PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, Public Works Director Zech Prouse (via teleconference), City Attorney Andrew Rawlings and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: LoAnn Belnap, Kevin Casper, Clint Jolley, Alban Hatch, Sherri Hatch, Carol Spain, Russell Spain and Doug Tolbert. Mayor Gubler welcomed everyone and Council Member Thompson led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of August 18, 2020 were reviewed. Council reviewed the finance reports for the period ending August 30, 2020 (92% of the fiscal year elapsed). The City had $1,066,191.50 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council President Geray made a motion to approve the consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Approval of Engagement Letter for Fiscal Year 2020 Audit — Mayor Gubler asked if there was a cost increase from last year's annual audit. Clerk West said she would need to check her records and let them know tomorrow. Council President Geray stated he does not recall approving an engagement letter for the audit in the past. Mayor Gubler stated this is something that is done every year, prior to the annual audit. Attorney Rawlings stated the engagement letter does have a section on fees where the auditors have estimated a fee for this fiscal year of $8,000- $10,000. Council President Geray stated the fee seems high and asked if the City should research the cost of other auditors. Clerk West stated she would research the average cost for this service. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the engagement letter for Searle Hart & Associates to conduct the Fiscal Year 2020 Audit, not to exceed $10,000. Council Member Wadsworth seconded the motion. All in favor. Motion carried. Approval of FY2021 Bonneville County Sheriff's Office Contract — Mayor Gubler stated this was a discussion at last month's meeting and it is now an action item for approval or denial. Council President Geray stated he has gone through the contract and stated the only major change he recognized is the City will receive reports monthly rather than weekly from Bonneville County Sheriff's Office (BCSO). He continued and stated other than this minor change, the contract remains identical to last year's contract, including the fee. 1 Council Member McNamara stated she had some concerns and wanted to address Lieutenant Casper directly. She continued and stated her concerns for continued speeding on 55th East and noted a separate traffic incident with a family member that received no response from BCSO. Council Member McNamara continued and asked if the City of Iona has a dedicated officer now that school is back in session and the previous officers work at the schools. Lt. Casper responded to each concern individually. He stated if anyone has a situation where they have called dispatch and are not receiving a response from an officer, they need to call Lt. Casper directly. He continued and stated their department cannot improve if he is not aware of these instances. He also stated they have a regional dispatch that goes through the City of Idaho Falls, so if there is a breakdown of communication in calls, he needs to be made aware to get them addressed. Lt. Casper also stated he has discussed with Mayor Gubler the option to have another portable radar sign that is assigned only to Iona to help slow down speeders on various streets within the City. Council President Geray stated this action item is specifically regarding the contract and the discussions about service details should have been discussed at last month's meeting. Council Member McNamara stated these are concerns she has regarding the contract and the service BCSO is providing the City. Council President Geray reiterated the service concerns should have been presented for Lt. Casper to address prior to tonight's discussion, which is specifically about the contract itself. Mayor Gubler asked if there were any other questions or concerns that need to be addressed prior to the motion. No comments made. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the contract with Bonneville County Sheriff's Office for Fiscal Year 2021 for the amount of $212,000. Council Member Wadsworth seconded the motion. Council President Geray, Council Member Wadsworth and Council Member Thompson voted aye. Council Member McNamara voted nay. Motion carried. Public Hearing, Final Plat Application — HLE, Inc., Pam Addition on the NW corner of 49th North and 55th East — Clint Jolley from HLE, Inc. approached the podium and stated the main change from the Preliminary Plat is the increased lot size and now all four lots will face 55th East. Mayor Gubler asked if all the water and sewer concerns have been addressed. Mr. Jolley confirmed they have been working with Forsgren Engineers and have made changes to address those concerns. Clerk West stated the City has received a final approval letter from Forsgren Engineers that is in the City Council packets. Mayor Gubler asked if anyone in the audience would like to address the City Council regarding this application. No comments made. Mayor Gubler then closed the Public Hearing portion of this agenda item. Mayor Gubler asked if anyone in the City Council has any questions or concerns regarding this application. No comments made. 2 Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the Final Plat Application of the Pam Addition on the NW corner of 49th North and 55th East. Council Member McNamara seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member Thompson: YES Council Member McNamara: YES Public Hearing, Conditional Use Permit Application — Doug Tolbert, Recreational Vehicle (RV) maintenance inside the detached shop at 2758 N. Barnes Way — Doug Tolbert of 2758 N. Barnes Way approached the podium and stated he wants to do RV repair work in his detached shop at his residence. He continued and stated he has talked to all his adjoining neighbors. He also stated he has done this type of work 20 years ago in his shop, but it was on a much larger scale. Mr. Tolbert stated his neighbor, Russell Spain, brought up concerns regarding the noise, at the Planning & Zoning (P&Z) Meeting held earlier in the month. Mr. Tolbert stated he has since talked with Mr. Spain and did an experiment with the door closed to illustrate the amount of potential noise that would take place. He continued and stated he believes that addressed Mr. Spain's concerns. Council Member Wadsworth asked if Mr. Tolbert would be limiting the number of units outside the shop. Mr. Tolbert stated he would keep all units being repaired in the shop. He also stated it takes approximately one year to rebuild an RV and he has no retail customers. Council President Geray stated this Conditional Use Permit sounds like a business and requested Attorney Rawlings to help interpret the type of business this would be considered and the permits that would be required. Attorney Rawlings asked Mr. Tolbert if he would be building RVs or refurbishing them. Mr. Tolbert stated he would be mostly repairing ones that he has built in the past. Attorney Rawlings read definitions from the City Code, such as "Light Industrial" and "Heavy Industrial", in an attempt to help categorize this type of business. Council Member Wadsworth asked if customers would be coming to the shop to look at units to purchase. Mr. Tolbert said there would be no customers at his shop because he is not selling the units retail. Council President Geray asked if this would be considered an "Industrial Home Occupation". If so, this would not be allowed in any Residential Zone. Attorney Rawlings stated that would be determined by variables as mentioned in the definitions, such as excessive noise, etc. Council President Geray stated if this is classified as a "Manufacturing Home Occupation", that is also not allowed in any Residential Zone. Discussion continued to clarify the Home Occupation definitions in the City Code, Mr. Tolbert's business specifics and if this business is allowed in a Residential Zone. Council President Geray stated if the Council determines this is an occupation and categorizes it as either manufacturing or industrial, this business does not qualify for a Conditional Use Permit in a Residential Zone. Attorney Rawlings agreed. Clerk West inquired if the City Code has a definition for "occupation". She continued and asked if Mr. Tolbert is purchasing an RV and taking one year to repair it before selling it privately, does it qualify as an occupation? Council President Geray read the definition of "Home Occupation" from the Iona City Code 11-1-5: "Any business, operation, profession, or craft that: (a) is conducted in a residential zone established under Chapter 3, 4, 4A, or 5 of this Title; (b) is incidental and secondary to the use of 3 the dwelling for dwelling purposes; and (c) which is carried on primarily by the immediate members of the family residing on that lot." Council President Geray stated he believes this business would be considered a Home Occupation, according to the above definition. He continued and stated this business is not a permitted use and is not eligible for a Conditional Use Permit. Mr. Tolbert stated during the application process, he was unsure if he needed a Conditional Use Permit because he does not have customers. Clerk West stated this application was difficult to categorize, which is why she submitted it to the City Council to interpret and discuss. Mayor Gubler stated the P&Z approved this application based on their own interpretation of the City Code. Council President Geray stated the P&Z also does not have the City Attorney at their meetings to defer to during these discussions. Mayor Gubler stated the City Council needs to make a decision according to what the current City Code reads. Council President Geray stated the Council has no decision to make because if this business is categorized as described earlier, they have no ability to approve the permit. Mayor Gubler asked Attorney Rawlings if there is any other interpretation the Council can consider in this situation, regarding the type of Home Occupation. Attorney Rawlings read the categories in the Home Occupation and stated he believes this business would be considered a Manufacturing Home Occupation and that is not allowed in any Residential Zone. Mr. Tolbert stated he feels the definition in the City Code for "Manufacturing" is a broad term and would apply to anyone building small crafts or sewing clothes in their garage or shop. Council President Geray agreed and asked again if this would be considered a Home Occupation. Attorney Rawlings re -read the definition of "Home Occupation". Council President Geray stated other crafts and small projects would be categorized differently because they are on a smaller scale than an RV. Mr. Tolbert stated he will be doing repairs inside an insulated shop, with the doors closed without disturbing any of his neighbors by sound or sight. Russell Spain of 2792 N. Barnes Way approached the podium and stated he and his wife came to the P&Z Meeting to voice their concerns and opposition to Mr. Tolbert's Conditional Use Permit Application. He confirmed he has since met with Mr. Tolbert and allowed him to do a grinding experiment inside his shop with the door closed to illustrate the small amount of noise that would occur during the RV repair process. Mr. Spain stated when he spoke with Mr. Tolbert, he agreed to always work with the shop door closed and agreed to limited work hours. Mr. Spain continued and stated with these conditions agreed upon, he would like to withdraw his previous opposition of this application. Mayor Gubler asked Attorney Rawlings if this business could be considered a repair service. Attorney Rawlings did state there is a classification of "Home Occupations" that is called "Service Home Occupations". Attorney Rawlings read the definition as found in Iona City Code 11-11-12(B): "A Service Home Occupation is a Home Occupation that provides services, documents, or intangible products. Examples include: professional skills, expertise, advice, salons, repair shops, school, banks." 4 Council Member Wadsworth stated he believes this could be classified as a repair shop. Mayor Gubler agreed. Attorney Rawlings stated Mr. Tolbert would also be building new parts which would disqualify it from being considered a repair shop. Mr. Tolbert stated he would be receiving new parts and repairing the RVs and would not be building any frames. Council Member Wadsworth stated he is considering this a repair shop, if all the conditions are met that Mr. Tolbert agreed to with Mr. Spain. Attorney Rawlings stated if the Council considers this a repair shop under the "Service Home Occupations" classification, there may be other conditions the City would need to consider as well. He continued and defined all requirements for a business to be considered a "Service Home Occupation" (Iona City Code 11-11-13(C)). Sherri Hatch approached the podium and stated if Mr. Tolbert owns the RVs and is only working on one per year, she believes anyone in the City can work on their own vehicles in their own shop. Mayor Gubler replied and stated this situation is different because Mr. Tolbert is intending to complete these repairs as a business. Council President Geray stated if the consensus among the Council is to classify this business as a "Service Home Occupation", Mr. Tolbert is required to obtain a Business License. He continued and mentioned there was a situation in the past regarding a building permit for the shop and asked Mr. Tolbert if that situation had been rectified. Mr. Tolbert stated he added a carport to the back of his shop and was under the impression he did not need a building permit after speaking to City officials. When the City took legal action, he paid the settlement amount and had all required inspections completed. Mr. Tolbert stated he takes a lot of pride in his home and his work. He also stated he respects his neighbors and has visited with each of them prior to this meeting. Council Member Thompson asked Mr. Tolbert if he would have any employees. Mr. Tolbert confirmed he will not have any employees. Attorney Rawlings stated if the City classifies this business as a "Service Home Occupation", it may also be considered a "Small Service Home Occupation" if the business is visited by fewer than 10 individuals per calendar month. He continued and stated if this is the case, it is a permitted use and does not require a Conditional Use Permit. Attorney Rawlings continued and stated a business license would not be required if the business is a sole proprietorship. Mr. Tolbert stated his business is an S-Corp. Attorney Rawlings then confirmed a business license would be required, but a Conditional Use Permit would not. Mayor Gubler asked if anyone from the public would like to address the Council regarding this item. No comments made. Mayor Gubler then closed the Public Hearing portion of this agenda item. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the Conditional Use Permit for Doug Tolbert with conditions including working hours only between 8am-6pm, maintain noise levels that are not disruptive to the neighbors and that Mr. Tolbert apply for a Business License to operate the business. Attorney Rawlings stated if the Council determines this to be a "Service Home Occupation", it would be considered a "Small Service Home Occupation" and therefore does not require a Conditional Use Permit. Mayor Gubler agreed and stated the Council needs to decide on a classification for the business and the motion needs to be voted on or disregarded. Council Member McNamara seconded the motion. A roll call vote was taken: 5 Council President Geray: NO Council Member Wadsworth: NO Council Member Thompson: NO Council Member McNamara: NO Council President Geray asked the Council which classification is most appropriate. Mayor Gubler stated he is classifying this business as a "Small Service Home Occupation" because he does not have more than ten visitors per month. Attorney Rawlings stated if the Council agrees, the next action required would be to deny the Conditional Use Permit because it is not necessary. He continued and stated Mr. Tolbert would then need to apply for a Business License to be voted on at next month's City Council Meeting. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to deny the application for the Conditional Use Permit, based on it not being necessary, deeming this business a "Small Service Home Occupation". Council Member McNamara seconded the motion. All in favor. Motion carried. Public Hearing, Amendment to Iona City Code § 11-11-26, Private Access Roads (Ord. 245-09-20) — Mayor Gubler stated this item was tabled from last month's meeting due to necessary changes as recommended by the P&Z. Clerk West stated this section of the City Code deals with "flag lots" and the private roads necessary to access those lots. Attorney Rawlings stated this amendment adds the term "flag lot" for convenience and removes the permit necessity. It still maintains the same requirements and specifications for those private access roads. Mayor Gubler asked Director Prouse if he approved the changes. Director Prouse confirmed his approval. Mayor Gubler explained to members of the audience the history of this section and that this amendment is mostly for clarification. Sherri Hatch asked if there was a minimum width for the private access road. Mayor Gubler confirmed the minimum width for this type of road is 20'. Mayor Gubler asked if anyone from the audience had any other questions on this agenda item. No comments made. Mayor Gubler then closed the Public Hearing portion of this agenda item. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Ord. 245-09-20; an Ordinance of the City of Iona, Idaho; amending Section 11-11-26 of the Iona City Code; removing permit requirement for private access roads while preserving requirements for such roads; providing for methodology and severability; and establishing an effective date. He also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Thompson seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member Thompson: YES Council Member McNamara: YES Public Hearing, Amendment to Iona City Code §§ 11-12-1 and 11-12-2, Off -Street Parking requirements (Ord. 246-09-20) — Mayor Gubler stated this amendment is to clarify the City Code for better understanding regarding off-street parking requirements. He stated these clarifications were made due to recommendations from the P&Z. 6 Mayor Gubler asked if anyone in the audience had any questions. No comments made. Council Member Thompson made a motion to approve Ord. 246-09-20; an Ordinance of the City of Iona, Idaho; amending Section 11-12-1 of the Iona City Code; clarifying general off-street parking requirements; amending Section 11-12-2 of the Iona City Code; altering certain standards for off-street parking; describing methodology; providing for severability; and establishing an effective date. He also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council President Geray seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member Thompson: YES Council Member McNamara: YES General Water System Discussion — Mayor Gubler stated this item was discussed at the Work Meeting held just before this meeting. STAFF REPORTS: Director Prouse stated nothing to report. Clerk West stated nothing to report. Council Member Thompson asked if the Trunk or Treat is still planned. Clerk West confirmed there will be a Halloween activity, but we will know the extent as it gets closer and the regulations Eastern Idaho Public Health has set at that time. Council President Geray stated the Veterans Day Program will be on Wednesday, November 11, 2020, but the time and location are still to be determined. Council Members Wadsworth, Thompson and McNamara stated nothing to report. Attorney Rawlings stated nothing to report. Mayor Gubler stated the Mayor's Youth Advisory Council is now running for the new school year. He stated they are meeting the second and fourth Wednesdays at the City Building and new members are welcome to join.
