIA, ACTING BY AND THROUGH
THE DEPARTMENT OF TRANSPORTATION AND THE CITY OF
LYNWOOD
WHEREAS, on January 23, 2018, the City entered into a Grant Agreement with
the State of California (State) for the construction of the Lynwood Urban Bicycle Trail
(Project); and
WHEREAS, the Grant Agreement requires the City to provide to the State
funding agency an Agreement with Caltrans and a Caltrans issued encroachment
permit; and
WHEREAS, the City in 2018 entered into a Freeway Maintenance Agreement
with Caltrans; and
WHEREAS, Caltrans has approached the City to amend the Freeway
Maintenance Agreement to assign and expand the maintenance responsibilities for the
bike trail; and
WHEREAS, since the Project site is controlled by Caltrans, Caltrans may not
issue an encroachment permit for the construction if the City does not approve the
amendment to the Freeway Maintenance Agreement.
' NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:
Section 1. That the City Council approves Amendment No. 1 to the Freeway
Maintenance Agreement attached hereto as Exhibit A in a form approved by the City
Attorney.
Section 2. That the City Council authorizes the City Manager or his designee to
make any changes and to negotiate with Caltrans on the recommended changes on the
Amendment No. 1 to the Freeway Maintenance Agreement.
Section 3. That the City Council authorizes the Mayor to execute the
Amendment No. 1 to the Freeway Maintenance Agreement in a form approved by the
City Attorney following the negotiation of terms with Caltrans.
Section 4. That this resolution shall take effect immediately upon its adoption.
