EMERGENCY ORDINANCE NO. 71 -3, held on Dec. 10, 1971.
AN EMERGENCY ORDINANCE OF THE TOWN OF GULF STREAM, PALM BEACH
COUNTY, FLORIDA, PROVIDING FOR ADOPTION BY REFERENCE "THE
FLOOD PROTECTION REQUIREMENTS" AS SET FORTH IN PARAGRAPH
1910.3(a) OF THE NEW REGULATIONS GOVERNING THE NATIONAL FLOOD
INSURANCE PROGRAM AS PUBLISHED IN THE FEDERAL REGISTER ON
SEPTELBER 10, 1971 (36 R.R. 18175 -86).
WHEREAS, NEW regulations and requirements governing the National
Flood Insurance Program have been established and reprinted from the
Federal Register, 36 F.R. 18175 -86; and
WHEREAS, the Federal Insurance Administration of the Department
of Housing and Urban Development has identified this entire community
as an area of special flood hazards, and, though more precise informa-
tion derived from the Flood Insurance Rate Study is not yet available,
adoption of that portion of "The Flood Protection Requirements" as set
forth and contained in Paragraph 1910.3(a) of the NEW Regulations gov-
erning the National Flood Insurance Program as appears in the Federal
Register 36 F.R. 18175 -86 is required prior to December 311 1971 if
the Town of Gulf Stream is to retain its eligibility to qualify for
"Flood Insurance Coverage ":
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN
OF GULF STREAM, FLORIDA:
Section 1. Paragraph 1910.3(a) of the Federal Register 36 F.R. 18175 -86
be and is hereby adopted in full, and is as follows:
(1) Require Building Permits for all proposed construction or other
improvements in the community;
(2) Review all building permit applications for new construction or
substantial improvements to determine whether proposed building
sites will be reasonably safe from flooding. If a proposed build-
ing site is in a location that has a flood hazard, any proposed
new construction or substantial improvements (including prefabri-
cated and mobile homes) must (i) be designed (or modified) and
anchored to prevent flotation, collapse, or lateral movement of
the structure; (ii) use construction materials and utility e-
quipment that are resistant to flood damage; and (iii) use con-
struction methods and practices that will minimize flood damage;
(3) Review subdivision proposals and other proposed new developments
to assure that (i) all such proposals are consistent with the
need to minimize flood damage; (ii) all public utilities and fa-
cilities? such as sewer, gas, electrical, and water systems are
located, elevated, and constructed to minimize or eliminate flood
damage; and (iii) adequate drainage is provided so as to reduce
exposure to flood hazards; and
(4) Require new or replacement water supply systems and /or sanitary
sewage systems to be designed to minimize or eliminate infiltra-
tion of flood waters into the systems and discharges from the
systems into flood waters, and require onsite waste disposal systems
to be located so as to avoid impairment of them or contamination
from them during flooding.
This Emergency Ordinance shall take effect and be in force from
date of adoption.

Dear Mr. Worthing:
This will acknowledge receipt of your communication of October 22,
and I have perused the information that you had attached and can
find nothing that would in any way affect continued issuance of
building permits in your town if you comply with paragraph 1910.3,
subparagraph Al -4 inclusive and as amended by letter from Federal
Insurance Administrators and as quoted in the third paragraph of
their communication.
We here do not have compliance with these paragraphs, consequently,
we are not fully aware of all the conditions that must be met and
whether or not you are in a position to comply.
I trust that we have answered your question relative to the matter
so that you will be able to proceed with your plans. If there is
any further data that we can give you, please advise.
