HomeMy Public PortalAbout012-1989- ZONING - 647 INDIANA AVENUEORDINANCE NO. 12-1989 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 647 INDIANA AVENUE FROM C-4 GENERAL BUSINESS DISTRICT TO M-1 LIGHT INDUSTRIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY FOR A VECHILE IMPOUND STORAGE AREA. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325- 1968 designates and describes as C-4 General Business District the property located at 647 Indiana Avenue; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from C-4 General Business District to M-1 Light Industrial Special Use District, and to authorize the Special Use of said property for a vehicle impound storage area; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of ,1989, at which time remonstrances were heard from all parties interested in or affected by this Ordianance; and, WHEREAS, the vote of the Richmond City Plan Commission was to in favor of/in opposition to recommending the passage of Amended Ordinance No. 12-1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to M-1 Light Industrial Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of the northeast quarter of Section 31, Township 14, Range I West in Richmond, Wayne Township, Wayne Coutny, Indiana, and being more particularly described as follows: Beginning at the southeast corner of said northeast quarter and running thence west along the south line of said northeast quarter, One thousand four hundred six and eighty five hundredths (1,406.85) feet, thence north seventy five (75) feet to the north right of way line of the Pennsylvania Railroad Co., thence north 2 degrees Ordinance 12-1989 Page 2 46 minutes east, one hundred seventy three and fifty eight hundredths (173.58) feet to the point of beginning. Hence west two hundred and twelve (212) feet, thence north 2 degrees 46 minutes east, four hundred eleven and forty two hundredths (411.42) feet to the south right of way line of Indiana Avenue, thence east two hundred and twelve (212) feet, thence south 2 degrees 46 minutes west, four hundred eleven and forty two hundredths (411.42 feet to the point of beginning, containing an area of two (2) acres. SECTION 2. That as provided in Articles 34, and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed for a vehicle impound storage area. SECTION 3. That as a condition of being granted the Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a. The Special Use site plan and narrative submitted in the Special Use petition shall be marked Exhibit "A" and made a part of this Ordiance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required.
